FRANCIS CAREER COLLEGE, ~~ THEREBY DENYING APPEAL NO. 2002-04 AND ~ UPHOLDING THE DECISION OF THE PLANNING COMMISSION TO APPROVE MODIFICATION OF CONDITIONAL USE PERMIT NO. 32 AND VARIANCE NO. 2002-10; TO PERMIT THE OPERATION AND EXPANSION OF ST. FRANCIS CAREER COLLEGE, ON THE 5T" FLOOR AND HALF OF THE ~T" FLOOR, LOCATED AT 3680 IMPERIAL HIGHWAY (STOCKWELL BUILDING), IN THE H-M-D (HOSPITAL-MEDICAL- DENTAL) ZONE. ~ WHEREAS, the Lynwood City Council, pursuant to law, conducted a continued public hearing on March 4, 2003; and WHEREAS, the Lynwood staff, St. Francis personnel, an°d some of the property owners having a percentage of the shared parking lot met and discussed parking issues and a comprehensive parking plan; and ~ WHEREAS, the Lynwood City Council conducted a public hearing on November I; 19, 2002 and at such public hearing, authorized St. Francis Caree'r College to occupy ~~ the 5th floor and proceed with expansion to the 4th floor of the Stockwell building. The Lynwood City Council directed staff and St. Francis staff to meet with the ten (10) property owners of a shared parking lot to discuss and agree on a parking plan; and WHEREAS, the Lynwood City considered all public oral and written ~ communication and the two (2) public hearings; and WHEREAS, the Lynwood Planning Commission, pursuant to law, conducted a public hearing on October 8, 2002, and approved the application; and ~ WHEREAS, the Community Development Department has determined that the proposal would not have a negative impact on the environment pursuant to the California Environmental Quality Act (CEQA) Guidelines, a Mitigated Negative Declaration was previously prepared and approved for the five story, 52,000 square feet building, therefore; ~ Section 1. The City Council of the City of Lynwood hereby finds and determines as follows: A. The granting of the Conditional Use Permit and will not adversely .affect the Lynwood General Plan. , B. That the proposed location of the conditional use is in accord with the objective~ of the Zoning Ordinance and the purpose of the zone in ,which the structure and land uses are located. C. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. _ H:\ W O RD FI LE\P LANN I NG\RESOS\rcso1907.counc i Lst franc is.dot - 1 - D. That the proposed conditional use will comply with each of the applicable provisions of Chapter 25, Zoning, of the Lynwood Municipal Code. E. The St. Francis Career College staff, property owner, and City staff present at the meeting agreed in principal to the conditions set forth below. F. The property owner and St. Francis Career College agree to implement and maintain such conditions identified below. Section 2. The City Council of the City of Lynwood, hereby approves St. Francis Career College comprehensive parking_ plan, denies Appeal No. 2002-04 and approves MODIFICATION of Conditional Use Permit No. 32, to allow St. Francis on the 5th floor and half of the 4th floor, subject to all conditions, restrictions and limitations set forth as follows: COMMUNITY DEVELOPMENT l. The conditional use must be acted upon within 180 days of approval. The Conditional Use Permit shall become null and void 180 days from the date of approval if not acted on within this period. One extension of 90 days will be granted if the extension is requested in writing prior to expiration. 2. The project shall comply with all applicable regulations of the Lynwood Municipal Code, the Uniform Building Code and the Los Angeles County fire Code and shall be developed in substantial compliance with approved plans on file with the Community Development Department, Planning Division, dated March 4, 2003. 3. The applicant shall meet the requirements of all other City Departments to include but not be limited to Building & Safety, Environmental Services, Fire, and Redevelopment. 4. Any proposed subsequent modification of the subject site or structures thereon shall be first reported to the Community Development Department, Planning Division for review. 5. The applicant or his/her representative shall sign a Statement of Acceptance stating that he/she has read, understands and agrees to all conditions of this resolution prior to the issuance of building permits. 6. Conditions of Approval shall be printed on the plans prior to submission to the Building and Safety Division for plan check. PLANNING DIVISION 7. This parking plan and Conditional Use Permit MODIFICATION is for the St. Francis Career College to operate on the 5th floor and half of the 4th floor only. Neither St. Francis nor the properry owner shall subJease any part of the areas approved in this application. 8. Floors one (1) through three (3), and half of floor fiour (4) shall be utilized for medical offices and services only. St. Francis Career College staff and students shall utilize the first floor building and subterranean parking facilities oniy. - • ~ li. No outside storage of materials, equipment; personnel belongin,gs of any kind , ~ shall be permitted. ~ . . . „ 12. Prior to installing signs, the applicant shalf submit detailed sign plans and obtain a sign permit. ' ~ ~ ' .- " ` 13. . The applicant shalf not reserve or install any signage in the shared parking lot or ~ parking' lot areas outside the building, , ~ 14. The applicant and/or properry owner shall submit a detailed parking plan that ~ identifies frsf -~ floor parking, subterranean parking, on-site parking, shared ~ parking lot, and parking at Emmanuel Temple Church. Such parking plans shall ~. be submitted to the Community`Developrnent Department, Planning Division. ~ 15. Arval Street, upon vacation ~would be an extension of the shared parking ~ lot to be utiiized by all ten ~(10) property owners based on their percentage. 18. The . property owner shall keep, the shared parking agreement valid for a minimum4 of forty (40) parking stalls for the ducation ~of the St. Francis Career ~ Coflege. ~ ~ ~ ~ • 19. ~ The property owner and St. Francis shall pursue shared parking agreements with {` other ~ ro erties and shalf ursue urchase of ad'acent ro erties or ro erties in ,; . ' The property owner shail work with City Planning staff to analyze, review and pursue additional and/or alternafive parking facilities and parking metlio,ds in , order to provide additional. parking, reduce parking and traffic ci.rculation, and improve parking and traffic~ safety. . All construct+on shall meet or exceed the minimum building standards that are referenced in the following codes: The Uniform Building Code - 1998 edition; ~, The Uniform Plumbing Code - 1998 edition; The Uniform Mechanical Code - 1998 edition; The Los Angeles County Fire Code 1999 edition; The National Electric Code - 1996 edition; All as amended by the California Building Code of 1998. In case where the provisions of the California °Building Code, the Lynwood Municipal Code, or the plans or specifications in these .plans may conflict, the more restrictive provisions shall govern. ENVIRONMENTAL SERVICES DEPARTMENT ~ 22. Submit parking plans to meet~ parking requirements set forth by City of Lynwood Planning Division. ,~ LOS ANGELES COUNTY FIRE DEPARTMENT + F 23. The applicant and property owner shall comply, with all provisions set forth by the Los .Angeles County Fire Department.
