HomeMy Public PortalAbout20121015 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 15 October 2012 Page 1 of 3 MINUTES- 15 October 2012 Called to Order: 7:30 PM Hopkinton Town Hall, Room 215-216 Adjourned: 9:15 PM Members Present: Jeffrey Barnes, Frank D’Urso, Andre Griben, Craig Nation, Melissa Recos, Marcus Waldron, Bob Ingram: Conservation Scientist, Don MacAdam: Conservation Administrator Members Absent: None 7:30 PM Commission Business • The Commission signed the following documents: - Goldstein, 17 and 19 Twin Island Rd – Certificate of Compliance (188-634) - Goldstein, 19 Twin Island Rd – Certificate of Compliance (188-927) • Mr. Waldron made a motion to approve the Request for Payment dated 15 October 2012. The motion was seconded by Ms. Recos and it passed unanimously. • Mr. Nation made a motion to waive the filing fees, but not to waive any associated consultant fees, under the Hopkinton Wetlands Protection Bylaw for the filing of a Notice of Intent by the Hopkinton Parks and Recreation Department at 0 Sandy Island. The motion was seconded by Mr. Waldron and it passed unanimously. • The Commission reviewed the status of the site work at 13 Cedar Street Extension (188-1473) and determined that an as-built plan signed and stamped by a Registered Landscape Architect would be sufficient under a Request for Certificate of Compliance application. 7:45 PM Cappetta, 2 Exchange Street HCC File No. RDA 2012-13 Request for Determination of Applicability Daniel McIntyre, McIntyre Engineering & Septic Services, Inc. Mr. McIntyre provided an overview of the Request for Determination of Applicability (RDA) application and the site plans dated 15 September 2012 with a final revision date of 24 September 2012. A discussion was held regarding the location of the 100-year floodplain on the site plans. The Commission noted that elevations were not utilized by FEMA in this particular area on the Flood Insurance Rate Maps and that the proposed Title V septic system would not be located within the 100-year floodplain. Conservation Commission Meeting 15 October 2012 Page 2 of 3 Mr. Waldron made a motion to close the hearing and issue a negative Determination of Applicability with the standard and noted special conditions. The motion was seconded by Mr. D’Urso and it passed unanimously 7:55 PM Goldstein, 17 and 19 Twin Island Road DEP File No. 188-1511 Notice of Intent Sharon and Steven Goldstein, applicants/owners Mr. Goldstein provided an overview of the Notice of Intent application and the following site plans: “Proposed Conditions Certified Plot Plan of Land in Hopkinton, MA” and dated 25 September 2012; “NOI-OOC “As-Built” Existing Conditions Certified Plot Plan of Land in Hopkinton, MA” and dated 25 September 2012; Hand drawn sketch plan by applicant on plan by other entitled “Location of Haybales” and submitted on 26 September 2012; Hand drawn sketch plan by applicant entitled “Cross Section, Swale & Berm” and dated 26 September 2012; Hand drawn sketch plan by applicant entitled “Proposed Detail Plan View” and dated 26 September 2012. The Commission determined that any Order of Conditions would be conditioned so that no further additions or structures accessory to the single family home at 19 Twin Island Road could be constructed closer to Lake Maspenock in the future. The Commission determined that a revised plan must be submitted which identifies that the current dock is only a seasonal floating dock and not a permanent dock. Mr. Nation made a motion to close the hearing and issue an Order of Conditions, subject to the submittal of a revised plan, with the standard and noted special conditions. The motion was seconded by Mr. Waldron and it passed unanimously. 8:10 PM Weldon, 20 Downey Street DEP File No. 188-1481 Amended Notice of Intent The applicant contacted the Commission prior to the meeting and requested to continue the public hearing to the next available public meeting. The hearing was continued to 05 November 2012. 8:10 PM Commission Business • A discussion was held regarding the proposed project change submitted by Pulte Homes, Legacy Farms South (188-1489). Mr. Waldron made a motion to approve, as an insignificant project change, the proposed substitution of the Stormceptor 450 BMP with a First Defense FD4 F60 BMP as identified in the email from Emerald Excavating dated 10 October 2012 and the accompanying specifications, subject to confirmation from Commission’s engineering consultant, Fay Spofford & Thorndike. The motion was seconded by Mr. D’Urso and it passed unanimously. • A discussion was held regarding the tree that was cut down in the right-of-way adjacent to 240 Hayden Rowe Street. The Commission determined to have the Conservation Administrator coordinate with the Hopkinton Tree Warden on the matter. • A discussion was held regarding the status of the culvert the DPW replaced on Front Street (RDA 2003-20). The Commission determined to have DPW submit documentation on the completion of the culvert replacement. Conservation Commission Meeting 15 October 2012 Page 3 of 3 • A discussion was held regarding vegetation cutting and site clearing that occurred at 81 Front Street. • The Commission determined to notify the property owner of 0 Twin Island Road (L36 29 0) that a discarded oil tank needed to be removed from the resource area and properly disposed of. • Mr. Waldron made a motion to have Lucas Environmental review the Site Plan Review for Hopkinton Parks and Recreation Department, 0 Sandy Island and provide comments to the Planning Board in response to their request. The motion was seconded by Ms. Recos and it passed unanimously. • The Commission determined that a request from American Climbers for the removal of a root damaged tree at 20 Teresa Road qualified as a minor project exemption. • The Commission reviewed the draft charge for the Lake Maspenock Dam Advisory Group. • The Commission reviewed revisions to the draft of the revised Wetlands Protection Bylaw Regulations.
