HomeMy Public PortalAbout1985-013Member moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. k - RESOLUTION REGARDING PROVIDING MUNICIPAL WATER AND FIRE PROTECTION SERVICE TO WALTER G. ANDERSON COMPANY WHEREAS, Medina has created development district No. 1, pursuant to Minnesota Statutes, Chapter 472A and TIF districts Nos. 1-1 and 1-2, pursuant to Minnesota Statutes, Sections 273.71 to 273.78; and WHEREAS, the development program and TIF plans for said districts call for Medina to construct a public water system and water storage facility to serve the development district, includ- ing the Anderson property at 4535 Willow Drive; and WHEREAS, Anderson is constructing an office/warehouse/ manufacturing facility on its property at the above address; and WHEREAS, Anderson wishes to utilize the public water system and water storage facility in lieu of expending funds for the construction of similar private systems but wishes to be assured of the timely completion of said systems. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA that the city council expresses its intent to do the following: 1. Medina will construct a public water system to provide water to property within the development district, including Anderson's, no later than May 15, 1985. The systems shall be designed to provide 900 gallons of water per minute with a minimum of 20 pound pressure per square inch for a period of two hours. 2. Medina will construct a water storage facility for the benefit of property within the development district, includ- ing Anderson's, no later than November 15, 1987. The storage facility shall be designed to provide 1500 gallons of water per minute with a minimum of 50 pounds pressure per square inch for a period of three hours. 3. Medina will deem its failure to construct the systems in a timely fashion to be an element of hardship on the part of Anderson in regard to any permits or approvals Anderson may seek in order to construct a private above -ground water storage facility on its property.
