AN ORDINANCE OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, AMENDING CHAPTER 30 OF THE TOWN
CODE, TRAFFIC AND VEHICLES, AT SECTION 30 -1
RELATING TO OPERATION OF GOLF CARTS SO AS TO
PROVIDE FOR RULES AND REGULATIONS RELATING
TO THE OPERATION OF GOLF CARTS ON TOWN
STREETS; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF ORDINANCES IN CONFLICT;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS
Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby
amended at Chapter 30, Traffic and Vehicles, Section 30 -1, Operation of Golf Carts on
Town Streets, to read as follows:
"Sec. 30 -1. Operation of golf carts on town streets.
(a) All town streets located within the town and located east of
the Intracoastal Waterway are hereby designated for the use of golf carts,
which may be operated on such streets subject to the regulations and
provisions of the laws of the state and the town.
(b) Golf cart operators must observe all traffic rules and
regulations applicable to the drivers of any other motor vehicle. In
addition, the following regulations shall apply to the operation of golf carts
on town streets.
(1) All golf carts must be equipped with efficient brakes, reliable
steering apparatus safe tires, rearview mirror and red
reflectorized warning devices in both the front and rear. Golf
carts operated after dark must have functioning headlights,
taillights and turn signals.
(2) Any golf cart operating under this section shall be occupied
by no more passengers than for whom there are seats in the
golf cart.
(3) Standing in or on the golf cart is prohibited when it is in
motion.
(4) Children are prohibited from sifting in the driver's lap while
the golf cart is in motion.
(5) It is prohibited for golf carts to tow any scooter, bicycle,
skateboard, wagon or other conveyance.
(6) Golf carts that exceed the speed of 20 mph shall not be
considered golf carts under the provisions of this article and
are not afforded the rights provided herein."

Section 2. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or applications, and to this end the
provisions of this Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which
conflict with this or any part of this Ordinance are hereby repealed.
Section 4. Codification.
This Ordinance shall be codified and made a part of the official Code of
Ordinances of the Town of Gulf Stream.
Section 5. Effective Date.
This Ordinance shall take effect immediately upon its passage and approval, as
provided by law.
PASSED AND ADOPTED in a regular, adjourned session on first reading this
