RESOLUTION NO. 85- C0.5
RESOLUTION IMPOSING A MORATORIUM ON
DEVELOPMENT IN THE AREA AT THE NORTHWEST
INTERSECTION OF HIGHWAYS 55 AND 101
WHEREAS, the city council of the City of Medina finds that
the formation of a new land use plan for that area of the city
north of Highway 55, west of Highway 101, south of Evergreen Road
and east of the Medina Ballroom, the boundaries of which area are
more specifically described in Attachment A hereto, is necessary
to guide future development of land in the area, to insure a
safer, more pleasant, more economic environment for residential,
commercial, industrial and public activities, and to promote the
public health, safety and general welfare of the city of Medina;
and
WHEREAS, the city council also finds that the formation of a
land use plan for the area could bring about significant savings
in both private and public expenditures, enable public and
private agencies to plan their activities in harmony with the
land use plan to be formulated, assist in developing lands more
wisely and effectively, make the provision of public services
less costly, and achieve a more secure tax base; and
WHEREAS, the city council in order to further promote the
public health, safety and general welfare of the city of Medina
intends to hold a public hearing on adoption of an interim zoning
ordinance for the purpose of protecting the planning process in
the area, regulating, restricting and prohibiting certain uses,
developments and subdivisions within the area, all pursuant to
Minnesota Statutes, Section 462.355, Subdivision 4; and
WHEREAS, the interim ordinance will not take effect until
after its publication in the official newspaper; and
WHEREAS, immediate action is needed to commence the planning
process for the area and to insure that the benefits of municipal
planning for the area are secured by the city of Medina.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina as follows:
1. The city staff is authorized and directed to halt the
processing of all requests or applications for variances,
conditional use permits, licenses, rezonings or land di-
visions or plats made pursuant to the Medina Code of
Ordinances for property located within the described area of
the city of Medina. The prohibition against the processing
of the requests and applications contained in this
resolution shall not include any applications or requests
approved by the council prior to July 16, 1985.
2. The city staff is directed to take immediate action initiat-
ing the planning process for the land use of the area by
proposing to the city council the names of one or more
consultants to prepare a plan for the area and the names of
citizens of Medina willing to serve on a task force intended
to make recommendations regarding the land use plan for the
area to the planning commission and city council.
BE IT FURTHER RESOLVED that this Resolution shall take
effect upon its adoption and shall remain in effect until the
interim zoning ordinance becomes effective, or 120 days after
passage of this resolution, whichever occurs first.
