A RESOLUTION OF VACATION OF PUBLIC EASEMENT OF 'l'l-lJ~ TOWN COUNCIL
OF THE TOWN OF TRUCKEE ABANDONING PUBLIC UTILITY EASEMENTS
WITHIN ASSESSORS PARCEL NUMBERS 44-390-29/30/31 (DOUGLASS/SAUERS)
WHEREAS, the Town of the Truckee has received a request to vacate and abandon
public utility easements located on the side property lines of Lots 79, 80 81 of Unit 5 of the Tahoe
Donner Subdivision; and
WHEREAS, environmental review has been conducted in accordance with the
California Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town Council
has determined the project will not have a significant impact on the environment and is exempt
from environmental review in accordance with Section 1506 l(b)(3) of the CEQA Guidelines; and
WHEREAS, said easement has not been used for the purpose for which it was dedicated
or acquired for five consecutive years immediately preceding this proposed abandonment;
WHEREAS, the Town Engineer and the Community Development Department Director
have reviewed the proposed vacation and abandonment and find the easement no longer
necessary for public purposes; and
WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code,
Section 8335, et seq., provides a procedure for summary reduction of easements;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE,
The ten foot (10') public utility easement located along the common side
boundary lines of Lots 79, 80 and 81 of Tahoe Donner Subdivision, as shown on
Exhibit A, is hereby summarily vacated and abandoned.
It is hereby declared that from and aider the date that this Resolution is recorded,
the subject easement no longer constitutes a public easement.
The Town Clerk is hereby instructed to record this Resolution of Vacation of
Public Easement, pursuant to Section 8336 of the Streets and Highways Code.
The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town
of Truckee, held on the 4t~ day of March, 1999 by Councilmember McCormack who moved its
adoption, which motion being duly seconded by Councilmember Drake was upon roll call carried
and the Resolution adopted by the following vote:
AYES: Councilmembers Drake, Florian, McCormack, Schneider & Mayor Susman
NOES: None
ABSENT: None
