Chairman's announcements Dr. Scherzo welcomed Sherrie McCullough, Assistant Health Director who is filling in for Nancy Ellis Ice at this meeting. The VNA in conjunction with the Brewster Board of Health will hold a Child and Adolescent Immunization and Lead Screening Clinic on October 16, 2017 from 9Am - 11AM at the VNA offices at 434 Route 134 South Dennis. Residents must call 508 - 957 - 7423 for an appointment. The VNA in conjunction with the Brewster Board of Health will hold a Blood Pressure, Glucose and Cholesterol screening at the Brewster Ladies Library on October 24, 2017 from 10AM - 2 : OOPM. The VNA is currently taking appointments for the shingles vaccine. Residents can call 508- 957- 7423 for an appointment. The Board of Selectmen and the Board of Health will hold a joint meeting on October 16 to vote on a new BOH member. Correspondence from a Brewster resident was received urging Brewster homeowners to check their insurance policies for "home heating oil release" coverage. 2 . Bass River Engineering - Title 5 variance request for 64 Nathans Pasture Way Tom McLellan was present. The existing house was built in 1980 . The SAS has failed They will be installing anew system and are requesting a variance from the Board to allow the SAS to be more than 3 feet below grade. The components will be H2O when installed. Mr. McLellan stated that the State gives the Boards of Health power to approve the variance up to 6 feet. The chambers will be 57 feet. Mr. Ford asked what the depth to groundwater was. Mr. McLellan stated that it was approximately 40 feet. Mrs . Graczewski asked if there would be a vent. Mr. McLellan stated that there will be and it is noted in the notes section of the plan, Motion : Approve variance as requested, by engineer, based on the findings that it will provide greater protection, there are 2 mitigation strategies (a vent and H2O piping) , previously approved similar variances, putting it as far down slope as possible. Motion : Mary Chaffee Second : Annette Graczewski Vote : 4- O - O Action : Motion carried 3 . J. M. O' Reilly & Associates - Local variance request for 22 Gulls Way John O 'Reilly, Engineer and Barbara Hannon (owner) were present. They are seeking relief of the Leaching Facility Setback Regulation. The existing septic tank is H10 and needs to either be replaced, have a slab put over it, or reconfigure the driveway to avoid the tank. Property has a private well and there is a well on the other lot next door. Setback is 117 ' from pond. Separation of 11' from bottom of system to water. WWW.BREWSTER-MA. GOV BOH 10 / 11 / 2017 Minutes Page 2 Dr. Scherzo asked if there was town water. Mr. O ' Reilly stated that only well water was available. Dr. Scherzo asked if the driveway allowed access from the south side all the way down to North side . Mrs. Hannon stated that the driveway goes to the retaining wall. The driveway goes around so you can access the house from the basement. The tank is in the driveway, the leaching is not. Mrs. Graczewski asked if this was a year round home. Mrs. Hannon stated that it was. Mrs. Graczewski asked where the pipe to the septic was. Mr. O'Reilly stated that he assumes it's in the back of house by the slider door. Mrs. Graczewsi asked if they could put a system in the large open area on property. Mr. O ' Reilly stated that there is a right of way, a bike trail and a private residence next door. He stated that they could put a leaching area in the front if necessary. Dr. Scherzo questioned the flow of the house. Mr. O' Reilly stated that it would stay at the capacity it was put in as. Mrs . Graczewski asked if the driveway was paved. Mrs. Hannon stated that it is paved. Dr. Chaffee stated that there is 16 feet of separation from bottom of pit to groundwater. Motion : Approve the variance request finding that the septic tank is down gradient of pond, the system has not failed and there is 16 feet of separation from the system to groundwater. Motion : Mary Chaffee Second : Joe Ford Vote : 4- 0 - 0 Action : Motion carried 4. J. M. O' Reilly & Associates - discuss additional "wash" chair for Beach House Spa - 2740 Main Street John O ' Reilly was present. Bennett & O ' Reilly were the original designers of this system when it was built. System was expanded in 2007 with a total design flow of 1018 gallons per day. He analyzed the flow of the spa with other establishments in the area and noted that the flow from the establishment is 1000 gallons per day. Originally they did not want a wash chair but now would like it. If a chair is added flow would be 1100 gallons per day. 1135 exact. Mr. O 'Reilly is asking if the Board would approve a 1135 gallons per day flow. This is only a wash sink. A letter from the spa manager stated that there is no chemical or dyes being used. Mrs. Graczewski asked if there was any data regarding water usage and when the chair would be added. Mr. O ' Reilly stated that there are no water meter readings until December and that they hope to add the chair this winter so it is available for the spring. Mrs. Graczewski asked if this could be continued until the water meter readings could be obtained . Dr. Chaffee stated that she doesn't understand how a water meter reading would help with this decision. Motion : Continue this request until the November 1, 2017 meeting. Motion : Mrs. Graczewski Second: Joe Ford Vote : 4- 0 - 0 Action: Motion carried 5 . Mitchell Relin - Local variance request for 168 South Pond Drive Mitchell and Yvonne Relin were present. They are selling the home. An inspection was done and was passed with the exception of the SAS being within 300 ' of Sal's Pond. The system was installed where it is now because of the steep incline in the back of the house. Dr. Chaffee asked what the date of inspection was. Mr. Relin stated that it was done on September 25, 2017 . Mrs . Graczewski asked if the property was across from the pond and if the leaching was in the front. Mr. Relin answered yes to both questions and stated that there is no other place to put it. The SAS is 189 feet to pond. ' BOH 10 / 11 / 2017 Minutes Page 3 Motion: Grant the variance given the fact that there is no other place on the lot to put the system, groundwater separation is 5 . 