McHarg Roberts and Todd, who were being recommended for an additional „oning
study. Mr. Stanley Whitman of the Bal. Harbour Shops read a sta^:ement, abjectintr
to the extension of the moratorium. After discussion, on motion of Mr.. Davis,
seconded by Mr. Taplin and voted Resolution No. 256 was adopted.
Mr. Maley said he recommended that two firms be retained to do a final
Business District zoning study. Along with oallace Mcitarg Roberts and Todd
he would like to have the firm of Charles Kober. & Associates. He said he had
talked to both firms and they have agreed to work together. inasmuch as the
specifics had not been worked. out it was moved by Mr. Davis, seconded by Mr.
Taplin and voted that the appointments be deferred until. March 28th.
Mayor Printup read a letter from Mrs Robert C. Graham, Sr. thanking the
the village for the flowers sent on the occasion of her 90th birthday.
On motion of Mr. Davis, seconded by Mr. Taplin, the meeting was adjourned
at 10:30 A.M.

COUNCIL MINUTES
March 28, 1978
Mayor
The Council of Bal Harbour Village met Tuesday, March 28, 1978 at 9:30
A.M. in the Village Hall.
Present: Messrs. Beatty, Davis, Krez, Printup and Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan Gold, Village Attorney.
On motion of Mr. Krez, seconded by Mr. Davis, and voted the minutes of
the meetings of February 28, March 14, and March 21, 1978 were approved as
submitted.
Mrs Wagner read a statement regarding her husoand's Cardiac i?ehabiiition
Center and asked that his letter regarding the Longevity Center at the Americana
Hotel be read. (Mr. Taplin arrived at this time). The setter was read by fir.
Maley. After statements by Mr. Shepard Broad, attorney for the Longevity Center,
and Mr. Joseph Weil, attorney for Dr. Wagner, Mr. Gold told the council that
the question is whether or not the business as stated is "solely and incidental
to the hotel". It was moved by Mr. Davis, seconded by Mr. Krez that the Longevity
Center be granted an occupational license during the contract period only, with
no guarantee of renewal. The motion carried; Messrs Beatty, Davis and Krez
voting "yes"; Mr. Taplin, "no"; Mr. Printup abstained due to a conflict of
interest. It was moved by Mr. Davis, seconded by Mr. Beatty and voted that Mr.
Gold and Mr. Maley should survey the code and recommend changes to more clearly
define permitted businesses on the ocean front district..
Mr. Boris Dramov from Wallace McHarg Roberts and Todd explained their
proposed program and time table for the Business District zoning study. Mr.
Maley said the funds for the study would be available in the General Fund from
other departments. Mr. Gold said he would give a written opinion on the possible
use of tourist funds for this study. After discussion with those present, on
motion of Mr. Davis, seconded by Mr. Taplin, the firm of Wallace McHarg Roberts
and Todd was retained together with Charles Kober and Associates for the zoning
study at a cost not to exceed 336,000.00. The motion passed with Messrs. Davis,
Krez, Printup and Taplin voting "yes"; Mr. Beatty "no". Mr. Beatty said his
negative vote was due to the fact that he did not understand where the 136,000.00
was coming from. Mr. Gold recommended that all previous reports be documented
for the consultants.
On motion of Mr. Taplin, seconded by Mr.

Mr. Maley said that he had been looking at street sweepers and found that
there are four basic sweepers made by three manufacturers, ranging from $9,000
to $11;,000. He asked for council's approval to purchase the Tenant. Model /1 92
at a cost of approximately 313,000.00. It was moved by Mr. Davis, seconded by
Mr. Taplin, and voted that the sweeper be purchased.
On motion of Mr. Davis, seconded by Mr. Krez, and voted, Mr. Maley was
appointed bargaining agent for the Village for the Police Benevolent Association
contract which will expire September 30, 1978.
Mr. Maley reported that Mayor Printup, Mr. Davis and he had attended
meetings of the North Dade County Cities group and they feel that this organ-
ization is overlapping the work of the Dade County League of Cities. It was
moved by Mr. Beatty, seconded by Mr. Davis, and voted that Pal Harbour would
withdraw from this group.
Mr. Maley said he had been notified that under. LF-77-166, the State of
Florida will designate 96th Street as a. State Road by 1982. It was the council's
opinion that Mr. Gold should investigate this Law to see what authority we have
in this matter.
Mr. Maley .tdvi ed the council than. Mr. ?'hilli.p Gabler, Laison Officer
from the Dade County office of Economic Development had offered their service:;
if the Bal Harbour Council wished to discuss with our hotels their feelings
about remaining in operation in Bal Barbour.
On motion of Mr. Davis, seconded by Mr. Krez the meeting was adjourned
at 11:55 A.M.

April 25, 1978
The Council of Bal Harbour Village met Tuesday, April 25, 1978 at 9:30
A.M., in the Village Ha11.
Present: Messrs. Davis, Krez, and Printup
Absent: Messrs. Beatty and Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and William Berger, representing the Village Attorney.
On motion of Mr. Davis, seconded by Mr. Krez, the minutes of the previous
meeting of March 28, 1978 were approved as submitted.
Discussion followed on the format of the Council minutes. On advice of
the Village attorney it was reconfirmed that they would be written in abridged
form.
Ordinance No. 200. regarding rules for the use of the beach was tabled
until Mr. Gold could get an opinion from the Attorney General. Mr. Berger read
Mr. Gold's opinion on the use of the beach.
Mr. Maley said he had attended a public hearing with the Department of
Transportation regarding the designation of 96th Street as a State Road. He
said it was Mr. Gold's and his opinion that we could not stop it unless we
challenge their functional classification. At the change -over there will be
an agreement with Surfside, Bay Harbor and Bal Harbour regarding street lights,
planting, etc.
