ZONING INQUIRIES POLICY
Zoning inquiries are suggested to be submitted in writing to the Building Department.
The inquiry along with any response generated by the Building Department will be
maintained on record for future reference.
The Brewster Building Department fee schedule includes fees for a written response
from the Building Commissioner regarding a request for zoning opinions.
The Building Department does not have the authority pursuant to Massachusetts
General Law Chapter 40A or under Brewster Zoning Bylaws to make a determination
about the development potential of a property absent a completed building permit.
Zoning opinions are not legal opinions and legal counsel should be sought before
investing time and resources into a property.
Zoning opinions may only pertain to the time of opinion due to changes in bylaws, court
decisions and other legal influences that may impact future relevance.
