A JOINT RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY AND
LYNWOOD CITY COUNCIL AMENDING THE CONSULTING SERVICES
AGREEMENT FOR SPECIAL COUNSEL SERVICES TO THE CITY OF LYNWOOD
AND LYNWOOD REDEVELOPMENT AGENCY
WHEREAS, on February 3, 2009, the Lynwood Redevelopment Agency and City
Council entered into that certain agreement ("Agreement") for special legal counsel
services wifh the 'Kane, Ballmer & Berkman ("KBB") law firm; and
WHEREAS, the term of the Agreement has expired before #he conclusion of the
special services in which KBB was designated to represent the City and Agency; and
WHEREAS, the City Council and Agency Board directed staff to enter into a
amendment to the Agreement in accordance with KBB to extend the term; and
WHEREAS, the City ~Councii and Agency Board further wish to designate the
areas in which KBB is authorized to provide special legal services by way of the
proposed amendment to the Agreement in the matters of the pending appeal and cross-
appeal pertaining to ~the award of attorneys fees in the case of Rogel v. City of Lynwood,
et al., Second District Court of Appeal Case No. B219626, 'and any superior court
proceedings related and subsequent to that appeal, and Lynwood Redevelopment
Agency v. Angeles Field LLC, Los Angeles Superior Court Case No. BC379877,
Second District Court of Appeal Case No. B210165, Supreme Court Case No.
S179706; and
WHEREAS, the City Council now wishes to approve the proposed amendment to
the Agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. The Lynwood City Council and Lynwood Redevelopment Agency
Board hereby approve the Amendment to Consulting Services Agreement for Special
Counsel Services by and between the City of Lynwood and Redevelopment Agency and
the Kane, Ballmer & Berkman law firm provided concurrently with this Resolution.
Section 2. This Resolution shall go into effect immediately upon its adoption.
Section 3. The City Clerk shall certify as to the adoption of this Resolution.
