BOULEVARD, IN THE CB-1 (CONTROLLED BUSINESS) ZONE,, LYNWOOD, CALIFORNIA. THE SPECiAL PERMIT UPHOL~S THE DECISION OF THE PLANNIIVG COMMISSION APPROVAL OF CONDITIONAL . USE PERMIT NO. 2003-01. WHEREAS, the Lynwood City Council, conducted a hearing to consider the special permit request on March 4, 2003; and , ' V1/HEREAS, the Lynwood Planning Commission, pursuant to law, on February 11, 2003, conducted a public hearing and approved Conditional Use Permit. No. 2003-01 thereby recommending the City Council authorize a dance hall; and WHEREAS, the City Council and Planning Commission considered all public oral and written testimony offered at the two (2) hearings; and WHEREAS, the Community Development Department has determined that the proposal is categorically exempt for the provisions of the California Environmental Quality'Act (CEQA) pursuant to section 15301(a). > Section 1. The Lynwood City Council hereby finds and determines as follows: ' A. The site of the subject property and structure is adequate in size and shape to accommodate a dance hall within the existing restaurant. B. The project would be consistent with and comply with all development standards set forth in Lynwood Municipal Code Section 25-16.27 pertaining to dance halls, nightclubs, and places of public assembly. C. The granting of the Conditional Use Permit will not adversely affect the General Plan and is consistent with the General Plan Land Use Designation. , " D. The location of the conditional use is in accord with the objectives of the r zoning chapter and the purpose of the zone in which is the site is located. ~ V E. The location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public healfh, safety, or welfare, or materially injurious to properties or improvements in . the vicinity. The City Council of the City of Lynwood, based upon the aforementioned findings and determinations, hereby approves the Special Permit request for Conditional Use Permit No. 2003-01, provided the following conditions are implemented and complied with at all times. ~ a . ; CONDITIONS OF APPROVAL COMMUNITY DEVELOPMENT DEPARTMENT 1. The business establishment shall comply with all applicable regulations of the Lynwood Municipal Code, the California Building Code, the Health and Safety Code,and the Los Angeles County Fire Code. 2 Any proposed subsequent~ modification of the subject site or structures thereon shall be first reported to the Community Development Department, Planning Division, for review. ' 3. The applicant and/or his representative shall sign a Statement of Acceptance stating that he/she has read, understands, and agrees to all conditions of this resolution prior to issuance of any building permits. PLANNING DIVISION 4. All applicable construction permits and approvals for the project and existing business shall be obtained within one hundred eighty (180) d'ays from the date of approval. 5. All vehicle access areas and parking stalls shall be permanently paved and maintained. The applicant shall provide fifty-eight (58) parking stalls and such parking stalls shall be striped and have concrete bumper guards. 6. The property shall be maintairied in a neat and orderly manner at all times. No outside storage of supplies, materials, or items of any kind shall be permitted. 7 The applicant shall submit a detailed lighting plan for the parking lots areas and the exterior of the buildings to the Planning Division. 8. The applicant shall submit a detailed security plan to the Planning Division. Such security plan shall address the interior and exterior of the establishment and be maintained for the duration of the conditional use permit. 9. Prior to installing or altering any signs, the applicant shall submit a sign plan and application to the Planning Division. 10 Their shall be no adult entertainment activities at any time pursuant to Lynwood Municipal Code Section 25-16.19. 11. All conditions of approval shall be printed on the cover page of plans prior to submittal to the Building Division for any permits. 12. A trash enclosure shall be provided and surrounded on three (3) sides by solid masonry, brick or concrete walls a minimum of five feet (5') in height and shall be enclosed with a solid sight-obscuring gate of the same height. The refuse container(s) shall have secure lids. 13 At no time shall the bar area be open or operate between 2:00 a.m. and 6:00 a.m daily. No alcohol sales between 2:00 a.m. and 6:00 a.m. 14 The applicant shall not exceed building occupancy loads as established under the Uniform Building Code, Los Angeles County Fire Code, or which may be more restrictive. ~ ° 15 The applicant shall not allow patrons to loiter outside the building or in the parking lot areas. 16 No alcohol shall be allowed outside the premises. 17. The applicant shall submit a detailed landscaping and permanent irrigation plans to the Planriing Division. ~ ~ 18. The applicant shall submit a detailed parking and traffic circulation plan to the Planning Division. 19 Th'e applicant shall obtain a"dance hall permiY' from tlie Business License Division prior to conducting such public dances. 20 If the dance hall and/or alcohol sales lapse or discontinue for a period of six (6) consecutive months, the Special Permit and Conditional Use Permit No. 2003-01 shall become null and void. ~ 21. The application may be brought back to the City Council and/or Planning Commission in six (6) months for review of compliance with conditions and code requirements. , ~ BUILDING AND SAFETY DIVISION 22 All construction shall meet or exceed the minimurn building standards that are referenced in the following codes: The Uniform Building Code - 1997 edition; The Uniform Plumbing Code - 1997 edition; The Uniform Mechanical Code - 1997 edition; The Los Angeles County Fire Code - 1997 edition; The National Electric Code - 1996 edition; All as amended by the California Building Code of 1998. In case where the provisions of the California Building Code, the City of Lynwood Municipal Code, or the plans or specifications in these plans may conflict, the more restrictive provisions stiall govern. ~ PUBLIC WORKS DEPARTMENT 23; Reconstruct lifted sidewalk along Abbott Road adjacent to the building. FIRE DEPARTMENT ; ,~ 24. The applicant shall comply with all code requirements and conditions set forth by "~ the Los Angeles County Fire Department, Fire Frotection Division, 5823 Rickenbacker Road, Commerce, CA 90040-3027, (323) 890-4243. Section 3. A copy of this Resolution and its conditions shall be delivered to the applicant~ ~ Section 4.
