of language regarding tidal marsh within our Soil Erosion and Sedimentation Control
Ordinance Council approved City Attorney contacting Attorney General's office and
obtaining answers to the following questions- 1) Does the E&S Act require a 25'
buffer in coastal areas that have been stablized, with or without a permit? 2) Does
the 1993 Bowers decision still provide protection for coastal marshlands by
requiring a 25' buffer from state waters, and can local governments base this
buffer upon the delineation established by DNR's CRD? 3) Are there any elements
in the draft proposal that is presently being reviewed by the Tybee committee that
should not be allowed regardless of a local government's ability to enact more
stringent laws, provided the state's minimum requirements are met? Also request
an opinion on the River Basin Center's comments on EPD's denial of Camden
County's LIA application.
