HomeMy Public PortalAbout2003.078 (05-06-03)RESOLUTION NO. 2003.078 , ~ ~~ • .~ A RESOLUTION OF THE CITY COUNCIL OF THE 'CITY OF LYNWOOD , , DETERMINING THAT A NUISANCE IS BEING MAI•NTAINED ON CERTAIN PROPEFtTY, COMMONLY KNOWN AS 3686 PLATT AVENUE, - AND IDENTIFIED AS TAX ASSESSOR'S BOOK NO. 6173, PAGE 025,' PAF2CEL .No . 002 ,_IN THE CITY OF LYNWOOD AND DIRECTING THE ~ ABATEMENT~ THEREOF ' ~ ~ WHBREAS, pursuant to the recommendation of the City Manager of the City of Lynwood, and Staff, the conditions at the site have proven to be an imminent peril to life or ad~acent property; and -, WHEREAS, rt has 6een documented that this site fias heavily impacted the Cify's resources , ~ s , , due to the excessive amount of enforcement required in trying to bring this site into compliance, and " k • . ' ' , ~ WHEREAS, this Councrl has held a hearing and has heard and considered ~all relevant ' evidence and'testimony from all interested persons desiring to be heard concerning the conditions constituting the alleged nuisance and the proposed.abateznent. ' ~ N.OW, THEREFORE, the City Councii of the City of Lynwood does hereby find, dete'rmine; order and resolve as foilows ~ ,, ', , ~ - ~ Section 1 The property descnbed as Tax Assessoc's Book No. 6173, Page 025, - ~Paccel No. 002, also known.as 3686 Platt Avenue, in the City of Lynwood, California, is hereby found and declared to be a public nuisance as defined in Chapter 3-13 1 of the Lynwood'City Code. ~ ~ ~ . - , . Section 2. The particular conditions of said property which are hereby found and determined to constitute a nuisance are described as follows ~, - 1 Single family dwelling left unsecured, transients. ~ . 2 Junk, trash, and debris scattered theoughout the property, that ~s unsightly and likely to attract vermin and rodents. _ . , 3. Overgrown vegetation likely to attract vermin and rodents orother pests. •~ ' . 4 Discarded home appliances and equipment. ' S Broken windows and doors$constrtuting hazardous condrtions. ' - , . ~ = Section 3 It is further found and determined that the methods by which said • conditions could be abated include, but are not lim~ted to 1 ~Upon obtaining an Entry and Abatement Wai•rant for this site, al] junk, trash, debcis and gang grafitti fi~om ~ site will' be removed, properly disposed of, and the srte will be maintained on a regular basis . 2 Alf points of entries to the site wrl4 be boarded up and maintained. , ` Section 4 The owner of said property, Rosa M Gutierrez and Nlaria Sandoval is , ordered and directed to take said steps and to abate said nuisance. Section 5 If the property owner fails to take the steps as provided in this resolution within five (5) days after the date this resolution is posted upon said property, the City of Lynwood shall ~mmediately ~cause the same to be abated by City personnel or private contractor and such personnel oc persons under contract are ~ ~ . ~ expressly authorized to enter upon the premises for such purposes.
