INITIATION: 1. CALL TO ORDER: CITY OF TEMPLE CITY CITY COUNCIL MINUTES NOVEMBER 7, 1978 2. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 3. ROLL CALL: Present: Absent: Also Present: Councilmen - Dennis, Merritt, Tyrell Councilmen - Atkins, Gillanders City Manager Koski, City Attorney Martin, Assistant City Manager Pucci, Parks and Recreation Director Kobett, Planning Director Dragicevich, Steve Johnson, Temple City Times, Becky Dake, Pacesetter Councilman Merritt moved to excuse Councilman Atkins and Councilman Gillanders for cause, seconded by Councilman Dennis and carried. 4. APPROVAL OF MINUTES: Councilman Dennis moved to approve the minutes of the City Council meeting held October 17, 1978, as written, seconded by Councilman Merritt and carried. 5. CONSENT CALENDAR: On motion by Councilman Merritt, seconded by Councilman Dennis and carried, Items A through G on the Consent Calendar were approved as recommended: A, REQUEST FOR USE OF LIVE OAK PARK - Junior Women's Club Approved Parks and Recreation Commission recommendation for use of Live Oak Park, Saturday, November 18 to conduct a Pancake Breakfast subject to the required Certificate of Insurance. B. RENEWAL OF AGREEMENT TO CROSS PEDESTRIAN MALL NO. 4, 96592 LAS TUNAS Approved Parking Commsision recommendation to renew agreement granting permission to cross over Pedestrian Mall No. 4, located at 96592 Las Tunas Drive. C. REQUEST FOR PARTIAL PAYMENT: PACIFIC TENNIS COURTS, INC. Authorized partial payment to Pacific Tennis Courts, Inc. in the amount of $10,000 subject to Waive of Lien from Sta -Soil Corporation and Crown Fence and Supply Company, Ltd. D. ACCEPTANCE OF BID: LEMON AVENUE RESURFACING Accepted the low bid of $9,650 from Vernon Paving Company and authorized the Mayor and City Clerk to sign. E. RESOLUTION NO. 78 -1764: ADJUSTMENT OF STREET LIGHTING ZONE BOUNDARIES - ANNEX CERTAIN AREAS FROM ZONE B TO ZONE A Adopted Resolution No, 78 -1764 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENTION TO HOLD A PUBLIC HEARING RELATING TO AN ADJUSTMENT OF ITS STREET LIGHTING ZONE BOUNDARIES and setting public hearing December 5, 1978, 7:30 p.m. G. RESOLUTION NO. 78 -1765: WARRANTS & DEMANDS Adopted Resolution No. 78 -1765 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $124,367.83, DEMAND NOS. 10696 THRU 10822. UNFINISHED. BUSINESS: 7. PUBLIC HEARING: 7 :30 p.m. ADOPT COUNTY ORDINANCE RE: SANITARY SEWER AND INDUSTRIAL WASTE City Manager Koski presented background information, stating the City Engineer advised the Board of Supervisors has amended and adopted the Sanitary Sewer and Industrial Waste Ordinance for the unincorporated area due to recent changes in state laws and an analysis of fees collected under the present regulations. The ordinance provides _ an. increase_ in current fees anal. charges , establishes certain new fees and charges and provides various technical changes and - reduction. - in plan.checking.fees, as well as establishing requirements for mainline sewer for condominiums and pretreatment of industrial waste. The City Engineer recommends the ordinance be adopted in order to administer uniformly throughout the county. City Council, at their regular meeting held October 3 set public hearing on this matter for November 7, 1978. Mr. Tom Howard, County Engineer's Department, clarified question relating to pretreatment, advising pretreatment refers to industrial waste from facilities such as manufacturing and commercial; adds a requirement for main line sewer hook -up for condominium development. Mayor Tyrell declared the public hearing open and invited anyone wishing to speak to come forward. There being no one wishing to speak, Councilman Merritt moved to close the public hearing, seconded by Councilman Dennis and carried. City Attorney Martin introduced Ordinance No. 78 -469 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING A SANITARY SEWER AND INDUSTRIAL WASTE ORDINANCE for first reading by title only. Councilman Dennis moved to waive further reading, seconded by Councilman Merritt and carried, 8. PUBLIC HEARING: 7:30 p.m. TENTATIVE TRACT NO. 35757, 5412 McCULLOCH City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held October 10, 1978, adopted a resolution recommending approval of Tentative Tract No. 35757 for construction of three 2 -story buildings, each con- taining two units, each unit to contain attached 2 -car garages. The property is zoned R -2 Light Multiple residential, consists of 0.49 acres of land and has 80 ft. of street frontage. The Minor Zoning Modification Committee approved a deviation of .85 of 1% of the required lot area per unit and