The second Public Hearing on a proposed ordinance governing
Zoning Regulations in the Business District was called to order at
the Village Hall at 5:15 P. M., October 17, 1978 and moved to the
auditorium of the Church By the Sea.
All councilmen were present with the exception of Mr. Beatty.
Also present were Fred Maley, Village Manager; Mary Wetterer,
Village Clerk; and Alan Gold, Village Attorney.
Mr. Dan Paul, attorney for Bal Harbour Shops, presented 1075
cards reportedly signed by Bel Harbour residents in favor of a
proposed Bel Harbour Shops expansion. Mr. Paul protested the pro-
visions of the ordinance cancelling the Park Drive variance and
establishing a .70 Floor Area Ratio.
Mr. Whitman presented several experts and other interested parties
who spoke in favor of the proposed expansion.
Mr. Paul said the Center wants an addition to their garage build-
ing at a 50' set back from Park Drive and a Floor Area Ratio of 0.86
instead of 0.70.
The Bal Harbour E3nvironmental Protective Association submitted
370 cards, reportedly 25% of the registered voters, who indicated
they were not in favor of the center's expansion and recommended that
the Council accept the consultants recommendations.
Mr. Gold said there were still some questions pending from the
consultants and suggested that the hearings be held open for the
answers. He said that a definition of Traffic Level of Service should
be added. Also, the definition of mezzanines and their uses determined.
He advised that roof parking was permissible under the consultants'
recommendations.
