RESOLUTION NO.454-
RESOLUTION APPROVING THE FINAL
PLAT OF LUTZ ELM CREEK ADDITION
WHEREAS, B. James Lutz and Sarah Lutz have requested final
plat approval on property which is zoned for single family
residences and which is legally described as set forth on Exhibit
A which is attached hereto and made a part hereof by reference.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota, that the final plat of Lutz Elm Creek
Addition dated the I day of .3 , 1985, prepared by
or under the supervision of Lot !Surveys Company, Minnesota
Registration No. 6743 be and the same is hereby approved as a
final plat upon the following conditions:
1. That a park dedication fee in the amount of $6,800 be paid
to the city by letter of credit within one year of the date
of adoption of this resolution.
2. That all sewer and water connection charges shall be paid
according to applicable city ordinances and resolutions at
the time of issuance of building permits.
3. That the developer sign a subdivision agreement drafted by
the City Attorney and post a performance bond and a public
contractor's bond in the amounts of$ 391,335.15 and
$ , in which documents the developer "shall agree
and guarantee to construct the subdivision improvements,
including sanitary sewer, storm sewer, public water supply
and streets, including the extension of Red Fox Trail from
Hunter Farms into Elm Creek Drive, in accordance with the
plans submitted and upon the terms and conditions as ap-
proved by the City Council.
4. Approval by the city engineer of plans for the streets,
sewer and water and drainage in the subdivision.
5. Compliance with all requirements of the Elm Creek Watershed
District.
6. The home located on Lot 15, Block 3 to be connected to the
sewer system within five years of the date of adoption of
this resolution or upon failure of the existing septic
system, whichever is earlier.

incurred for planning, engineering, legal and administrative
services in processing this application in the amount of
$ , and that the developer shall pay any addi-
tional costs incurred hereafter and during construction
through and including final approval of the construction and
release of the subdivision bond.
8. That the Mayor and the City Clerk/Treasurer are hereby
authorized and directed to sign the plat on behalf of the
City, at such time as the subdivision agreement and bond
have been executed and placed on file with the City
Clerk/Treasurer.

EXHIBIT A
Lot 6 except that part thereof lying Westerly of the plat of Elm
Creek Ridge and Northerly of the plat of Elm Creek Ridge Second
Addition and its Westerly Extension; and except that part of the
South 387.5 feet of said Lot 6 lying West of a line drawn 755
feet East of measured at right angles to and parallel with the
West line of Lot 10, Auditor's Subdivision Number 241; and except
that part of said Lot 6 embraced within the plats of Elm Creek
Ridge and Elm Creek Ridge Second Addition, all in Auditor's Sub-
division Number 241, Hennepin County, Minnesota, according to the
plat thereof on file or of record in the office of the Registrar
of Titles in and for said County; AND
Lot 10, Auditor's Subdivision Number 241, Hennepin County, Minne-
sota, EXCEPT the South 387.5 feet thereof and EXCEPT the West 390
feet of the North 525 feet of the South 912.5 feet thereof and
EXCEPT that part thereof lying North of the South 912.5 feet; and
EXCEPT part now replatted into Lutz Creek View. ALSO: That part
of the North 25 rods of Lot 11, Auditor's Subdivision Number 241,
Hennepin County, Minnesota, lying West of the Southerly extension
of the East line of Lot 6 of said addition, and lying East of the
Southerly extension of the East line of Lot 9 of said addition,
EXCEPT the West 755 feet thereof and EXCEPT the East 528 feet
thereof; AND
The East 528 feet of that part of the North 25 rods of Lot 11,
Auditor's Subdivision Number 241, Hennepin County, Minnesota
lying West of the Southerly extension of the East line of Lot No.
6 of said addition and lying East of the Southerly extension of
the East line of Lot No. 9, of said addition. ALSO: The South 20
feet of that part of the North 25 rods of Lot 11, Auditor's
Subdivision Number 241, Hennepin County, Minnesota lying East of
the East line of Lot 6, said Subdivision extended South.
