THE LEVY AND COLLECTION OF ANNUAL ASSESSMENTS
FOR fISCAL YEAR 2003-2004 WITHiN LYNINOOD LIGHTING

ASSESSMENT DISTRICT PURSUANT TO THE "LANDSCAP.ING~
(~^ '~ AND LIGHTING-ACT OF 1972", AS AMENDED, ~
- (COMMENCING WITH STREETS AND HIGHWAYS CODE
~ ~ ~ SECTfON 22500 ET SEQ.), AND FIXING THE TIME AND
~ ~ ~ ~ PLAGE FOR HEARING PROTEST'S AND OBJECTIONS
WHER.EAS, the City Council ~has tlirected and the Cify Engmeer has
prepared and filed a report in writing containing all matters required by Council under
` Streets and Highways Code, Section 22565, et seq.; and
~ 1NHEREAS, said report has been presented to the City Councif for
consideration and has been received and approved. ~
' NOW, THEREFORE, the City Council does hereby resolve, order and
deterrriine as follows: ~ ~ ° ~
. Section 1. Pursuant fo the Landscaping and Lighting Act of 1972 as
~ amended, commencing_ wifh Streets and Highways Code Section 22500 et seq., the
~~ Gity Council of the City of Lynwood hereby declares its intention to order the levy and
i`~` collection of assessments' against the assessable lots and parcels of land within an
~: existing assessment district designated "Lynwood Lighting Assessment District (the
,"District") for fiscal year 2003-2004 to pay for°the costs of those existing and previously
proposed impro~ements described as: ~ °
~The installation or construction and maintenance and servicing of existing
and previously proposed public lighting facilities and facilities which are appurtenant
. thereto or which are necessary or convenient for the maintenance or servicing thereof,
including but not lim:ited to, electr.ic current, repair of street light standards and~fixtures
-- and incidenfal costs including labor, material and equipment. Such improverrients
constitute the maintenance~ .and operation of sid'ewalks and streets, specifically, the
maintenance and operation of existing and previously proposed public lighting facilifies
located in and along sidewalks and streets, including street lights and fraffic signals,
and facilities which are appurtenant thereto_ or which are necessary or convenient for
the main#enance or operation thereof, including the Xcost of rent, repair, replacement,
~. rehabilitation, fuel, power, eiectrical current, care, and supervision necessary. to
properly.operate and maintain public lighting facilities and traffic signals located in and
`, along' public streets within the City; and the installation and construction' of previousiy
' proposed public lighting facilities, and facilities which are appurtenant thereto or which
are necessary or con:venient foc the maintenance or operati~n thereof; which have been
j° ' or are to be paid from the~proceeds of revenue bonds."
The boundaries~of the District are conterminous wifih the boundaries of,the
- City of Lynwood. as shown on the map identified as Assessment .District Map No. 2003-
` A on file in the office of the City Clerk. , . ,
Section 2. Reference is hereby rnade to the report of the Engineer
approved by Council on June 17, 2003, by a resolution, and on file in #he office of the
City Cierk, describing in detail,the improvements to be made, the boundaries of the
assessment district and any zones therein, and the proposed assessments upon
° assessable lots and parcels of land within the District. . a
Section 3. Notice is hereby given that on July 1, 2003, at the hour of 6:00
p.m., in the Council Chambers of City Hall, 11330 Bullis Road, Lynwood, California, is
the date, hour and place fixed for the hearing of protests ~and objections by the City
Council to the levy and collection of the proposed assessments against the lots and
parceis of land within the District for fiscal year 2003-2004.
Any and all persons having any protest or objection to the proposed improvements, the
exten# of the assessment district, or the levy and collection of the proposed
assessments may appear before the City Council at said hearing and show cause why
said improvements should not be carried out and the proposed assessment and
diagram confirmed, all in accordance with this Resolution of~fntent and the report of the
City Engineer. Prior to the conclusion of the~hearing, any interested person may file a
written protest with the City Clerk, or, having previously filed a p.rotest, may file a written
withdrawal of protest. A written protest shall state all grounds of objection. A protest by
a property owner shall contain a description sufficient to identify the property owned by
him. All interested persons shall be afforded the opportunity to hear and be heard. The _
city Council shall consider all oral staternents and written protests or communications
made or filed by an interested person. ,.
Section 4. The City Clerk is hereby directed to cause notice of the
passage of this resolution to be given at the time and place in the form and manner
provided by law. ~
Section 5. The proposed assessment for fiscal year 2003-2004 of $1'.62
per foot of frontage for residentially zoned property and $3,.01 per foot of frontage for
commercially zoned property.
Section 6 This resolution shall take effect immediately upon its adoption.
