INVOCATION: The invocation was given by City Manager Karl L. Koski. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Councilmen- Atkins, Dennis, Gillanders, Merritt, Tyrell Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Traffic Engineer Envall, Dave Willman, Temple City Times APPROVAL OF MINUTES: Councilman Dennis moved to approve the minutes of the regular meeting of the City Council held August 1, 1978, as written, seconded by Councilman Merritt and carried. 6. CONSENT CALENDAR: On motion by Councilman Merritt, seconded by Councilman Atkins, Items A through C were approved as recommended. A. RESOLUTION NO. 78 -1749: WARRANTS & DEMANDS Adopted Resolution No. 78 -1749 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $69,760.28, DEMAND NOS, 10126 THRU 10248. B. CHAMBER OF COMMERCE REQUEST RE: COMMUNITY BAZAAR, OCTOBER 28, 1978 Approved request to conduct Community Bazaar, Saturday, October 28, 9 a.m. to 5 p.m. along the sidewalks of Las Tunas Drive from Cloverly to Camellia Avenues. C. CLAIM FOR DAMAGES - DOBERT, 5841 GOLDEN WEST AVENUE City Manager Koski presented claim from Mrs. Harold Dobert, 5841 N. Golden West Avenue for damages alleged to have occurred June 8, 1978 resulting from a tree limb falling on roof and lawn. Denied and referred to JPIA. UNFINISHED BUSINESS: 7. PUBLIC HEARING: 7:30 p.m. TEMPLE CITY MUNICIPAL LIGHTING DISTRICT - REPORT OF FISCAL YEAR 1978 -79 FUNDING City Manager Koski advised that with the passage of Proposition 13 and the subsequent provisions of SB 154, funds available from the ad valorem property tax have been substantially reduced, and the proportionate share of the maximum $4 per $100 available to all taxing agencies will be determined by the Board of Supervisors. Staff has used two basic assumptions in its estimate of property tax revenue; 1) utilized FY 1975 -76 assessed valuation with a 2% Council Minutes, August 15, 1978 - Page 2 per year increase, and 2) developed a ratio between last year's lighting district tax rate and the total average tax rate within the City. The district will experience an approximate loss of $100,000 in revenue which will be offset through the use of reserve funds and $20,000 available from the State surplus. City Manager Koski advised pursuant to Street Lighting Act of 1919 the City may levy an assessment equally upon all of the parcels within a district, with some adjustments to differential between commercial, industrial, multiple and single family property uses, to generate the funds required for the operation of the lighting system. A resolution has been prepared reflecting the same tax rate as last year to be filed with the Auditor- Controller in the event action is taken by the courts affecting those special distric which are providing property related services. City Manager Koski stated it might be beneficial for a_ citizens committee to review the lighting district operations and evaluate alternative methods of generating the necessary funds for energy and maintenance of the street lighting system as previously discussed by Council. The Community Communication Committee has expressed an interest in this regard. Mayor Tyrell declared the public hearing open and invited anyone wishing to speak to the issue to come forward. There being no one come forward to speak, Councilman Gillanders moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Gillanders moved to accept the report of. the Temple City Municipal Lighting District Fiscal Year 19.78 -79 funding, seconded by Councilman Atkins and carried. Councilman Atkins moved to approve the budget for fiscal year, 1978 -79, seconded by Councilman Gillanders and carried. City Attorney Martin presented Resolution No. 78 -1750 to be used only in, the event the courts take some action affecting Proposition 13 Councilman': Atkins moved to adopt Resolution No 78-1750 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY LEVYING A SPECIAL. ASSESSMENT TAX WITHIN TEMPLE CITY MUNICIPAL LIGHTING DISTRICT FOR THE FISCAL YEAR 1978 -79, seconded by Councilman Merritt and carried. NEW BUSINESS; . 8. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of August 2, 1978 A. TEMPLE CITY BOULEVARD - LEFT TURN POCKETS City Manager Koski presented recommendation from Traffic Commission for installation of left turn pockets on Temple City Boulevard at Garibaldi Avenue, Live Oak Avenue, Broadway, Olive Street and La Rosa Drive, and a continuous left turn lane from Lemon Avenue to Camino Real. Councilman Atkins moved to set public hearing for September 5, 1978 and advise those property owners affected, seconded by Mayor Tyrell and carried. B. ALESSANDRO AVENUE, LAS TUNAS DRIVE NORTHERLY - Parallel Parking City Manager Koski presented background information, stating the Traffic Engineer made an investigation of Alessandro Avenue, northerly of Las Tunas Drive pursuant to referral from the City Council for the placement of parking stalls adjacent to the new commercial development on the west side of the street. Traffic Engineer's findings disclosed heavy parking demands with some apparent violations of driveway openings and recommended to the Traffic Commission marked parallel parking stalls be placed on the east and west sides of Alessandro between Las Tunas Drive and Woodruff Avenue, with appropriate red curb adjacent to driveway approaches. Councilman Merritt moved to approve Traffic Commission recom- mendation, seconded by Councilman Dennis and carried. 