Mr. Keller explained the traffic situation and said the available traffic data was not sufficient to complete their study. It was agreed by the members of of the council present at the hearing the Bal Harbour Village would give the Con- sultants authority to conduct the additional traffic count, on June 17th. and 18th. with formal action to be taken at the next council meeting. Dr. Wallace said their final draft of recommended change would be ready for presentation at the July council meeting. After further discussion the height of the parking garage the hearing was asjourned at 4:20 P.M. Attest: Village Clerk June 13, 1978 COUNCIL MINUTES June 27, 1978 Mayor The Council of Bal Harbour Village, met Tuesday, June 27, 1978 at 9:30 A.M. in the Village Hall. Present: Messrs. Beatty, Krez, Printup Davis, and Taplin Also present were Fred W. Maley, Village Manager; Mary T. b;etterer, Village Clerk; and Alan Gold, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Davis and voted the minutes of the meeting of May 30, 1978 were approved as submitted. On motion of Mr. Davis, seconded by Mr. Beatty and voted the minutes of the public hearing of May 5, 1978 were approved as submitted. Mr. Maley said that our Comprehensive General Insurance was being cancelled by Consolidated Mutual Insurance Company on July 1st inasmuch as that company would no longer insure governments. He said that Head -Beckham Insurance and one other agent had attempted to secure coverage for the Village the second company was unable to get any bids. A bid has been submitted by the Puritan Insurance Company of Stamford, Conn, for Comprenhensive General Liability, Auto Loability, and non - owned liability in the amount of 136,110. This does not include Police Liability, which would have to be purchased separately of available at a reasonable price. It was moved by Mr. Davis, seconded by Mr. Taplin and voted to purchase the Com- prehensive Insurance from Puritan Insurance Company. ORDINANCE NO. 200 setting the limits of liability for the Village at $500,000/ 3500,000 Bodily Injury and. 4500,000 Property Damage Liability per occurrence was adopted as an emergency ordinance on motion of Mr. Davis, seconded by Mr. Taplin and voted. Mr. Karl Hart reviewed the beach dredging contract and the history of the bidding by Great Lake Dredge and Dock Company and their performance. He said that the claim being filed by Great Lake Dredge in the amount of 31,821,000 was in his opinion fraudalent as determined by an examination of their books which hadbeen obtained through a court order. Mr. Hart asked for permission to bring Great Lakes personnel Mr.Calnon and Mr. Woods into the suit and also Western Quarles a subsidiary of Great Lakes if he deemed it appropriate after further review. He said we should file a counter claim for approximately 3250,000., plus punitive damages for the expense we are incurring over this suit. It was moved by Mr. Taplin, seconded by Mr., Davis and voted that Mr. Hart be authorized to consult with Mr. Gold and file a motion for leave by the Court to file a counter claim in our suit. A letter from the Committee of North clerk regarding Bal Harbour withdrawing from was moved by Mr. Krez, seconded by Mr. Davis and Taplin voting "yes"; Mr. Beatty "no" not Dade Cities was read by the village the Committee. After discussion it and voted Messrs Davis, Krez, Printup to participate in the meetings. 0n motion of Mr. Davis, seconded. by Mr. Taplin, and voted up to .32,500 was approved as an extra to Wallace, McHarg, Roberts and Todd fee to cover the traffic study verbally approved at the June 13th. hearing. Mr. Maley reported that bids had been opened for the extension of the storm sewers in five areas in the residential district. The bids were as follows: Sims Paving Co. '.65,700; Webb General Contracting 4100,820; L.G. Menefee Inc. 3110,862 he said that our engineers would like to meet with the low bidder before the contract is awarded. It was moved by Mr. Krez, seconded by Mr. Davis and voted to award the contract to Sims Paving Company subject to the approval of zurwelle-Whittaker Inc. Mr. Davis reported that he and Mr. Krez had met with the Board of Bal Harbour Club and discussed the ownership of the streets and planting of shrubbery with them. The Club declined the option of leasing the streets to the Village and preferred that the Village create a separate tax district for caring for the private street. Mr. Maley said he had contacted Wyatt and Company, pension acturaries about reviewing our pension plan but did not have any recommendations to make at this time. Mr. Maley read a letter from Dade County asking if Bal Harbour would consider joining the County library system, he said he had talked to Jack Jones and Jordan Davidson, trustees of our library and the possibility of operating a library our- selves has just about been exhausted. However the County will not furnish service for anything less than on the county tax basis. It was moved by Mr, Beatty, seconded by Mr. Davis and voted that the village reject the offer to join Dade County system. Mr. Maley said that a landscape plan had been submitted for Mr. Pfohl's Mr. Maley said he was going to meet with the Superintendent of the Dade County Beaches and see about having the south one-third of the beach resifted and the north end can be done by our own employees. Also he believes our private beach cleaning contractor can now be terminated. He said he was going to ask the Corps of Engineers to re -fill near 96th Street where the sand was lost to Surfside. fence. Mr. Maley told the council that when the emergency number 911 becomes a law in January 1979 that we will have to negotiate with Dade County on how our calls are passed on to the village. Mr. Maley reported that preliminary plans have been submitted to desiMnate Abbott Avenue as south bound only to relieve some of the traffic congestion.
