CITY OF MEDINA
RESOLUTION NO. g2 - / /6/
RESOLUTION GRANTING CONDITIONAL USE
PERMIT TO REED BALES
WHEREAS, Reed Bales ("applicant") has applied for a condi-
tional use permit to operate a wood chipping business at 4300
Willow Drive in the City of Medina; and
WHEREAS, the operation of said business will not impede the
normal and orderly development of the property in the area; and
WHEREAS, a conditional use permit is required by the Medina
Zoning Ordinance for the operation of said business; and
WHEREAS, the applicant was granted a conditional use permit
for the operation of the business on June 26, 1984; and
WHEREAS, the applicant has requested a modification of that
conditional use permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that a conditional use permit be
granted to Reed Bales to operate a wood chipping business at 4300
Willow Drive, on real estate legally described as:

upon the following terms and conditions:
1. The operation shall conform in all respects to the pro-
visions of the Medina Code of Ordinances.
2. The applicant shall enter into the development contract
attached hereto and said development contract shall govern
the terms and conditions of construction at the site.
3. The applicant shall construct site improvements in compli-
ance with the following schedule:
a) Phase I - A berm shall be constructed parallel to
Willow Drive and extending 100 feet north of the
applicant's driveway and 225 feet south thereof. A
fence shall be constructed on top of the berm. The
berm and fence shall be completed no later than June 1,
1986.
b) Phase II - A berm shall be constructed commencing at a
point along the northern property line 600 feet east of
the northwestern corner of the parcel and extending
southerly a distance of 500 feet. Willows or poplars
shall be planted on the top of the berm. The berm and
plantings shall be completed no later than June 1,
1987.
c) Phase III - A berm shall be constructed along Willow
Drive from the points of termination of the berm
constructed in phase I to the northwestern property
corner and to the southwestern property corner. The
berm shall also be constructed along the northern
property line from the northwestern corner of the
property to a point 400 feet east thereof. The berm
shall also be constructed along the southern property
line from the southwestern corner of the property to a
point 100 feet east thereof. A fence shall be con-
structed on top of the berm. The berm and the fence
shall be completed no later than October 1, 1987.
The height of the fence shall be a minimum of six feet or
such lesser height as may be agreed to by the applicant and
the zoning administrator and the combined height of the
fence and berm shall be such as is necessary to screen the
property. The fence may be constructed so that there is a
gap of no more than six inches between the fence and berm.
A11 site improvements shall be maintained in a good state of
repair. Landscaping materials which become diseased or die
shall be replaced promptly, season permitting.
4. Hours of operation on the wood chipping facility shall be no
longer than 6:00 a.m. to 8:30 p.m., Monday through Saturday.
5. The applicant shall install adequate security lights within
the area enclosed by the berm and fence.
6. The driveway shall be blacktopped no later than June 30,
1986.
7. Placement of all equipment and structures used in the wood
chipping operation shall meet setback requirements of the
city.
8. If the applicant conducts a sawmill operation at the facili-
ty at any time in the future, the 60 by 100 foot slab which
will serve the sawmill shall be enclosed no later than 90
days following commencement of sawmill operations.
9. Operation of the facility shall not exceed state noise level
regulations at the perimeter of the property.
10. The applicant shall install a holding tank, which shall be
constructed and maintained in accordance with City
ordinances and regulations, no later than 90 days after
water is available to the site or December 31, 1987, which-
ever comes first.
11. Commencing immediately, all storage of unprocessed wood
shall be confined to the area designated on the attached
site plan.
12. The applicant shall place no fill or materials in the
wetlands and shall remove that material which he has
previously placed or caused to be placed in the wetlands no
later than June 1, 1987. The wetlands area is defined as
that portion of the site designated as such on the attached
site plan.
13. The applicant shall submit a bond or other financial guaran-
tee in a form to be approved by the city attorney in the
amount of $20,000.
14. Resolution number 84-42 is hereby rescinded.
