MINUTES
OCTOBER 17, 1978
Mayor Tyrell called the regular meeting of the City Council to
order at 7:32 p.m. on Tuesday, October 17, 1978, in the Council
Chamber of the City Hall.
2. INVOCATION:
The invocation was given by Councilman Gillanders.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.
4. ROLL CALL:
Present: Councilmen- Atkins, Dennis, Gillanders, Merritt, Tyrell
Absent: Councilmen -None

5. APPROVAL OF MINUTES:
Councilman Atkins moved to approve the minutes of the City Council
meeting held October 3, 1978, as written, seconded by Councilman
Merritt and carried.
IAt this time, Dick Taylor, Manager, Temple City branch of Automobile Club
of Southern California, presented the Pedestrian Safety Citation for
2 -year achievement with no pedestrian deaths, stating Temple City is one
of 405 cities in the United States to achieve such an enviable safety
record. Mayor Tyrell accepted the plaque on behalf of all the citizens
of Temple City.
6. CONSENT CALENDAR:
Item C was removgd from the Consent Calendar. On motion by Councilman
Atkins, seconded by Councilman Gillanders, Items A, B, D, E, and F
were approved as recommended.
A. RENEWAL OF AGREEMENT: STUDENT AND THE LAW.- CLEMINSON SCHOOL PTA
Approved agreement between City and Cleminson School PTA to provide
Student and the Law program to sixth grade students during the
1978 -79 school year, and authorized Mayor and City Clerk to sign.
B. EXTENSION AGREEMENT: BETWEEN CITY AND SIGNAL MAINTENANCE, INC
Approved agreement to maintain 25 signalized intersections within
the City from July 1, 1978 to June 30, 1979, and authorized Mayor
and City Clerk to sign.
D. RESOLUTION NO. 78 -1761: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 78 -1761 A RESOLUTION OF THE CITY OF TEMPLE
CITY APPOINTING PERSONNEL.

On motion by Councilman Gillanders, seconded by Councilman Atkins,
Ordinance No. 78 -468 was introduced for first reading by title
only, and public hearing relating to amendment to the Municipal
Code Section 3115, application for permit for fireworks stands
was set for November 21, 1978.

7, CONTINUED PUBLIC HEARING: 7:30 p.m. TEMPLE CITY BOULEVARD, LEFT
TURN POCKETS

Assistant City Manager Pucci presented background information,
stating the City Council, at their regular meeting held September
3, 1978, held .a public.hearing on the proposed installation of left
turn pockets at certain intersections on Temple City Boulevard and a
continuous left.turn, lane between Lemon Avenue and Camino Real, and
continued the matter to October.17 and requested staff to clarify
inquiries f.rom:resident'.s testimony and further analyze the
individual inter.sectians:as.to available options relating to
shorter turn pockets, shorter transitions, and reduced restrictions
of on- .street parking.. .Base . studies were made at all intersections
proposed, however no base.study.was made between Lemon Avenue and
Camino Real in view of the activity at the high school. The Traffic
Engineer was able to off -set the majority of the proposed pockets
to minimize the - impact on.parking along the residential frontages.
Traff ic..C.ommiss.ion,.attheir special meeting held October 2, 1978,
recommended.a modified.continuous left turn from Lemon Avenue to
Camino Real; left turn pockets at Garibaldi Avenue, Live Oak Avenue,
Broadway, Olive.Str.eet and LaRosa Drive, at an estimated cost of
$2,247 for. the continuous left.turn, and $915 for each of the five
recommended intersections.... In addition, the Commission recommended
widening a .portion of Temple.City Boulevard south of Olive Street
at an estimated cost of $6.,000. Mr. Pucci distributed letters from
Mark Nottingham and Fred Wood opposing the left turn pockets.
Councilman Dennis. moved to include the letters as a part of the
public_record, s.econded.by.Councilman Merritt and carried.
Continuous Left.:Turn.Lane_- Lemon Avenue to Camino Real
Traffic Engineer .Geor.ge.Envall.advised the School District's position
in opposing loss of parking.on the west side of Temple City Boulevard
has been resolved by commencing the continuous left turn lane southerly •
of the south driveway.into the school parking lot and continuing to
Camino Real. The mofification will provide an acceleration lane to
go north and.allow on- street parking fronting the high school which
is presently posted with "No Stopping 7 a.m. to 5 p.m. "; and there
would be no restrictions on the east side of Temple City Boulevard.
Mr. Robert Harris, Assistant Principal, Temple City High School,
stated the proposal submitted at this time meets the needs of the
school and. keeps the traffic pattern away from the side streets, and
also provides a. safe ingress and egress to the student parking lot.
He would.hope the City-Council will approve the recommendation.
In brief discussion, Council expressed concern with the signs posted
on the east side of Temple City Boulevard with "No Stopping 7 a.m.
to 5 p.m." and requested staff to investigate the reasons for the
hours posted in that 3 .p.m. may.be sufficient„
Councilman Atkins moved to approve Traffic Commission recommendation
for modified continuous left turn pocket commencing southerly of the
south driveway into the school parking lot and continuing to Camino
Real, seconded by Councilman Dennis and carried.

