RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T &M ASSOCIATES - WATERFRONT PARI(, PHASE IIB \VHEREAS, the Borough of Carteret is in need of supplemental engineering inspection fees with regard to Waterfl-ont Park, Phase II B; and . \VHEREAS, the Borough's ~ol1sulting Engineers, T&M Associates, possess the requisite skill and expertise for said services; and '''HEREAS, T&M Associates has submitted a proposal to provide said engineering services at a total cost not to exceed $6,800.00; and 'VHEREAS, ~he Mayor and Council have reviewed said proposal; 'VHEREAS, the Chief Fitlal1cial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from T &M Associates for supplemental engineering inspection fees with regard to Waterfront Park, Phase II B, at a total cost not to exceed $6,800.00 at the rate set fOlih in T~M's existing contract with the Borough is hereby approved. 2. That armexed hereto is a copy of said proposal. 3. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11-5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 4. That a copy of this resolution be forwarded to the Borough's Purchasing Depar1ment and T &M Associates. Reiman Borough of Carteret Municipal Building 61 Cooke Avenue Carteret, New Jersey 07008 o7/}t7 Re: Supplemental Engineering Inspection Fees Waterfront Park, Phase lIB Zenith Construction Dear Mayor Reiman: As a follow-up to our recent discussions, all contract work has been completed for the referenced project and we are proceeding with preparation of final closeout paperwork consisting of Final Payment Certificate and Change Order. In a related matter, also as discussed, we have notified Zenith Construction, the project contractor, that the Borough intends to exercise its rights under contract provision IB-4, Damages, and will be deducting $6,800.00 from Payment Certificate #3, as permitted under Section 18-4 of the contract, to compensate the Borough for engineering inspection fees beyond the contract completion date for the project (see enclosed letter dated September 6, 2007 to Zenith Construction). In a matter related to the $6,800.00 deduction, which represents engineering inspection fees beyond the contract completion date, we are writing to request Mayor and Council approve compensation to T &M Associates for engineering inspection efforts related to the project work beyond the contract completion date. In addition to the $6,800.00, we are requesting Mayor and Council approve of an additional fee of $10,700.00 for engineering design, contract administration, and inspection services associated with the SensOlY Garden (Danielle's Garden) project. Our engineering services provided to the Borough for the selection of garden amenities and materials, preparation of a Change Order with the contractor, and construction inspection services represent extra effort for this project not included in the or~a<le-mi'project contract. / Based on the above damages being. assessed against Zenith Construction and the supplemental engineering inspection costs assOciated with Danielle's Garden and added improvements, we respectfully request the Mayor and Gpuflcil approve an additional engineering authorization for T &M Associates in the amount of$17,S,AJO. /.