7 feet and the system is 20 years old. Motion : Annette Graczewski Second : Mary Chaffee Vote: 4- 0- 0 Action: Motion carried 6. Alan Lammey- Local variance request for 171 South Pond Drive Alan Lammey was present. He is selling the home and has a passing septic inspection with the exception of the SAS being too close to the pond . He is requesting a 179 foot variance. Dr. Scherzo stated that the inspector had written the groundwater flow incorrectly. The flow is actually to the north. Motion : Approve the request for the variance given that there is no other reasonable location on the property to put it, the current system exceeds the 4' separation to groundwater and that 121 ' is given from the pond. CC Bible Alliance Church - Food Establishment Permit application Myron Heckman, Pastor of church was present Dr. Chaffee questioned the septic repairs that needed to be done. Mr. Heckman stated that he believed the repairs should have been done already but he will check into it. Mr. Heckman handed in the allergen awareness certificate. Mrs. Graczewski asked about the occasional use. Mr. Heckman stated it would be 3 or 4 times a year for dinners. Mrs . Graczewski asked Mrs. McCullough about the capacity of the system. Mrs . McCullough stated that it is adequate for what is proposed. Dr. Chaffee asked about CFM being there if outside events tools place. Mr. Heckman stated that either the churches or the outside vendor' s would be there. Dr. Scherzo spoke about the 8 issues in the recommendations that need to be taken care of before a permit is issued. Motion : Approve the Food Service Permit application pending the completion of the outstanding items. Motion % Joe Ford Second: Mary Chaffee Vote: 4- 0 - 0 Action: Motion carried 8 . Brewster Housing Authority - request to waive fee for soil testing Motion : Approve the request to waive the fee for soil testing. AG seconded. 4 yes . Motion : Joe Ford Second : Annette Graczewski Vote : 4- 0 - 0 Action : Motion carried 9 . Discuss and possibly approve changes to I/A Monitoring Regulation Town Counsel did a review and added a section on enforcement. Mrs . Graczewski believes this accurately reflects what the Board previously discussed. Request from Ferretti's Market for Tobacco Regulation violation penalty week Motion : Approve the request for the first week in February for the penalty week Motion : Joe Ford Second : Mary Chaffee Vote : 4-0 = 0 Action : Motion passed 11 . Discuss changes to State Private Well Regulations and possibly change Town's regulation Continue until the next meeting for Nancy Ice's input. 12 . Discuss letter to Representative Sarah Peake re : Septic Tax Credit for Nitrogen limiting technology Mrs. Graczewski wanted to do some research about other towns to see what they are doing. She has not finished investigating yet. She did ask some engineers about this too. They believe there are a lot of other factors that should be used, especially for seasonal use. She does not support this. To offer this to a small section of people doesn' t really seem reasonable. She is not really convinced that it is a BOH role to ask for this . Dr. Scherzo read a statement he had written with his concerns and reasoning for asking for this. Dr. Chaffee believes that this Board is one of the most active boards trying to help with water quality. This is a really tough process from start to finish. If the Board doesn't go forward as a "board" any individual can move forward and present this to the legislature. She believes this will be a 2 - 3 year process and it's a very tough process. Not sure it would even be successful. She is not sure this is the right approach. Mr. Ford stated that the whole Board cares about the ponds in Brewster. But agrees with Mr. Graczewski and Dr. Chaffee that it may be inappropriate as a Board to present this to the legislature. Dr. Scherzo won't go forward without the Board's support. He believes that this will ultimately cost the town money. The Board agreed not to pursue it. 13 . Review and approve minutes from 7/ 14/2017 meeting Dr. Scherzo questioned why the septic inspection had not been given to the BOH so they could give their comments to the Planning Board . It was noted that no inspection report has been handing in at this point. Motion : Approve the minutes as written. Review and approve minutes from 8/2 /2017 meeting Mrs. Graczewski questioned the motion for the discussion on the letter to representative Peake. Mrs . Topics the Chairman did not anticipate The next BOH meeting will be November 1St. There will be a joint meeting with BOS will be Oct 16th . Informational items were noted.