Temple City Boulevard and Garibaldi Avenue
Traffic Engineer Envall stated that based on the left turn counts
at Garibaldi, he would recommend a 60 -ft. pocket with a 90 -ft.
transition, restricting parking on the west side of Temple City
north of Garibaldi 210 feet; and restricting parking on the west
side, south of the intersection 240 feet.
Councilman Dennis stated that based upon the number of left turn
or rear end type accident as compared to the County average, he
did not feel left turn pockets at this intersection are justified
Councilman Gillanders stated he felt it was necessary to provide
for continuity.
Councilman Merritt felt the demand is not there for left turn pockets
at this intersection and he does not feel the absence of left turn
pockets at certain intersections will affect the flow of traffic.
Mayor Tyrell expressed concern that the fast traffic lane will be
too close to bicyclists.
Councilman Gillanders stated the same situation exists at those
intersections that have left turn pockets and there have been no
recorded incidents.. Those existing left turn pockets have shown
a decrease-in left turn and rear end type accidents.
Mrs. Mary.Bayyha,.6053. Temple City Boulevard, stated she does not
understand why so much red curb is needed; that the City is penalizing
the residents. She stated she has lived near Garibaldi since 1941
and has never seen.. a. bad accident from left turns. In response
to question by Councilman Merritt, Mrs. Bayha advised when her gate
is closed she has space to park two cars in her driveway.
Councilman Gillanders stated that according to staff report, that
area does not have a high parking demand.
Councilman Atkins .moved .:to_ approve .Traffic Commission recommendation
for left turn pocket at Temple City Boulevard and Garibaldi Avenue,
seconded by Councilman Gillanders. Motion failed on a roll call vote.

Traffic Engineer Envall advised the roadway at Live Oak Avenue inter-
section is 64 feet wide north, and 60 feet wide south. In order to
provide a 60 foot pocket with a 90 foot transition it will be necessary
to restrict 210 feet north of the intersection and 240 feet south of
the intersection. Mr..: Envall advised the count shows 131 left turn
moves during a period between .8 and 9 a.m.
Bernard Cook, 5736 Rowland Avenue, stated he is opposed to the
elimination of parking spaces to accommodate left turn. pockets.
It was pointed out to Mr. Cook that the revised recommendation for
60 foot pockets would not eliminate parking spaces in front of his
apartments.
Councilman Dennis stated that based on the number of left turn
or rear end type accidents as compared to the County average, he
feels the left turn lane is warranted.
Mayor Tyrell stated his concern with children riding bicycles
and the residents entering and exiting their driveways without benefit .
of a wider lane, which would require their backing into a traffic
lane.
Councilman Gillanders responded the driver backing out would have a
better view of traffic than he now does with cars parked at the curb.

Councilman Atkins stated he felt the greater vi.sability provided
to the driver who is backing out will be better than the situation
which exists now when he cannot see oncoming traffic with cars
parked and obstructing his view, Also cars now have to swing out
around parked cars,
Councilman Atkins moved to approve Traffic Commission recommendation
for left turn pockets at Temple City Boulevard and Live Oak Avenue,
seconded by Councilman Gillanders and carried on a roll call vote:

