ORDINANCE NO: 600
AN ORDINANCE CHANGING THE ZONING CLASSIFICATIONFROM "C-t) TO .,C-2(PLANNED UNIT DEVELOPMENT)" ON
CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE
CITY LIMITS OF BEL AIRE, SEDGWICK COUNTY, KANSAS.
WHEREAS, The legal description of the tract of land is as follows:

Lots 4, 5, 6, and a portion of Lot 7, Block l, Arthur Heights, Bel Aire, Sedgwick County,
Kansas, all as set forth on a map attached hereto, and identified as
WHEREAS, A public hearing was convened on the matter of rezoning the described tract on
August ll, 2016, by the Planning Commission for the City of Bel Aire, Kansas in conformance
with the requirements set fortb in Article Five of the Zoning Resulations of the Citv of Bel Aire.

WHEREAS, Following the public hearing, the Planning Commission found that the evidence
supported recommending approval of this requested zone change based upon the guidelines set
forth in Article 5.01 of the zoning Regulations of the city of Bel Aire, Kansas;
WHEREAS, The Planning Commission for the City of Bel Aire, Kansas recommends approval
of the application by the property owner to change the above described tract of land, as described
above, from C-1 to C-2 (Planned Unit Development), in conformance with the terms of the plat
and a Development Agreement entered into between Developer and the City, and with specific
conditions as follows:
1. SIGNAGE. Signs shall be allowed of such type and size, and in such location, as approved
as part of the building permit process. All signage shall comply with the applicable
regulations of the City associated with PUD. Signs are to be maintained by the property
owner indefinitely, unless transferred to a homeowner's association, or equal resolution
approved by the City. The current billboard shall be removed as soon as the existing land
lease associated with such billboard expires. No new or replacement billboards miy be
placed upon the property.
2. ROADWAYS, PARKING, DRIVES, AND ACCESS. The Developer shall install privare
parking, drives and access controls per city ordinance and regulations.3. LIGHTING. A security and parking lighting plan shall be submitted to the City for
approval and shall comply with all applicable ordinances and regulations. Outdoor lighting
sources shall be directed downward and shall employ cutoff luminaries or shields tominimize light trespass and glare on the adjoining residential properties. A three
dimensional photometric plan will be required, and shall be approved in writing by the City
prior to utilization of outdoor lighting. Lighting shall not negatively impact visibility of
nearby traffic signals.
4' LANDSCAPING AND SCREENING. A draft Landscape Plan, as shown on the sire plan,is representative of the landscaping to be provided as each phase of the Development isimplemented. The Landscape Plan for each phase shall bi created by Developer and
approved by City, showing contours, utilities, size and spread of plants at planting, anytype of ground cover, and/or shrubs, and such Landscape Plan shall be substantlittv in
accordance with the approved draft plan.5' RESERVE MAINTENANCE. Developer will provide continuous maintenance fbr allidentified reserves, common areas, and ponds within the Development as well as 45th andWoodlawn Road rights-of-way.
6. HOURS OF OPERATION. Self-storage hours of operation will be limited ro rhe hours of7:00 a.m. to I l:00 p.m.
7 ' PAINT COLORS UPON STRUCTURES. Paint colors for all buildings shall be limited to
earth tones as approved by the City Manager. The self-storage units shall be residential incharacter with hip roofs and asphalt shingles.8' RESIDENTIAL USE. One (l) future residential home/office is allowed on the site.9' REMOVAL OF EXISTING STRUCTURES. All three existing buildings shall beremoved from the site within six (6) months of Development Agreement approval.
10. FENCING- Fencing shall be limited to black *.orght iron along the exterior of theDevelopment, including frontage roads, and shall utilize 6' (six footfconcrete or masonry
walls for other areas, sucb as around buildings, trash containers, and other needs within theinterior of the development.
I l' LIMITATION OF USE OF STORAGE UNITS. No businesses, hobbies, repairs, or orhernon-storage activities/uses shall be permitted to occupy any storage unit(s). No outdoor
storage shall be permitted within the storage unit facility.
l2' WATER LINE. A water line within the Development, as approved by the City Engineer,connecting with the existing water line located along the south boundary of tire property(running along 45tn Street North to a line along Woodlawn on the east line of theDevelopment), so as to form a water line loop, with such water line to be deemed dedicated
to the public' and such water line to be sized in accordance with city engineering standards.The City will work with the Developer to determine the timing, phasiig, and financing ofthe waterline so as to facilitate the Development.
l3' DRAINAGE- Storm and surface water drainage and detention facilities to be constructedwithin the approximate sixteen thousand ( 16,000) square foot detention pond as shown anddesigned on the site plan, with the detention pond/ficility to be maintained by Developer.The Developer shall maintain existing drainage patterns and develop the site in such amanner as to not dam water upon adjacent properties.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:

SECTION 2' All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3' This Ordinance shall take effect and be in force from and after publication of itssummary in the Ark Valley News, an official city newspaper.
