RESOLUTION NO. 85-
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
TO LARRY MCCALL
WHEREAS, Larry McCall, hereinafter "applicant," has request-
ed approval of a conditional use permit to construct a duplex
office/warehouse building at 3540 Kilkenny Lane, which property
is legally described at Lot 11, Block 2, Medina Industrial
Addition; and
WHEREAS, the applicant has requested variances to reduce the
front yard setback for the parking area from 50 feet to 5 feet
and to reduce the side and rear yard setbacks for the building
from 30 feet to 15 feet.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota, as follows:
1. The operation of an office/warehouse facility at the
subject location meets the requirements of the Medina zoning
ordinance regarding conditional uses within the urban industrial
(UI) district.
2. A conditional use permit shall be issued to the appli-
cant for an office/warehouse at the above location, subject to
the following terms and conditions:
a. There be no more than five parking spaces constructed
on the property;
b. There be no outside storage on the property;
c. The applicant submit and implement a plan for security
lighting which is satisfactory to the zoning adminis-
trator;
d. The hours of operation of the businesses on the site be
limited to not more than 7:00 a.m. to 7:00 p.m., Monday
through Saturday;
e. Landscaping be installed and maintained in accordance
with the plan submitted to the City and attached hereto
as Exhibit A;
f. The applicant construct a building which is substan-
tially similar in exterior appearance to the one shown
on the drawing submitted to the City and attached
hereto as Exhibit B, except that no more than 20
percent of the exterior surface of the building be
constructed of metal;
g. The applicant enter into a development agreement with
the City, a copy of which is attached as Exhibit C; and
h. The applicant post a performance bond in the amount of
$14,550 to ensure completion of the project in a timely
and professional manner.
3. Variances shall be granted from the requirements of
Section 826.67, Subd. 3 and 4 of the Medina zoning ordinance to
allow construction of the parking lot within 5 feet of the front
lot line and of the building within 15 feet of the side and rear
lot lines due to the hardship caused by the shape of the proper-
ty.
BE IT FURTHER RESOLVED by the City Council of the City of
Medina that violation of any of the foregoing conditions or
requirements regarding issuance of the conditional use permit or
granting of the variances enumerated above is declared to he a
violation of the zoning ordinance of the City of Medina.