Temple City Boulevard and Broadway
Traffic Engineer .Envall recommended 60 foot pocket with 90 foot
transition for subject intersection which has a roadway width of
60 feet; with restriction on the east side of Temple City Boulevard
240 feet north of the intersection and 240 feet south of the inter- -
section. Mr. Envall advised the count shows 125 recorded left turns
during.the hours of the.survey.
Grace Vett, 5476 Temple City Boulevard, stated she does not feel
left turn pockets are necessary, and advised she is concerned with
.race track traffic and a reduction in speed would control the problem.
Carl Kessler.,' 115470.Temp.le City Boulevard, stated he would have a
parking..problem with the restriction because his house fronts on
Temple City Boulevard and there Is a house•on the rear of the
property•with an .easement to the driveway for egress and ingress;
he plans to have a step van for business purposes in the near future
and he would require an overnight parking permit because he cannot
park in his driveway. •
Councilman.Atkins moved to approve Traffic Commission recommendation
for left turn pockets at Temple City Boulevard and Broadway, seconded
by Councilman Gillanders and.carried on a roll call vote:

Temple City Boulevard and -Olive Street
Traffic Engineer Envall advised subject intersection has experienced
the highest number of left turns, 152, during the hours of the survey;
he has prepared two alternatives to be considered in the placement .
of left turn pockets as-the street is 60 feet wide north of the
intersection and 56 feet wide south of the intersection; in order to
install a 60 foot with the.necessary transition, and if the
restriction is on the east side only, it would be necessary to widen
the street south of the. intersection 4 feet... The estimated cost
is approximately $6,000. There would be a total of 240 feet of
restriction on the east.side with a loss of 3 parking spaces north
of the intersection and 7 parking spaces south of the intersection.
If'the reconstruction is not considered feasible, the second alter-
native would be restricting the east and west sides of Temple City
Boulevard,. north and south of Olive.
Raiph Phillips, 5416 Temple City Boulevard, stated he has a sub -
standard driveway, that he would have to back into a traffic lane
and his vision would be blocked with cars parked in his neighbor's
driveway. Mr. Phillips stated he thought the Council had asked for
a survey to include speed.
Cissy Van Hastaart, 5411 Temple City Boulevard, stated she is worried
about her narrow rive approach because she would have to negotiate
the turn into her driveway from the fastest lane of traffic; also
expressing her concern with children on bicycles It was her
contention the number of accidents recorded at subject intersection
is mostly caused by people taking chances; that even now with the
delay in the light turning green, people anticipate the light and

Joseph Braun, 9532 Olive Street, urged the Council to approve
left turn pockets for subject intersection, stating he has had
many near misses in trying to negotiate a left turn in that when
on- coming traffic has a car waiting to make a left turn, you cannot
see past that car for on- coming traffic. With the proposed left
turn pockets, visibility is increased which provides for a -safe
left turn.
Bill Swain, 5758 Agnes Avenue, stated that the residents who are
concerned with backing out of their driveway will have increased
visibility and the traffic signal will provide an opportunity for
them to maneuver their cars into the flow of traffic.
Councilman Gillanders noted that some driveways on the east side
of the boulevard south of the intersection are substandard and
he would assume they would be modified if the street is widened,
and he would approve the pockets to include widening the street.
Councilman Merritt stated that he has never had a problem in making
left turns and those he has observed are because drivers do not want
to relinquish the right of way; that he is concerned with the safety
of residents turning into their driveways.
Councilman Atkins moved to approve Traffic Commission recommendation
for left turn pockets at .Temple City Boulevard and Olive Street to
include widening the curb line south of the intersection at an
estimated cost of $6,000, seconded by Councilman Gillanders and
carried on a roll call vote:

