RESOLUTION NO.
RESOLUTION DECLARING A PUBLIC NUISANCE AT
2860 LAKE SHORE AVENUE IN THE CITY OF MEDINA
WHEREAS, on February 27, 1985, members of the Medina Police De-
partment made a visual inspection of the property located at 2860
Lake Shore Avenue in the City of Medina, taking several photographs
which depict an accurate representation of the property from several
directions; and
WHEREAS, the City Council also received a report from the Chief
of Police in which it was stated that the conditions depicted in the
photographs have existed for a considerable period of time; and
WHEREAS, subsequent investigation by the Chief of Police indi-
cates that the condition of the property remains unchanged as of the
date of this resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MEDINA, MINNESOTA, as follows:
1. That 2860 Lake Shore Avenue, City of Medina, consists of a
single family dwelling constructed on a single family lot ap-
proximately /z,d feet long and p feet wide, owned and
occupied by Ivan Carver.
2. That the lot contains large amounts of scrap lumber, tree stumps,
paper, and other combustible materials; inoperable and unlicensed
automobiles; unlicensed boats and trailers; numerous steel, wood
and plastic containers, portions of buildings, packing crates,
and similar combustible objects; steel piping, wires, pieces of
machinery and plastic; steel grates, wires, cages, hoses, chains,
tires and discarded construction materials and appliances, to-
gether with an assortment of unidentifiable pieces of junk.
3. That this collection of materials and debris has so completely
filled the front yard, side yard and back yard of the property
that it is impossible to traverse the area, making it impossible
to provide fire protection, police protection or protective in-
spection to the property.
BE IT FURTHER RESOLVED by the City Council of the City of Medina
that the Ivan Carver property located 2860 Lake Shore Avenue is here-
by declared to be a public nuisance and the said Ivan Carver is
hereby ordered to abate the nuisance by the removal of the debris
which is described herein, save and except for those items of sub-
stantial value which can be stored in an orderly fashion upon the
property in such a manner as to eliminate the asthetic blight and
provide free access for pedestrian traffic.
BE IT FURTHER RESOLVED that a copy of this resolution bearing
the Clerk's certification shall be served on the said Ivan Carver
and the said Ivan Carver shall abate the nuisance within 10 days of
the date of such service upon him.
BE IT FURTHER RESOLVED that upon failure of the said Ivan Car-
ver to abate the nuisance as aforesaid, the City Council shall, by
separate order, direct that the nuisance be abated by City forces,
and the costs thereof shall be certified to the County Auditor to
be extended on the tax rolls of the county against the real estate
from which the nuisance has been abated.

Whereupon said resolution was declared duly passed and adopted.
