Mr Fitzer has submitted plans for a multi-phase demolition project at his property at 20 Taylor Street that would be coordinated with the subdivision of his property that is the subject of the footprint application. A permit for the initial phase of the demolition has been granted by the City of Tybee. I understand from speaking with Mr. Fitzer that his desire is to subdivide out a 12,260 square foot lot from his existing lot ONLY if the DNR will issue a footprint permit assuring him of his ability to build a home on the new lot. After reviewing the Demolition plans, as well as the proposed subdivision plan, I concur that the proposed subdivision would not violate any zoning laws upon the completion of the proposed demolition, and the normal subdivision process if in fact the footprint permit is granted as submitted and the subdivision completed as proposed. This process is complicated by the fact that a concrete structure would have to be removed prior to the subdivision being done. This letter in NO WAY grants any authority to Mr Fitzer to undertake the proposed subdivision, or proposed demolition that would be obtained through normal applications &processes with the City of Tybee pending approval of the footprint permit by the DNR. FOOTPRINT PERMIT FOR 20 TAYLOR STREET, TYBEE ISLAND GEORGIA This application is for a footprint permit to define the buildable area for an oceanfront lot that is to be subdivided out of the existing property in Chatham County Georgia. The intended use is private, and will include the construction of a new 2 level residence with parking underneath as well as the demolition of a 1936/1958 addition to the existing 1898 fort structure. There will be no clearing activity involved in the project. Elevations will remain the same as they are today. The total square footage of the lot is 12,250 square feet. The total area under the footprint(impacted area) equals 2897 square feet. Our proposed project exceeds the design standard of retaining at least 1/3 of the property in its naturally vegetated &topographic condition.(2897 divided by 12,250 =23.6%) All of the proposed construction will meet or exceed the applicable hurricane codes and will be certified by the appropriate Architects & Engineers at the time of construction permitting. The alternatives that were considered for this application include the following: 1. Not building- which is economically unfeasible. 2. Placing a portion of the lot in a perpetual conservation easement. The proposed site is NOT over a Landfill/Hazardous waste site as evidence from the internet verifies. We feel that the DNR should grant this permit for the following reasons: 1.We do not feel the project will increase the alteration of the dynamic dune field, or the function of the sand sharing system as it will be located 10' behind the already disturbed dune area line. 2. We are certain that our project will NOT interfere with the conservation of marine life, wildlife, or other natural resources as the area has been substantially impacted from an earlier clearing from the previous owners, and we intend to stay 10' behind the already impacted area. We intend to leave ALL jurisdictional areas in a natural state and mow the non jurisdictional areas. The 10' front & side setback areas will be restored with native landscaping. 3. We are certain that our project will NOT interfere with access by and recreational use and enjoyment of public properties impacted by the project. There is an existing dune crosswalk for the property located adjacent to the Western property line that will now serve 5 families instead of 4. Include additional CONSTRUCTION DRAWINGS as needed to clearly show the proposed project and how the project will be completed. For SHORELINE ENGINEERING ACTIVITIES (Bulkheads, revetments, etc) show typical construction methods with respect to mean sea level for tiebacks, footings/foundations, type of material, slope of face, etc. For BOARDWALKS (walkways, decks, etc.) and PIERS show typical arrangement of posts/beams/decking, height above the dunes and existing vegetation, the height above any waters and the details of how and where boardwalks leave and meet the ground. For Parking Lots and other site improvements, show the type of surfacing, extent of curbing, drainage system, curb cuts, planting schemes, etc. S Include the amount of fill and grading work that will take place. Indicate this graphically on the drawings and give total volume amounts. Adjoining Property Owners On a copy of the plat,please show the names and addresses of adjacent property owners (include owners across the waterway). If the names of these property owners cannot be determined, you must provide an affidavit that you have diligently but unsuccessfully searched for this information. This search must include records of the local government's tax assessor's office. Zoning Letter and Signed Drawings from Local Government:, Have your plans reviewed by the local government and submit: 1. a letter from the local zoning authority stating that this proposal does not violate any zoning laws.This letter must be specific to the project and cannot be conditional in any way. 2. a copy of the most current version of your plans signed and dated by the local zoning authority. If the project is redesigned, the zoning authority must sign the latest plans. This ensures that there will be no confusion about which "version"of the project was approved. Certification that Project Meets Hurricane Design Standards Have your project engineer or architect certify that the project has been designed to meet applicable hurricane-resistant building standards. Shore Protection Ordinance The proposed residence would not require any type of variance with regard to Tybee's Shore Protection ordinance. The first floor of our existing residence extends some 80' seaward of the proposed dune line. Applying the current ordinance to our residence &the Kaplan residence does not encroach upon Tybee's Shore Protection line. Crosswalk When we purchased our home in April, 2007 from the Turner's we were approached by David Paddison. Mr. Paddison has an interest in an adjacent landward lot to our property along with Mr. Critz. David was involved with the construction of the recently installed crossover adjacent to our home. David informed my wife Cathy &I that one of the conditions of the DNR permit was that the owner of our property would be allowed to utilize the crossover. We assume this was done to discourage multiple crossovers. We do not assume that there is any opportunity to expand the usage of the crosswalk to a subsequent purchaser of our proposed lot. Perhaps the opportunity here is to allow the purchaser of our proposed lot to utilize the existing crossover. A new crossover could possibly be permitted& constructed between our property&the Seascape Condominium property to allow the owners (6) at Seascape to have beach access that doesn't violate Tybee's ordinance Dynamic Dune Area We fully appreciate the function of the dynamic dune area, and are committed to protecting and preserving it. We simply feel that there are several issues that should be considered with regard to our application. 