The Council of Bel Harbour Villare met Tuesday, July 25, 1978, at
9:30 A. M. in the Villa.e Hall.
Present: Messrs. Beatty, Davis, Krez, and Printup
Absent: Mr. Tanlin
Also present were Fred W. Maley, Village Manager: Mary T. Wetterer,
Village Clerk; and Alan Gold, Village 'attorney.
On motion of Mr. Beatty, seconded by Mr. Davis, and voted the
minutes of the public hearing of June 13, 1978, were approved as submitted.
On motion of Mr.. Davis, seconded by Mr, Beatty and voted the minutes of
June 27, 1978, were approved as submitted.
A. Public Hearing was conducted as to the use of Federal Revenue
Sharing Funds in the amount of approximately $21,760.00. Suggested were
installation of a traffic light, a traffic survey, and fire flow study.
Mr. Maley said that in the past the money had been used for the operation
of the library. It was moved by Mr. Beatty, seconded by Mr. Davis and
voted th<t the use of funds would be determined at the next meeting.
State Representative Paul Steinberg requested the council's support
for a petition drive to put the issue of electing the Public Service Com-
mission on the September Primary ballot. After consideration, on motion
of Mr. Davis, seconded by Mr. Beatty,

was adopted endorsing the concept of a, five member elected Public Service
Commission,
Dr. Wallace reviewed the final draft of the Zoning consultants'
recommendations for the Business District and pointed out errors in the
document. Mr. Gold asked that these be li. ted in a. formal addendum.
`resentation on the final report were made by Messrs, Smith, Toop,
Keller, aid Kober, each explaining the portion they covered. Discussion
followed with the council and those present on various f cets of the
report and recommendations. (Mr. Beatty left the meeting at 11:30 A. M.
Mr. Weyersberg turned over additional petitions for Dr, Wallace regarding
expansion of the Bal Harbour `„"hops. After further discussion Mr. Gold
recommended that the council approve the preparation of an ordinance for
the first reading by title only at the next council meeting. This would
contain the recommendations in the consultants' report. After this
first reading„ two public hearings will be held, Mr. Gold then read

extending the moratorium on the Business District for ninety days while
the public hearings are being held. On motion of Mr. Davis, seconded by
Mr. Krez and voted, the Resolution was adopted. On motion of Mr. Davis,
seconded by Mr, Krez and voted., the Village Attorney was requested to
prepare an ordinance covering the suggested changes in the Business District
Zoning.
The council considered a resolution passed by Bay Harbour Islands re-
questing the Miami Dade Water and Sewer ^uthority to evaluate taking over
their water system. It was moved by Mr. Krez, seconded by Mr. Davis and
voted that no action would be taken Hri the matter, pending our contract
negotiations with Miami Beach.
Budgets for the 1978-79 fisc,11 year were presented and discussed.
On motion of Mr. Davis, seconded by Mr. Krez a.n1 separately voted Ordi-
nance No. 201 General Fund); Ordinance 203 (Sewer Department); and
Ordinance 202 (Water Department) and Ordinance No. 2O (Tourism
Department) were adopted.
On motion of Mr. Davis, seconded by Mr. Krez and voted the
application of the Saucy Crepe Restaurant for matching tourism funds
was approved.
The council considered the financial operating statements for
the first nine months operation, and on motion Mr. Krez, seconded by
Mr. Davist and voted, they were filed for audit.
Mr. Maley reported that he had been notified by the State of
Florida that they will pay 759';or up to $189,900, of the beach land-
scaping project.
Mr. Maley said th t Mr. Hart has filed the counter -suit against
Great Lakes Dredge and Dock Company, and that Shutts and Bowen were
acing to billus at an adjusted rate until thr outcome of the suit.
On motion of Mr. Krez, seconded by Mr. Davis, and voted, the
meeting was adjourned at 1:21 P.N.