Temple City Boulevard and La Rosa Drive
Traffic Engineer Envall. advised the roadway at subject intersection
is 56 feet and recommended a 60 ft. left turn pocket with transition
which would require restriction on the east side of the street
eliminating 4 parking spaces north of the intersection and 6 south
of the intersection, and restriction on the west side eliminating
4 parking spaces. to the north and 7 parking spaces to the south of
the intersection. Mr. Envall. advised the county shows 61 recorded
left turns during the hours.of the survey.
I.t was the consensus of the Council the survey taken does not
substantiate the necessity at subject intersection for left turn
pockets.
Councilman Atkins moved to deny Traffic Commission recommendation for
left turn pockets at Temple City Boulevard and La Rosa Drive, seconded
by Councilman Gillanders and carried unanimously.
NEW BUSINESS:
8, RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of October 4, 1978
A. PETITION FOR STOP SIGN - LONGDEN AVENUE AT ENCINITA
Assistant City Manager Pucci presented background information, stating
the City Council, at their regular meeting held August. 15, 1978,
received a petition requesting the installation of an oversized
stop sign•on Longden Avenue at Encinita and referred the matter to
Traffic Commission for their review and recommendation. The Traffic
Engineer made a field investigation and recommended the stop signs
on Longden Avenue would not be in the best public interest because
stopping traffic within the curved section of Longden would be con -
ducive to rear end.type accidents. The Commission requested counts
and a recommendation for a solution to the complaints made by the
petitioners, To accommodate the petitioners' request, a hedge sight .
obstruction along the east property line of 9164 Longden Avenue
was reported to the code enforcement officer and corrected, the
Sheriff's Department was notified to watch the location for a speed

problem, and a letter is being sent to the. schools requesting
their help in notifying students the signalized intersection at
Oak Avenue 1,s the safest place to cross_ Also an advisory 25 mph.
sign was found to be missing and replaced, and foliage was
trimmed to provide adequate visibility of the advisory sign reading
"curve ". Traffic Commission, at their regular meeting held
October 4, considered Traffic Engineer's report and recommended
against the installation. of stop signs on Longden Avenue at Encinita
Avenue,
Mrs.. McCarthy, 6160 Encinita Avenue, stated motorists have to enter
tie intersection before they can see whether cars are travelling
on Longden Avenue; that children riding bicycles to school do not
want to go to Oak Avenue to cross because going up Encinita takes
them into the bicycle parking.lot at Oak. Avenue School.
Mrs, Peggy Johnson, 6157 Encinita Avenue, stated it's impossible
to t.rave.1 north on .Encinita and make a left turn, to Longden Avenue
and does not believe the City would expect her to go down to Oak
Avenue and drive around.the block -in order to go west on Longden.
Traffic Engineer Envall.stated that in his opinion the majority of
crossings at subject location were by bicyclists and that there are
sufficient gaps.in.the traffic to allow crossings and in addition,
if ,s.top... signs were installed, a further. hazard would be created in
facilitating rear -end type accidents. He .further stated motorists
have to exhibit precaution in entering the intersections, however,
there has been one accident in 3 -1/2 years.
Councilman Atkins mo.ved..to confirm Traffic Commission denial for
installation of stop sign on Longden Avenue at Encinita Avenue,
seconded by Councilman Gillanders.
In .discussion Councilman Merritt stated he would be willing to place
a stop sign and see how .it•works, out; if a greater problem is created
it can be removed.. Councilman Merritt moved to install the stop
sign at Longden,Avenue and .Encinita Avenue as petitioned, seconded
by Mayor Tyrell. Motion failed on a roll call vote:

TEE INTERSECTIONS .
Assistant. City Manager Pucci presented background information,
stating pursuant to request-from the Sheriff's Department for a
stop sign. on Gracewood at Daines Drive, Traffic Engineer investi-
gated.the intersections along Daines Drive, from Baldwin to El Monte
Avenue.. Daines Drive is a collector street with residential frontage
with a po.st.ed.speed limit of 30 mph. The Traffic Commission, at
their regular meeting held October 4, 1978, concurred with the Traffic
Engineer that it is in the best public interest to install stop and
bar pavement markings-at the north approach of Gracewood Avenue,
south approach of Nadine Street, north approach of Ryland. Avenue,
and north approach. of Robinhood Avenue to .Daines Drive.
Counci.lman. Merritt moved to approve Traffic Commission recommendation,
seconded by Councilman Dennis and carried.:

