AGREEMENT.
This agreement made in duplicate and entered into this Af2—�`eu
day of , 1923 , by and between the I077A ROAD BUILDING C0I2-

�TNESSETH:
First Party agrees to furnish approximately

Second Party agrees to pay freight Charges on material called for in this

3. Upon the arrival of material called for in this contract First
warty hereby agrees to apply the material with Modern nd Pressure
1-chinery on such streets or roads in the e of ,
as are designated by Second Party.
4. Seco Pe y here< <grees to also pay the First Party the sum
of . 1-'� . . .( ��¢�.Cents per gallon for the applying of the
material to t e streets or roads, said amount to be paid in cash immedi-
ately after the application of the contents of each car.
5. It is also understood that Second Party will pay to the Railroad
delivering this material, any demurrage which may accrue according to the ,
rules of said Railroad, for any tank car which may be held or detained.
However, First Party agrees to apply contents of a tank car in forty-eight
(48) hours time, and if for any reason the First Party is the cause of any
Rail -
delay on unloading the car or cars, the First Party will then pay the Rail-
road demurrage for a corresponding length of time as caused by reason of a
delay on the part of the First Party.
6. Second Party also guarantees that First Party will be able to
hire local horses and driver at customary local prices, to pull said First!
arty's Oil Distributor. (This will be three horses and one driver.)
7. If at any time before the delivery of material called for in
this contract, should the First Party be selling this grade of material
for a less price than stated in this contract, then Second Party shall re
ceive the benefit of said lesser price.
A8. It is understood that the guarantee on amount of Freight,
mentioned in Paragraph Two of this agreement, is based on present Freight
Rates, and should these rates be increased before the delivery of all the
Material called for in this contract, then Second Party shall pay any
such increase; and should there be a decrease in said rates, then Second
Party shall receive the benefit of said decrease.
9. Neither Party shall be liable for a breach of this contract
occasioned by causes beyond its control, and it is also understood that
this contract embodies the full understanding, is not effected by any
verbal agreements and is of subject to countermand.

the purpose of considering the purchase of Road -Oil, and all such other
business as may coma legally before the council.
This moating to be held on March 15 1923, at 7:00 oclock P.M. at
tho regular councilroom.
