HomeMy Public PortalAbout2002.134 (09-17-02)RESOLUTION NO. 2002.134 A RESOLUTION OF THE CITY OF LYNWOOD AUTHORIZIIVG THE MAYOR TO EXECUTE A JOINT POWERS AGREEMEfVT BETWEEN THE CITY OF LYNWOOD AND THE CITY OF LOS ANGELES. WHEREAS, the City of Los Angeles has invited a group of cities including the •~ City of :Los Angeles to create a Regional Agency; and l, WHEREAS, Members shall not be assessed the startup costs for the Agency of approximately $150,000, which have been borne by the City of Los Angeles As a Member, the City of Los Angeles will contribute existing staff and resources totaling approximately $300,000 per year to the Agency; and ~ WHEREAS, funding,will be provided by each additional Member jurisdiction at $ 15 per ton of disposal per year with the year 2000 as the base year, subject to adjustments as directed by the Board This fee will be due at the beginning of each fiscal year; and ~ WHEREAS, the City of Lynwood's initial share of the cost of the agreement will be $13,276 This amount is based on the base year 2000 DRS report of 88,509 tons at $ 15 per ton of disposal WHEREAS, the Regional Agency will enable member jurisdictions to report as a single entity for AB939 compliance and allow each jurisdiction to benefit from regional diversion programs; and . WHEREAS, with total waste generation of 10 million tons per year, Los Angeles can absorb the inherent fluctuations of the Disposal Report System, which has ,~ created many problems for smaller cities, such as the City of Lynwood, striving to reach the f I 50% divecsion rate , 1,~ ~ WHEREAS, by reporting diversion as a single regional entity, the DRS becomes more accurate In addition, jurisdictions that are implementing many programs but still not achieving numerical compliance can average #he diversion and disposal number across all members and thus have a diversion rate that is above 50%, and WHEREAS, the City Council of the City of Lynwood wishes to meet AB939 diversion requirements of 50% NOW, THEREFORE, be it resolved by the City Council of the City of Lynwood as follows~ Section 1 That the Gity Council authorize the Mayor to execute the Joint Powers Agreement between the City of Lynwood and the County of Los Angeles Section 2 That the City of Lynwood shall enter into an agreement with the City of Los Angeles to execute a Joint Powers Agreement establishing the Los Angeles Area Integrated Waste Management Authority (LARA) Section 3 That this resolution sha-I become effective immediately upon its , adoption ~ ~ ~ i . ~ PASSED, APPROVED AND ADOPTED this ~ ~~-fi day of September ,2002 ATTEST. z~~ ~~ e~~ ANDREA L.
