HomeMy Public PortalAbout2003.120 (06-17-03)RESOLUTION NO. 2003.120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REQUESTING AND APPROVING THE PARTICIPATION OF THE LOS ANGELES COUNTY REGISTRAR OF VOTERS IN THE LYNWOOD RECALL FRAUD INVESTIGATION WHEREAS, the City Clerk was stripped of her duties as Election Officer in } January, 2002; and " WHEREAS, the City Council has since determined that the action taken to appoint the City Manager as Election Officer in her place was a violation of Public Policy due to conflict of interest; and • WHEREAS, City Clerk's duties as Election Officer were restored on March 2i, 2003; and WHEREAS, prior to the restoration of Elections Officer power, the City Clerk was not in the position to monitor a fair and free signature collection and election process required by State and Federal Law, nor was the City Clerk in the position to respond to complaints and other protests in connection with the recall process; and WHEREAS, since being restored as Election Officer, the City Clerk has received important information demonstrating the possibility of fraud and other malfeasance associated with the recall effort; and WHEREAS, based on a preliminary showing of possible fraud and malfeasance, Los Angeles Superior Court has granted an order allowing the City Attorney along with the Secretary of State to'review recall petition and investigate related issues of , ~ '~ ~ impropriety. . ~ NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lynwood does hereby find, determine, order and resolve as follows: Section 1. That the City Clerk is requested to cooperate fully with the City Attorney and the Secretary of State. w Section 2. That the Los Angeles County Board of Supervisors be advised of the pending Lynwood Recall Fraud investigation. Section 3. That the Los Angeles County Registrar of Voters is hereby requested to participate in the Lynwood Recall Fraud Investigation and provide~ such support and assistance as may be requested. Section 4. That the payment of costs for Los Angeles County's participation in the said recall fraud investigation is hereby approved. Section 5. That copies'of this resolution be filed with the following officers: Los Angeles County Registrar Recorder/County Clerk, Secretary of State, Counsel Secretary of State's Office, State Attorney General, US Attorney General, United States Civil Rights Commission, Assembly Member Marco Antonio Firebaugh, Congresswoman Linda Sanchez, Congresswoman Juanita McDonald, Congresswoman Maxine Waters, Congresswoman Diane Watson, County Supervisor Yvonne Brathwaite-Burke and the Los Angeles Superior Court. Section 6.
