HomeMy Public PortalAbout1978-04-25 MeetingMr. Maley advised the council that Mr. Phillip Gabler, Laison Officer .from the Dade County office of Economic Development had offered their services if the Hal Harbour Counc.i.l wished to discuss with our hotels their feelings about remaining in operation in Rai Harbour. On motion of Mr. Davis, seconded by Mr. Krez the meeting was adjourned at 11:55 A.M. Mayor Attest: Village, Clerk March 28, 1978 COUNCIL MINUTES April 25, 1978 The Council of Bal Harbour Village met Tuesday, April 25, 1978 at 9:30 A.M., in the Village Hall. Present: Messrs. Davis, Krez, and Printup Absent: Messrs. Beatty and Taplin Also present were Fred W. Maley, Village Manager; Mary Village Clerk; and William Berger, representing the Village Attorney. T. Wetterer, On motion of Mr. Davis, seconded by Mr. Krez, the minutes of the previous meeting of March 28, 1978 were approved as submitted. Discussion followed on the format of the, Council minutes. On advice of the Village attorney it was reconfirmed that they would be written in abridged form. Ordinance No. 200. regarding rules for the use of the beach was tabled until Mr. Gold could get an dpinion from the Attorney General. Mr. Berger read Mr. Gold's opinion on the use of the beach. Mr. Maley said he had attended a public hearing with the Department of Transportation regarding the designation of 96th Street as a State Road. He said it was Mr. Gold's and his opinion that we could not stop it unless we challenge their functional classification. At the change —over there will be an agreement with Surfside, Bay Harbor and Bal Harbour regarding street lights, planting, etc.  2  Mr. Maley read Mr. Gold's opinion regarding the use of Resort Tax monies for rezoning studies. It was Mr. Gold's opinion that up to 40% could be used due to the impact on Tourism by the Bal Harbour Shops. At the request of Mr, Davis, Mr. Maley said he would give further study the ratio of Resort Taxes to Ad Valorem Taxes. Mr. Weyersberger and Mr. Whitman said they thought they should be reimbursed for their studies. Mr. Davis suggested that our consult ants determine what value they were to their studies. A memo read from Mr. Gold regarding the ownership status of the streets in Residential District and "Camden Drive extended" in the Business District in which he said he had asked the attorneys from Bal Harbour Club and Bal Harbour Shops for their opinions on the matter which will be discussed at the May meeting. Due to the appearance presented by a wooden fence across a vacant lot it was the councilEs opinion that Mr. Maley should write the owner and ask for a detailed landscaping plan and that Mr. Maley and Mr. Gold should study the matter of what type of fence should be allowed. After consideration on motion of Mr. Davis, seconded by Mr. Krez and voted the six months operating statements were filed for audit. On motion of Mr. Krez, seconded by Mr, Davis, and voted, Mr. Davis was reappointed to the Dade County League of Cities Board of Directors to represent Bal Harbour. It was moved by Mr. Davis, seconded by Mr. Krez and voted that Mr. Printup would be designated as the alternate. Contracts for the Tourism Matching Fund program were presented from the Singapore, Beau Rivage and Regency Hotels, On motion of Mr. Krez, seconded by Mr. Davis and voted the Contracts were approved. Mr. Maley explained that we owed P.N.M. Corporation a total of a12,500 as final billing for the beach access wall and walkway. He said it was the opinion of the engineers that a late completion penalty should not be assessed as no harm had been done to the Village, It was moved by Mr, Davis, seconded by Mr. Krez and voted that the payment be made. On motion of Mr. Davis, seconded by Mr. Krez and voted the Americana Hotel was granted permission to use the garage space for convention purposes through December 8, 1978. Mr. Maley said our consultants on the Business District rezoning had requested a public hearing on May llth at 1:00 P.M. Mr. Maley was asked to check to see if this meeting could be held earlier in the day. Mr. Maley reported that the survey for the beach landscaping had been completed and that the work was started today. Mr. Maley said the television cameras were being used in the Residential District storm sewers this week and if the Harbour Way lines are O.K. the eng ineers will take bids to be considered at the May meeting.