9. COMMUNICATIONS: IRECONVENE AS CITY COUNCIL: 11. ACTION ON REQUEST BY CRA: A. Petition for Stop sign - Longden and Encinita Avenues City Manager Koski presented petition received requesting an oversized stop sign at the corner of Longden and Encinita Avenue making it a four -way stop, which they feel is necessary to insure the safety of children travelling to school. Councilman Atkins moved to refer the matter to the Traffic Com- mission for their review and recommendation, seconded by Council- man Gillanders and carried. 10. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: City Council recessed at 7:45 p.m. to meet as the Community Redevelopment Agency, all members being present;approved the minutes of the regular meeting held August 1, 1978, approved request for remodeling and addition to the Herbert Hawkins building at 5770 N. Rosemead Boulevard, and adopted resolution approving warrants and demands. The minutes are set forth in full in the records of the Agency. 1 There was no action to be taken. �t 12. MATTERS FROM CITY OFFICIALS: A. Eucalyptus Tree Removal - 6500 biock 0k Avenue City Manager Koski presented petition to remove six existing Eucalyptus trees in the 6500 block of Oak Avenue. The Maintenance Superintendent's report indicates' ,,the trees are not diseased, however they are very large and unsightly and could.; present a safety hazard for those residents leaving their driveways. City has also received a letter from three of the property owners indicating their willingness to participate in the cost for the removal of the trees. Two basic policy decisions are at issue; one, whether Council,, will remove seemingly healty trees, and if so, two, whether citizen participation should be ericouraged to offset the cost. Councilman Atkins moved to continue the matter to September 5, 1978 and request the petitioners to discuss thematter with Council, seconded by Mayor Tyrell and carried.: • B. Establishment of a Non- ProfitCorporation City Manager Koski directedv,Coupc•il's attention to memo sent ..v t,p recently relating to the establishment of a non- profit corporation for the purpose of mailing the` Newsletter, which will result in substantial savings and may allow increased publication. Councilman Atkins moved to authorize staff to proceed with the necessary legal process to establish a non - profit corporation :naming the Mayor, City Manager and Assistant City Manager as officers, seconded by Councilman Merritt and carried. Mayor Tyrell directed Council's attention to final report on the Summer Youth Employment Program funded by the City which reflects that during the period June 23 to July 28, 57 requests to fill job vacancies were recorded with all but three filled for a total cost of $414 which is $13E under the budget appro- priation. D. Councilman Gillanders advised that AB 2442 which was reported in the League bulletin will allow municipalities to create their own sPeed limits without the benefit of engineering surveys, stating he is strongly opposed. He feels that municipalities hit budget restrictions due to Proposition 13 will see a source of revenue in speed traps. In his opinion, Section 40802 of the Vehicle Code provides a measure of protection against unscrupulous use of radar. He suggested that now is the time-for anyone who opposes the bill to make their feelings known in Sacramento. Councilman Gillanders also stated he was a witness and became involved in a traffic accident where a vehicle was overturned and'three others severely damaged and commended the officers for their response time and professional handling of the incident. E. Traffic Engineer Envall advised Council the traffic signal at Temple City Boulevard and Camino Real will be energized on August 17, 1978. F Mayor Tyrell directed Council's attention to the Silver Anni versary celebration of the Temple City Unified School District to be held September 30 at the Pasadena Hilton, expressing the hope the Council will support the event. Mayor Tyrell also directed Council's attention to a communication from Evergreen Convalescent Home advising of graduation exercises for certificated nurses aides and inviting Council to attend.