1.) The property that comprises the existing 1St floor of our home is approximately 80' seaward of the proposed dune line on the NE side of the proposed lot. The dune line on the adjacent(Kaplan property)lot appears from the mowing& routine maintenance to be in line with the Western terminus of our proposed NW dune line, 2.) We have not altered the dune at any time since we took possession of the property in 2007. We were unaware that there had been any previous alteration of the dune until we were involved with a renovation of our home that involved re-grading the back yard to alleviate a significant flooding &mold problem. We drove a crane onto the mowed area assuming that it was the "lot"that was represented to us during our"Due Diligence", before purchasing the property,to hoist a mini excavator onto the rear yard. We had to remove 2 courses of block& did this to insure that we had zero impact on the dune area. We did not remove any material from any portion of the dune system. The only material that was moved was sand that was removed from on top of our Battery during the re-grading. The sand was deposited on the Eastern side of our battery well behind the Shore Protection Line. Ann Thran was involved when we did this work and can verify these facts. Historic Significance The vast majority of the battery that we are proposing to remove was built in 1958 and represents a continuing liability. A portion was built in 1936. The Battery Fenwick was built in 1898. The wing that we are proposing to remove is covered by what was in 1958, a block swimming pool, and a block stairwell, neither of which conform to any codes, both of which pose a problem with our insurer. The abandoned pool is an eyesore that causes water to seep through the ceiling of the wing that we are proposing for removal. I am attaching a letter from Cullen Chambers,the Executive Director of the Tybee Island Historical Society regarding the historical significance of our property that was addressed to the previous owner, Mr. Turner, dated October 27,2005. Mr. Chambers clearly states "that there are absolutely no restrictions placed upon your property due to its inclusion in The National Register of Historic Places."He goes further to state "the only restriction your property is limited by is local ordinances". There have been serious alterations to this historic structure by previous owners. Our intention is to preserve the original 1898 battery in its current state. The permit placards and permit conditions are attached to this letter. All decision documents (attached), as well as all other plans, documents and materials submitted during the application process become terms of this permit and are now enforceable conditions. The permit allows for the construction and maintenance a single-family residence and landscaping in the State's Shore Jurisdiction to be located landward of the landward toe of the dune designated by DNR staff on the survey by Whitley Reynolds, dated March 19, 2008. Part of a wall structure attached to the old battery will be removed to allow for the new structure and driveway. The proposed subdivided lot will consist of approximately 12,260 square feet of which approximately 9,827 square feet is within the State's jurisdiction. This permit does not resolve actual or potential disputes regarding ownership of or rights in or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 3. All plans, documents, and materials contained in this permit application, required by the Shore Protection Act O.C.G.A. 12-5-230 et. seq. are a part of this permit and conformance to such plans, documents, and materials are a condition of this permit. No change or deviation from these plans, documents, and materials shall be permitted without prior notification and approval by the Department or Committee. 4. No further encroachment or construction shall take place within State jurisdiction, except as permitted by the Shore Protection Committee. Any modification of the plans or structure in the jurisdictional area must be reviewed and approved by the Department prior to construction. 5. A construction placard will be required to be obtained from the Department up to 30 days prior to the start of project construction and must be posted at the site. This placard will include certain steps in the construction of the permitted project that must be approved by the Department prior to construction. 6. The exact location and configuration of this project must be reviewed onsite and approved by Department staff immediately prior to beginning construction. No construction materials maybe disposed of in the jurisdictional area of the Shore Protection Act. 8. Any incidental impacts associated with the construction of this project must be rectified by restoring areas to their pre-construction topographic and vegetative states. 9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. The permit must be posted onsite within twenty-four(24) hours of beginning construction. 13. A copy of the above conditions must be supplied to the person in charge of construction. SPECIAL CONDITIONS: 1. No construction is permitted seaward of the landward toe of the dune. The footprint shall be reduced so that the entire structure is behind the toe of the most landward dune as designated by DNR staff on the survey by Whitley Reynolds, dated March 19, 2008. 2. The mowed area seaward of the toe of the most landward dune must be restored with native vegetation. 3. A landscape plan must be provided to the Department for approval prior to installation. Landscaping will consist of native species and shall not change the jurisdiction of the Shore Protection Act in the future. 4. Should the dunes shift landward,which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic area. 5. During construction, no materials or equipment can be stored in the dune area.During construction, silt fence must be placed landward of the existing dune to clearly delineate the dune area where no impacts are permitted. 6. All proposed driveways must be constructed of pervious materials. 