A RESOLUTION OF' THE CITY COUNCIL OF THE CITY OF LYNWOOD
APPOINTING ~'HE CITY CLERK AS THE ELECTIONS OFFICIAL
WHEREAS, the California Elections Code and Chapter 2, Section 2-3.5 of the
Lynwood Municipal Code authorize the City Council, by resolution, to appoint an
elections official of its choice to render services in a regular or special municipal
election held in the City;
WHEREAS, on January 2002, the City Council approved Resolution No.
2002.013 appointing Faustin Gonzales as the City's election official for recall
matters;
WHEREAS, on March 21, 2003, Mr. Gonzales was placed on administrative
leave and by virtue of that action is no longer able to perForm the functions as the
City's elections official; and ~
WHEREAS, ~Resolution No. 2002.013 has been determined by the City Council
to be a violation of public policy based on a conflict of interest and therefore is
null and void; and
WHEREAS, the City Council determines that the City would be best served by a
qualified and experienced Elections Official to conduct all matters relating to
elections.
NOW THEREFORE, THE CITY COUNCIL FOR THE CITY OF LYNWOOD
ADOPTS THE FOLLOWING RESOLUTION:
Section 1. The City Council hereby appoints the City Clerk as the Elections
Officer for the City and hereby restores the duties of the elections official with that
office.
Section 2. As the elections official, the City Clerk shall perform the duties as
provided in the California Elections Code and the Lynwood Municipal Code.
Section 3. Any prior resolutions or directives of the City Council, including
Resolution No. 2002.013, that are or may be inconsistent with the provisions of
this Resolution are hereby repealed in their entirety and are of no further effect.
Section 4. This Resolution shall take effect and be in full force immediately or
as authorized by law.
Section 5. The City Clerk shall certify to the passage and adoption of this
Resolution.
