Member Heideman introduced the following resolution and moved
for its adoption
CITY OF MEDINA
RESOLUTION NO. 85-115
ALPANA ADDITION
WHEREAS, the applicant, Alpana Aluminum Products, Inc. has
requested approval of the final subdivision plat as set forth on
plans submitted to the City of Medina; and
WHEREAS, a public hearing was held by the Medina Planning
Commission pursuant to all statutory and ordinance requirements
and a report was made to the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina that the Alpana Addition, the legal description
of which is on the signed plat, is hereby approved subject to
the following conditions:
1. The project shall conform in all respects to the
ordinances and regulations of the City of Medina and the Statutes
of the State of Minnesota and the applicable provisions of the
Elm Creek Watershed District;
2. The project shall conform in all respects with the plans
submitted to the City of Medina;
3. The applicant shall enter into a Development Contract
approved by the City Attorney and shall post appropriate financial
guarantees to insure the construction of the project in accordance
with the plans submitted to the City of Medina;
4. The applicant conveys Outlot C to the City of Medina; and
5. The applicant grants to the City of Medina an easement
for drainage and utility purposes over, under, and across the
western sixty (60) feet of Block 2, Lot 1, lying north of Outlot C
and extending to Evergreen Road, per the final plat submitted to
the City;
6. Block 2, Lot 1 of the final plat shall remain zoned
Multiple Residential (MR);
7. Outlot A as designated on the final plat remains zoned
Multiple Residential (MR). Prior to development of Outlot A,
Evergreen Road will be extended through Outlot A;
8. Block 1, Lot 1 as designated on the final plat shall
be zoned Industrial;
9. The 60.92 strip of the easterly most portion of the
plat extending 328.86 feet to the north shall not be used for
egress or ingress to Highway 55;
10. Evergreen Road as designated on the final plat shall
remain a private road built and maintained by the owner of Block
1, Lot 1, until such time as a future subdivision creates the
necessity for the road to be dedicated to the City of Medina, at
the City's option;
11. The applicant grants to the City of Medina an easement
for ponding and surface drainage purposes over, under and across
Outlot B;
12. The applicant submits to the City Attorney, an abstract
of title, continued to date, evidencing the fact that he has
marketable title to the property.

The motion for the adoption of the foregoing Resolution was
duly seconded by member Scheuer and upon vote being taken thereof,
the following voted in favor thereof: Heideman, Reiber, Scheuer
Anderson, Mitchell and the following voted against same: none.
Whereupon said Resolution was declared duly passed and adopted.
