HomeMy Public PortalAboutR 00:108No. 00-108 Date of Adoption lpril 6, 2000 A RESOLUTION OPPOSING THE BROWNING FERRIS/CITY OF NEW YORK PROPOSED PLAN TO TRANSPORT NEW YORK CITY WASTE THROUGH THE BOROUGH OF CARTERET AND COUNTY OF MIDDLESEX USING THE CONRAIL/CSX RAIL LINE WHEREAS, the City of Linden and Browning Ferris have negotiated a host benefit agreement to establish a "marine transfer station" at Trembly Point; and WHEREAS, Browning Ferris is presently negotiating with the City of New York for a contract to hall up to 10,000 tons per day of New York City's trash through the proposed marine transfer station at Trembly Point; and WHEREAS, the proposed waste management plan calls for the transportation of the New York City waste from the Trembly Point marine transfer station using Conrail/CSX rail lines; and WHEREAS, one of the proposed Conrail/CSX rail line routes involves a line that runs through Carteret before entering Port Reading, Avenel, and Iselin sections of Woodbridge Township; and WHEREAS, the route continues on through the Middlesex County municipalities of Edison Township, Metuchen Borough, South Plainfield Borough, Piscataway Township and Middlesex Borough before entering parts of Somerset County; and WHEREAS, the proposed plan calls for the use of train lines of up to seventy- five (75) rail cars extending 5,000 feet in length; and WHEREAS, the Borough of Carteret has suffered an intolerable experience with Conrail/CSX whereby the railroad has with conscious deliberation, harassed the residents of Carteret, particularly those residing on Jackson Avenue with intolerable conditions; and WHEREAS, Conrail/CSX's deliberate harassment involves its practice of idling its train engines, sometimes as many as four (4) hours at a time, behind the homes situated on Jackson Avenue in Carteret at all hours of the day and night, sometimes for as long as several days; and WHEREAS, Conrail/CSX idles these incredibly loud engines which are less than fifty (50) feet behind the homes on Jackson Avenue; and WHEREAS, the vibration, noise and pollution from these engines have resulted in structural damage to homes, the spread of diesel fumes into the homes, adversely affecting the health of the residents, including children and has prevented the residents, including children, from benefiting from a full night's sleep because the engines idle through the night; and WHEREAS, Conrail/CSX have consciously disregarded all pleas for help from the Borough of Carteret and the residents who have suffered from years of deliberate harassment; and WHEREAS, Conrail/CSX has repeatedly and deliberately lied, misled and disregarded its own promise and agreement with the officials of the Borough of Carteret and the residents about changing its practices and procedures, only to hide behind the argument of "Federal preemption" to continue its ongoing and deliberate homfic treatment of Carteret residents. NO. 00-108 PAGE-- 2 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE BOROUGH OF CARTERET, COUNTY OF MIDDLESEX, STATE OF NEW JERSEY on this 6th day of April, 2000 that the Administrator of the federal Environmental Protection Agency be asked to join with the Borough of Carteret in opposing the proposed plan to transport New York City waste through the Borough of Carteret and Middlesex County. BE IT FURTHER RESOLVED that the Administrator of the Environmental Protection Agency be asked to support the Borough of Carteret by using its full powers and authority to reject any plan that calls for the transportation of New York City's waste through the Borough of Carteret and Middlesex County.