10. RECOMMENDED ADMINISTRATIVE PROCEDURES RE: TEMPORARY CHRISTMAS
TREE SALES
Assistant City Manager Pucci presented administrative procedures
for processing permit applications for the sale of Christmas trees
as developed by staff, and_which provides consistency with
temporary permits granted for fireworks sales. General Conditions
provide the applicant shall comply with City Zoning and. Building
Code provisions; .a .cas,h..deposit of $250; filing with the City
Manager between October 1 and December 1 of each year; property
damage and public liability insurance naming the City additionally
insured; a fee of $25; and the location cleared of debris and
restored to its original condition within 72 hours after midnight..
Special Provisions require a diagram showing storage and display
areas; prohibition .of.flocking; and adherence to Fire Prevention
Bureau inspection guides.
In brief discussion, Council amended Item 3(b) to provide filing
application with the City Clerk between August 1 and November 1
of each year.
Councilman Dennis. moved to approve, by minute order, the recommended
administrative procedures for temporary permit to sell Christmas
trees, as amended, seconded by Councilman Merritt and carried.
11. COMMUNICATIONS:.
A. Claim for Damages. -.Mary Kathryn Rambeau, 5311 Farago
Assistant City Manager Pucci presented claim for damages on behalf
of Mary Kathryn Rambeau, 5311 Farago, for injuries alleged to have
occurred September .12,.1978 at Temple City Park.
Councilman Atkins moved to deny claim and refer to JPIA, seconded
by Councilman .Gilianders. and carried.
12.. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Boyce O'Bannon, 10316 Olive Street, provided Council with a copy
of literature published by Spirit of 13, Inc., a government spending
limitation initiative, stating the proponents of the initiative
will try to get the required .signatures on the petition election
day_ .Mr. O'.Bannon asked Council to support the initiative; however
the initiative itself has not .as.yet been printed and Council took
no action. Mr. O'Bannon advised he will try to obtain more
information before the seminar which will be held November 4, 1978.
RECESS TO CRA-:
City Council recessed at 10:03 p.m.. to meet as the Community Redevelopment
Agency, all members being present;. approved the minutes of the regular
meeting held October 3, 1978;. approved request to sell Christmas trees at
the southwest corner of Rosemead Boulevard and Las Tunas Drive subject
to approval of lease by Exxon Corporation; and adopted resolution approving
warrants and demands. The minutes are set forth in full in the records of
the Agency.

There was no action to be taken.
14. MATTERS FROM-CITY OFFICIALS:.
A. Municipal Code Section 7148 re: •Fences and Walls
Assistant City Manager Pucci presented background information,
stating Councilman. Dennis initiated.a review of Section 7148 of
the Municipal. Code which requires .a building permit to construct
a masonry wall in excess of 3 ft. in height.

Councilman Dennis stated this matter was discussed at Council's
study session held October :2,:1978; he feels the regulation is
no longer necessary in that a- permit is not required by the County
and it puts a burden on the City's residents.
Planning Director.Dragicevich directed Council's attention to letter
received from .the ..County .,District Engineer recommending the building
permit procedure for masonry walls be continued because it ensure
good construction and minimizes property line problems between
neighbors.
Mayor Tyrell stated he felt the requirement is not unreasonable
and should be maintained..
Councilman Merritt felt there are too many governmental regulations
and controls, however, .. there should be some manner to ensure the
footings are being properly installed.
Councilman Gillanders felt it is in the homeowners' best interest
to build a wall properly and the lack of a permit would not create
substandard footings.
Councilman Dennis .moved to instruct the City Attorney to draft a
modification to Section 7148 of the Municipal Code to exclude the
permit requirement for residential property, seconded by Councilman
Gillanders and :carried on ..a . roll call vote:

B. ACCEPTANCE ,OF.SANITARY SEWERS - TRACT NO. 32644

Assistant City Manager Pucci presented recommendation from County
Engineer..to accept•..the Sanitary Sewers completed for Tract No. 32644
and release the Sanitary. Sewer Agreement and Faithful Performance
Bond•.in the amount .of $6,000
Councilman Atkins moved_to.approve the. County,. Engineer's recom-
mendation, seconded by Councilman Gillanders and carried.
C. Councilman Dennis directed Council's attention to memo received
from the City Manager following his meeting with representative of
United Way regarding joint funding of social service programs,
advising .United .Way funds are not available for new services at this
time, and recommending that organization not advocate cooperation
with government unless they can back it up.
D. Councilman Atkins ..invited .Council participation in the San
Gabriel Valley. Association of Cities meeting, Wednesday,
October 18, 7 :30 a.m...at Arcadia City Hall. The guest speaker will
be Supervisor Schabarum.

meeting. adjourned at 10 :26 pom. Next regular meeting of the City
Council will be held Tuesday, November 7, 1978, 7:30 p.m. in the
Council Chamber of the City Hall.
