Presents the following Ordinance Seconded Qy Councilman AMENDING & SUPPLEMENTING ARTICLE V ENTITLED, DUMPSTERS AND OTHER CONTAINERS, OF CHAPTER 222, "STREETS & SIDEWALKS," OF THE CODE OF THE BOROUGH OF CARTERET BE IT ORDAINED by the Mayor and Council of the Borough of Carteret (the "Borough") that the Code of the Borough is hereby amended and supplemented as follows: Section!. ~222-34, "Prohibited conduct." is hereby amended and supplemented to include the following new subsection which shall read as follows: E. Temporary Storage Container/Portable on Demand Storage (PODS) (I) Definitions. For the pUlpose ofthis chapter, the following tenus, phrases, words and their derivations shall have the meanings indicated: (a) Temporary Storage Container- Outdoor containers commonly referred to as "Pods" andYor similar containers used for the temporary st6rage of home furnishings and/or personal items on a temporary basis during a time of home repair, construction, renovation or relocation. NOTE: No cOl111llerciaVpersonal business use or storage in Residential Zone. (2) Pemlit Procedure-Prior to the delivery or use of any temporary storage container on residential property, an application must be made to the Borough of Carteret for a pemlit allowing for the delivery and use of such temporary storage container. Penllits issued shall allow for the use of such temporary storage con~ainer for a period of sixty (60) days with a sixty (60) day extension if needed. No more than a maximum of 1 permit per year per lot from the issue of initial permit. Pennit' placard must be displayed on unit facing street view. Temporary storage containers shall not exceed 20 ft. in length. Temporary storage containers shall not be located "\vithin the front yard of the property except on a driveway and to the rear of driveway. (3) Fees-There shall be a permit application with no fee charged. An extension may be granted for no longer than sixty (60) days with a fee of$50.00. (4) Enforcement-This Chapter may be enforced by the Borough of Carteret or Carteret Police Department, Zoning Officer, Construction Code Official or such other employee or depmtment of the Borough as designated in writing by the Construction Code Official. NO. 07-2~ PAGE 2 (5) Violations and Penalties-Any person, corporation and/or entity violating or neglecting to comply with any provision of this Chapter, shall be subject to a fine of up to $2,000.00. Each and every day such violation or non- compliance exists shall constihtte a separate offense and an additional fine shall be imposed. Section 2. All Ordinances and/or provisions thereof inconsistent with the provision of this Ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. Section 3. If any section, subsection, part, clause or phrase of this Ordinance shall be declared invalid by judgment of any Court of competent jurisdiction, the section, subsection, part, clause Of phrase shall be deemed to be sever able from the remainder oftllls Ordinance.
