A Public Hearing was called to order at the Village Hall, Thursday,
May 11, 1978 at 9:30 A.M. for the purpose of discussing the proposed Business
District re —zoning. The meeting was recessed and reconvened in the auditorium
of the Church By The Sea at 9:40 A.M.
Bal Harbour Shops presented experts covering the original plan for the
shopping center as planned by the Graham family and later by the Whitman interests.
Mr. Whitman explained the model of the proposed expansion of the Center. Also
making presentations for the Center were specialists on traffic and polution, both
air and noise. Mr. Perry of the Sun Bank of Miami also questioned the consultants
retained by the village on the future status of the bank.
The meeting was recessed for lunch and reconvened at 2:10 P.M.
Further presentations were made for Bal Harbour Shops by experts on lighting,
landscaping, and costs incurred to date on the parking deck structure.
Mr. Maley explained the original zoning and said the consultants need basic
facts in order to upgrade the zoning of this district.
Representatives from the Bal Harbour Enviromental Protective Association,
tenants in the Center, and hotel interests were heard on the aspect of future
development of the Bal Harbour Shops.
The meeting was adjourned at 4:30 P.M.

COUNCIL MINUTES
May 30, 1978
The Council of Bal Harbour Village met Tuesday, May 30, 1978 at 9:30 A.M.
in the Village Hall.
Present: Messrs. Beatty, Davis, Krez, Printup and Taplin
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village
Clerk; and Alan Gold, Village Attorney.
Mr. Taplin said that on the minutes of April 25, 1978 he was shown as
present instead of absent. On motion of Mr. Davis, seconded by Mr. Taplin and
voted the minutes were approved as amended.
Mr. Gold submitted his opinion to the council. He summerized for those
present his opinion -that the residential streets are privately owned, but subject
to municipal police powers. He stated that ad valorem taxes should not be used for
street maintenance in this district. The possibility of the village leasing the
streets from Bal Harbour Club was to be explored by Mr. Davis and Mr. Krez,
On the matter of Camden Drive Extended. Mr. Gold reported that he had
reviewed the abstract of that portion of the business district and the record plats
and based oithese, the street was never public and is owned by Bal Harbour Shops.
Mr. Gold said that he and Mr. Maley and Mr. Hales and Mr. Horowitz of Bay
Harbor Islands had reviewed the proposed contract submitted by the City of Miami
Beach for water service and found it unsatisfactory. We will respond with a counter
offer and the engineering firm of Ludovici and Orange have been retained to advise
us cn the techinal terms. It was moved by Mr. Davis, seconded by Mr. Taplin and voted
to table this matter until Mr. Maley and Mr. Gold could further advise the council
after a water board meeting to be held tomorrow. Mr. Gold also advised that we should
not take any action at this time regarding a new water line across the bay from Dade
County.
Mr. Gold presented suggested wording for a proposed amendment to Section
6-9a.7 of the village code covering business establishments in the ocean front pro—
perties. This is to be put into ordinance form for the next meeting.
Mr. Maley said he had reviewed the formula for use of Resort Tax monies
for the rezoning studies in the business district and he still feels thata 40%
maximum is appropriate. It was moved by Mr. Davis, seconded by Mr. Taplin and
voted that costs would be allocated on this basis.
Applications for Tourism Grant monies were submitted by the Sea View Hotel,
Ivanhoe Hotel and Harbour House. It was moved by Mr. Krez, seconded by Mr. Beatty
and voted that the applications be approved; Mr. Taplin abstained due to the applic—
ation of the Harbour House being part of the motion.
Mr. Maley said that Mrs. Pfohl had agreed to submit landscape sketches for
the front of her fence for council approval.
Mr. Maley announced that the second public workshop on the business district
rezoning will be held on June 13, 1978 at 9:30 A.M.
In regard to the beach landscaping Mr. Maley said the delay was due to back —
flow cutoffs in the sprinkler system not being in place.
Mr. Maley said that the main storm sewers in the residential section were
in excellent condition and the engineers were preparing plans for bids for the exten—
sions. It was moved by Mr. Davis, seconded by Mr. Taplin and voted that the village
advertize fsr bids as soon as possible.

Mr. Maley reported that consolidated Mutual Unsurance Company had cancelled
the General Liability Insurance as of July 1, 1978. Mr. Maley said he would like
to contact another broker if Head -Beckham could not come up with anything by the
end of the week.
There being no further business on motion of Mr. Beatty, seconded by Mr.
Taplin and voted the meeting was adjourned at 11:20 A.M.

June 13, 1978

The second Public Hearing on the Business District re -zoning was held on
Tuesday, June 13, at 9:30 A.M. in the Village Hall.
Dr. Wallace of Wallace McHarg Roberts and Todd said the presentations of
all the consultants would not be recommendations but tenative findings with their
final presentation in mid -July. Dr. Wallace said the purpose of the study and
their assignment was to analyze the business district as to visual impact, now and
later; pedestrian safety; public vehicular circulation, parking, etc.; air quality;
land uses; and impact on adjoining municipalities. Also considered will be the
imput at the public hearings.
Discussion followed on the present set backs and heights regulations of the
main buildings abd parking structure.
A summary of existing and recommended business district zoning regulations
was given by members of the consultants firm and Mr. Charles Kober.
Dr. Wallace explained that they were trying to achieve a formula some where
in between what is asked by Bal Harbour Shops and the Protective Association.
Petitions were submitted to the Consultants from the Taxpayers Association
asking no further expansion be permitted in the Shopping Center.