7. In order to minimize the disruption of nesting activity from artificial lighting from the subject parcel, the permit must comply with the attached conditions entitled, "SHORE PROTECTION ACT O.C.G.A. § 12-5-230 SPECIAL PERMIT CONDITIONS REGARDING ARTIFICIAL LIGHTING SPECIFIC TO SENSITIVE SEA TURTLE NESTING AREAS"when developing a lighting plan for the subject parcel. 8. Prior to construction, the lighting plan for the subject parcel must be approved by the GA DNR Nongame Conservation Section. 9. The applicant proposes a footprint to construct and maintain a single-family residence with porches, and a driveway in the state's shore jurisdiction. Currently, a single-family residence built over the remains of a Fort Screven battery exist on the site. The applicant proposes to subdivide the property and build an additional single-family residence on the site. Part of a wall structure attached to the old battery will be removed to allow for the new structure and driveway. The proposed subdivided lot will consist of approximately 12,260 square feet of which approximately 9,827 square feet is within the state's jurisdiction. The applicant proposes to locate the 2,522 square feet residence approximately 10' seaward of the toe of the most landward dune on the western side of the property and approximately 35' seaward of the toe,of the most landward dune on the eastern side of the property. Approximately 905 square feet of the proposed residence will encroach into the dunes. Access to the proposed residence is through a driveway running behind the existing battery. The driveway will be constructed of pervious material and parking will be under the structure. Approximately 451 square feet of driveway will be in the state's jurisdiction. FOOTPRINT PERMIT FOR 20 TAYLOR STREET, TYBEE ISLAND GEORGIA This application is for a footprint permit to define the buildable area for an oceanfront lot that is to be subdivided out of the existing property in Chatham County Georgia. The intended use is private, and will include the construction of a new 2 level residence with parking underneath as well as the demolition of a 1936/1958 addition to the existing 1898 fort structure. There will be no clearing activity involved in the project. Elevations will remain the same as they are today. The total square footage of the lot is 12,260 square feet. The total area under the footprint (impacted area) equals 2897 square feet. Our proposed project exceeds the design standard of retaining at least 1/3 of the property in its naturally vegetated &topographic condition.(2897 divided by 12,260 =24%) All of the proposed construction will meet or exceed the applicable hurricane codes and will be certified by the appropriate Architects & Engineers at the time of construction permitting. The alternatives that were considered for this application include the following: 1. Not building- which is economically unfeasible. 2. Placing a portion of the lot in a perpetual conservation easement. The proposed site is NOT over a Landfill/Hazardous waste site as verified by Tybee & evidence from the internet verifies. We feel that the DNR should grant this permit for the following reasons: 1.We do not feel the project will increase the alteration of the dynamic dune field, or the function of the sand sharing system as it will be located 10' behind the already disturbed dune area line and is well landward of the adjacent structures on both sides of the project. 2. We are certain that our project will NOT interfere with the conservation of marine life, wildlife, or other natural resources as the area has been substantially impacted from an earlier clearing from the previous owners, and we intend to stay 10' behind the already impacted area. We intend to leave ALL jurisdictional areas in a natural state and mow the non jurisdictional areas. The 10' front & side setback areas will be restored with native landscaping. 3. When we looked at the properties on Fifth, it seems that all of the habitable space is below 35 ft so there is no problem there. What I think is a problem is the roof over the stairwell being higher than the 35ft&actually higher than the roof over the elevator shaft.While elevator shafts are exempt from the height limit so that the roof over it &access to service it could go over 35 ft, that does not now appear to be the situation here. I think that unless there is some reason related to the functioning of the elevator that the roof in the area over the stairwell has to be higher, it should be made to conform. I think this may have been done for appearance reasons &while it may look better to some, I do not think that is permissible&we do not need to start efforts by builders to go over the height limit under that theory or others claiming that it was permitted to occur here, so they should be allowed to do it. We will have to see what these builders say about why it is the way it is. I can readily see how this one got by given the configuration of the structures &the fact that access is permitted to exceed the limit when needed which is ordinarily the situation-that is the access &the shaft are under the same roof segment. ON Fitzer,this is a difficult issue because it is a renovation &is on an existing battery. There is no longer a natural grade on the property & has not been for over 50 years. There are numerous elevations all over the property which is now occupied. I think we agree I need to point out the error as we see it in the elevation certificate & I will do so, but I don't think that necessarily addresses the issue of the elevation that may be used from which to make the improvements as far as height is concerned. The owner is contending the elevation should be at almost 17 ft based on the current status of the property& home. There are floors below that level in that are part of the home but are actually more or less underground from the beach side.There are other issues as well, such as whether to use elevations from the dunes on the property on the river side. Some of the elevation issues relate to other code type considerations that are not directly involved in the height issue-such as lack of exits on the "underground " portions, FEMA,etc. I am trying to narrow down the specific issues on the issue of the height alone &it seems the only was is where the elevation to begin the measurement is & how it is determined. If you are able to find any records relating to the Alexander/Wright property please let me know. I think the property there is different in several respects but I want to remain as consistent as possible. I know you are adamant that the elevation suggested by the owner is not realistic& I do not necessarily disagree, I am just concerned that the uniqueness of the property as compared to the code, could result in an interpretation that no one would be happy with.
