ORDINANCE NO.602
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON CERTAINPROPERTY TO PAY THE COSTS OF INTERNAL IMPROVEMENTS IN THECITY OF. BEL AIRE, KANSAS, AS HERETOFORE AUTHORIZED BYRISOLUTTO _13_2g,R_13_30, R_13_31, R_13_32, R-13-34, R_13_40 AND R_13_41; ANDPROVIDING SPECIALASSESSMENTS.
WHEREAS, the governing body of the City of Bel Aire, Kansas (the ,,City,,) has heretoforeauthorized certain improvements (the "Improvements") to be constructed pursuant to K.S.A. 12-6a01 etseq..(the "Act"); and
WHEREAS, the governing body has heretofore conducted a public hearing in accordance withthe Act and desires to levy assessments on certain property benefited by the construction of theImprovements.
NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITYOF BELAIRE, KANSAS:
Section 1. Levy of Assessments.
Improvements:
For the purpose of paying the costs of the following described
Project No. I - Courtyards at Erk creek - Sewer Improvements
Originally Authorized by Resolution No. R_13_10
Construction of lateral sanitary sewerto serveLots I through 14, Block l; Lots 4l - 50, Block l;and Lots I - 15, Block 3, in the Courtyards at Elk Creek aoaltion to the City of Bel Aire, Kansas.
Project No. 2 - courtyards at Erk creek - water rmprovements
Originally Authorized by Resolution No. R_13_13
Construction of water distribution system, including necessary water mains, pipes, valves, hydrants,and appurtenances to serve Lots 41 - 50, Block l; Lots I - 15, Block 3, in the Courtyards at ElkCreek Addition to the City of Bel Aire, Kansas.
Project No. 3 - courtyards at Erk creek - paving Improvements

construction of pavement on Prestwick Avenue from the nofthwest edge of Elk creek Drive to thesouthwest corner of Lot 40, Block I ; Paving Prestwick lane from the southwest corner of Lot 46.

Block I to a point approximately 238 feet south serving Lots 46 through 50, Block l, in thecourtyards at Elk creek Addition to the city of Bel Aiie, Kansas.
Project No. 4 - Rock spring Addition: phase 3 - paving Improvements
Originally Authorized by Resolution No. R_13_29
That there be constructed pavement on Rock Spring from the south line of Rock Spring Addition,to the south line of Lot 22,Block2, Rock Spring aoaition; Chris from the east side of Lycee to thewest side of Rock Spring; and Chris from the west side of Rock Spring to the east line of Lot22,Block 2, Rock Spring Addition.
That said pavement on Chris between aforesaid limits be constructed for a width of twenty-four(24) feet from gutter line to gutter line, and each gutter to be two and one-hal f (2-l/2) ieet inwidth' making a total roadway width of twenty-nine (29) feet; and that said pavement on RockSpring between aforesaid limits be constructed for a width of thirty (30) feet from gutter line togutter line, and each gutter to be two and one-half (2-112) feet in *idtn, making u t6tul roadwaywidth of thirty-five (35) feet; with plans and specifications to be furnished by theCity Engineer ofthe city of Bel Aire, Kansas. Drainage to be installed where necessary.
Project No. 5 - Rock Spring Addition: phase 3 - Sanitary Sewer Improvements

A lateral sanitary sewer to serve Rock Spring Addition (Phase 3), according to plans andspecifications to be furnished by the City Engineer of the City of Bel Aire,kansas.
Project No. 6 - Rock Spring Addition: phase 3 - sidewalk Improvements

That there be constructed a 4' sidewalk on the north side of Chris from the east line of Lycee to thewest line of Rock Spring; a 4' sidewalk on the south side of Chris, from the east line of RockSpring to the east line of Lot 8, Block 4, Rock Spring Addition; and a 5' wide sidewalk on the eastside of Rock Spring from the south line of Chris to the south line of the Addition, according toplans and specifications to be furnished by the City Engineer of the City of Bel Aire, Kansas.

there are hereby levied and assessed the amounts (with such clerical or administrative amendmentsthereto as may be approved by the city Aftorney) against the property described on Exhibit A attachednereto.
Section 2' Payment of Assessments. The amounts so levied and assessedin Sectionl of thisordinance shall be due and payable from and after the date of publication of this ordinance. Suchamounts may be paid in whole or in part within thirty (30) days from the date of this Ordinance.
Section 3. Notification. The City Clerk shall notifu the owners of the propefties described inExhibit A attached hereto insofar as known to said City Clerk, of the urnount, of their respectiveassessments; and, said notice shall further state that unless such assessments are paid within thirty (30)days from the date of this ordinance, bonds will be issued therefor, and the amount of such assessmentwill be collected in installments with interest.
Section 4' Certification. Any amount of special assessments not paid within the time prescribedin Section 2 hereof shall be certified by the City Clerk to the Clerk of Seigwick County, Kansas, in thesame manner and at the same time as other taxes are certified and will be collected in twenty (20) annualinstalfments, together with interest on such amounts at arate not exceeding the maximum rate therefor asprescribed by the Act. The Ordinance levies special assessments on certain property located in Courtyards at Elk CreekAddition, Rock Spring Addition, Wolff Addition, Tiera Verde South Addition, und Ly""" HeightsAddition, which have been benefitted from certain internal improvements constructed pursuant to K.S.A.l2-6a01 et seq. and provides an opportunity for prepayment, in whole or in part, of said specialassessments. A schedule of the amounts of said ;pecial assessments and the prop".ty benefitted areattached to the ordinange-. Any amount of special asiessments not paid within the time irescribed in theordinance shall be certified by the City Clerk to the Clerk of Sedgwick County, Kanias, in rhe samemanner and at the same time as other taxes are certified and will be collected ln annual installments,together with interest on such amounts at a rate not exceeding the maximum rate therefor as prescribed bylaw.
