HomeMy Public PortalAbout1985-076Member Ai /1>e-,72447 introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 85- 76 RESOLUTION GRANTING A VARIANCE TO WILLIAM AND DORIS FENHOLT TO PERMIT CONSTRUCTION OF A DECK AT 3155 LAKESHORE WHEREAS, William and Doris Fenholt (applicants) have applied for a variance from the provisions of the city zoning ordinance to construct a deck over an existing concrete slab on their home at 3155 Lakeshore; and WHEREAS, the proposed deck will be located within 321 feet of the lake rather than the required 75 feet; and WHEREAS, a variance from the provisions of the city zoning ordinance may be issued to the applicants due to the fact that the deck will not increase hard surface coverage on the lot, will not be located any closer to the lake than the existing concrete slab and adjacent houses, and is justified by the size of the lot and location of the existing house; and WHEREAS, the applicants appeared at hearings before the planning commission on July 9, 1985 and before the city council on August 6, 1985. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a setback variance be granted to the applicants as requested, subject to the following terms and conditions: 1. The deck be constructed over the existing concrete slab and no closer than 321 feet from the lake. 2. There be no increase in hard surface coverage on the lot. 3. The deck not be screened or covered. 4. The deck be constructed in accordance with the plans submit- ted to and approved by the city, a copy of which is attached hereto. 5. The variance shall expire if the deck is not completed within one year of the date of adoption of this resolution. 6. The applicants shall comply with all other provisions of the city zoning ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Medina that a violation of any of the foregoing conditions is declared to be a violation of the city zoning ordinance.