Planning Commission concurred with the committee's approval. A Negative Declaration of Environmental Impact was filed pursuant to the California Environmental Quality Act of 1970, as amended. City Council, at their regular meeting held October 17, 1978, set public hearing on this matter for November 7, 1978. Council Minutes, November 7, 1978 - Page 3 Mayor Tyrell declared the public hearing open and invited anyone wishing to speak to the issue to come forward. There being no one wishing to speak, Councilman Merritt moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Merritt moved to certify the Negative Declaration of Environmental Impact, seconded by Councilman Dennis and carried. Councilman Dennis moved to approve Tentative Tract No. 35757 for property located at 5412 McCulloch Avenue, subject to all conditions set forth in Planning Commission Resolution No. 78- 816PC, seconded by Councilman Merritt and carried, 9. PROPOSED ORDINANCE RE: FENCES AND WALLS City Manager Koski advised the City Attorney had prepared a proposed ordinance deleting the.. requirement for permit for fences and walls for residential property pursuant to Council instruction at their regular meeting held October 17, 1978. It was the consensus of Council to table the item to be considered by a full Council. NEW BUSINESS: 10. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - Meeting of October 18, 1978: PROPOSED TENNIS COURT RULE CHANGES City Manager Koski advised the Parks and Recreation Commission, at their regular meeting held October 18, 1978, recommended to City Council that certain existing Tennis Court Rules and Regulations be deleted or changes and new rules adopted as outlined in staff memo dated October 24, 1978. Mayor Tyrell stated he would like to discuss the rules and regulations with the Commission prior to Council consideration. Councilman Merritt moved to continue the matter, seconded by Councilman Dennis and carried. 11. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of November 1, 1978 A. STOP SIGNS ON ROBINHOOD AND ON RYLAND AT BOGUE STREET City Manager presented background information, stating the Traffic Commission, at their regular meeting held November 1, 1978, recom- mended installation of stop signs, with bar and pavement markings at the north and south approaches of Robinhood at Bogue Street, and at the south approach of Ryland Avenue. Councilman Merritt moved to approve Traffic. Commission recommendation, seconded by Councilman Dennis and carried. B. ADDITIONAL TRAFFIC CONTROLS - LA ROSA SCHOOL City Manager Koski presented background information, stating at the request of the Temple City School District, the Traffic Engineer met with the Principal of La Rosa Elementary School regarding her request for a change in parking restrictions on the north side of La Rosa Drive at Rio Hondo Avenue, Following investigation, Traffic Engineer recommended to the Commission placing a "10 Minute Parking Zone, 8 :30 a.m, to 3 p.m,, School Days Only` sign on the north side of La Rosa Drive from a point 11 feet east of the west curb line prolongation of Rio Hondo Avenue to a point 265 feet east, and to place 13 feet of red curb on the north side of La Rosa Drive from the west line of the school. crosswalk to the driveway westerly. Traffic Commission concurred. Councilman Merritt moved to approve Traffic Commission recommendation, seconded by Councilman Dennis and carried. Council Minutes, November 7, 1978 - Page 4 C. ADDITIONAL TRAFFIC CONTROLS - CLOVERLY SCHOOL City Manager Koski presented background information, stating at the request of the Temple City School District, the Traffic Engineer met with the Principal of Cloverly School regarding her concern for exiting bicycles from the rack area located on the east side of Cloverly Avenue at the first drive southerly of Broadway. Traffic Engineer Envall's investigation disclosed parked cars north of sub- ject area which restrict visibility for southbound traffic on Cloverly Avenue and recommended "No Stopping 8 a.m. to 4 p.m., School Days Only" signs be placed on the east side of Cloverly Avenue from 115 feet, north line of the school walk, to 180 feet south of the south curb line of Broadway. Traffic Commission concurred. Councilman Dennis moved to approve Traffic Commission recommendation, seconded by Councilman Merritt and carried. 12. COMMUNICATIONS: A. Temple City Host Lions Club - Request to conduct Eyemobile, Las Tunas Drive - November 18, 1978 City Manager Koski presented communication from the Temple City Host Lions Club requesting permission to park the Lions Eyemobile on Las Tunas Drive in front of Temple City Park November 18, 1978. Councilman Dennis moved to approve the request, subject to the required Certificate of Insurance, seconded by Councilman Merritt and carried. 13, TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Ball Sparks, Temple City Auto Parts, located at 9225 Las Tunas Drive, requested a clarification of the sign ordinance, explaining he has been advised no free standing sign is permitted where a roof sign already exists. He would like to provide two 6 ft. x 6 ft. free standing signs advising there is off - street parking to the rear of his business. Councilman Atkins arrived at 8 p.m. In answer to Council's question, Planning Director Dragicevich advised that no free standing signs are allowed when a roof sign exists pursuant to Zoning Code Section 9326(3); that Mr. Sparks has been advised he can file a variance application to accomplish the directional signs he wishes to install. In discussion, Councilman Atkins stated, in his opinion the intent of the ordinance is valid, however, in this case the City is defeating its purpose in encouraging merchants to provide parking in the rear. City Attorney Martin advised the Planning Commission can interpret the seeming ambiguity without filing for a variance and payment of a fee. Councilman Atkins moved to refer the matter to the Planning Commission for interpretation of the Zoning Code, seconded by Councilman Dennis and carried. RECESS TO CRA: City Council recessed at 8:10 p.m. to meet as the Community Redevelopment Agency, Mr. Gillanders being absent; approved the minutes of the. regular meeting held October 17, 1978; approved payment on behalf of the City of Temple City for rent obligation pursuant to the Parking Lot Lease Agreement between the City and the CRA in the amount of $145,275.15; and adopted resolution approving warrants and demands. ACTION ON REQUEST BY CRA: There was no action to be taken. 15. MATTERS FROM CITY OFFICIALS: A. Entertainment and Dance Permit - Ivanhoe - Set Public Hearing November 21, 1978 City Manager Koski advised the City has received an application for entertainment and dance permit from new owner of the Ivanhoe which requires a public hearing by City Council. Councilman Dennis moved to set public hearing November 21, 1978, seconded by Councilman Merritt and carried. B, Temple City Boulevard - Signing on East Side Councilman Atkins moved to receive and file staff memo advising the parking restrictions on the east side of Temple City Boulevard between Lemon Avenue and Camino Real was originally requested by the property owners /residents and until such time as City receives a request for change, no action is recommended, seconded by Council - man Dennis and carried: C. Additional Tennis Court Fencing Council received a staff memo relating to proposed security /control fencing for the north side of the new tennis courts at Live Oak Park which will provide only one access to the courts, requiring players to enter and leave through the west gate. It was the consensus of the Council the Mayor discuss this item with the Parks and Recreation Commission at the same time he meets with them relating to the tennis court rules, D. IntErim Salary Adjustment - Planning & Engineering Aide On motion-by Councilman Merritt, seconded by Councilman Dennis and carried, Council approved a salary adjustment for the Planning and Engineering Aide who is assuming the duties of the Assistant Planner during the current recruitment for the Assistant Planner position. E. City Manager directed Council's attention to material relating to areawide Management Plan for Solid Waste Treatment; Management Plan on Air Quality; Regional Growth Forecast Policy; and draft Environmental Impact Report received from Southern California Association of Cities in the past 30 days, requesting the cities make their inputs by December 15, 1978. Fo Councilman Merritt advised he read an article regarding the number of apartment conversion to condominiums, many of which are in the City's sphere of influence. Discussion ensued regarding guidelines for conversion, and Councilman Atkins advised the Plan- ning Commission has studied this problem in depth and has developed some standards as condominium developments. G. Councilman Dennis directed Council's attention to the fact that the film "Scared Straight" is available on a rental basis, stating he would like to see some thought given to initiating the program in California. H. Mayor Tyrell advised Student Day in. Government has been scheduled for Tuesday, November 14, 1978, 9 a.m. to Noon and invited Council participation. Council Minutes, November 7, 1978 - Page 6 16.
