This ordin~nce is consistent with all relevant sections. of the ~ew Jersey Deoartment of
Environmental Protection rNJDEF) Stormwater Management Rules at N.J.~.C. 7:8. .

Section 1, Chapter l60-97.5-1(F)(2) Erosion ControL Groundwater Recharge and Runoff
Quantity Standar~s. is hereby amended and supplemented to-as follows:
1. Any application for a new agricultural development that meets the definition of
major development in 9-97.3.1 shal~ be submitted to the appropriate Soil
Conservation District for review and consideration and app;-o"al in accordance
with the requirements of this Section and any appllcab1e Soil Conservation
District guidelines for stormwater runoff quantity and erosion controL For the '
purposes of this Section, "agricultural development" means land uses normally
assoCiated with the production of food, fiber: and livestock for sale. Such uses do
not include the development of land for the processing or sale of fodd and the
manufachlling of agriculturally related products.

SECTION 4.
Section I is hereby amended and supplemented to as follows:
~160-97.12.J Penalties
a Any person who violates any prOV1SlOn of this ordinance shall, upon convlctlOn
thereof in municipal Court, be punishable by imposition of the penalties set forth in
Article XVII Administration and Enforcement, Subsection 160-140.
b Each instance of engaging in a separate regulated activity, in violation of this
ordinance shall be deemed a separate offense.
c In addition, the Borough may institute civil action for iniunctive or other relief to
enforce the provision of this ordinance.
SECTION 5. Severability.
The various parts, sections and clauses of this ordinance are.hereby declared to be severable.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any
reason held invalid or unconstitutional by any court or federal or state agency of competent
jurisdiction, such portion shall be deemed a separate, distinct, and in'dependent provision
and such holding shall not affect the validity of the remaining portions hereof. .

SECTION 6. Repealer.
All ordinances or resolutions or parts of ordinances or resolutions inconsistent herewith are
hereby repealed to the extent of such inconsistency .
SECTION 7. Effective Date oJ Ordinance.
This Ordinance shall take effect immediately upon the approval by the County re\'iew
agency.
