Resolution Regarding
Certain Streets in "Independence Beach"
WHEREAS, Lester O. Tronrud and Ethel L. Tronrud, Edward P.
Schanus and Irene F. Schanus, and Ruben A. Fries and Beverly G.
Fries have commenced applications to register title to certain
land located in the City of Medina ("City");
WHEREAS, there is an ambiguity as to how much of Main
Street, Brook Avenue and Grove Street were intended to be vacated
in a resolution of this council dated December 15, 1945, which
resolution is not filed, but is referenced on the Hennepin County
half section map of the North Half of Section 18, Township 118,
Range 23;
WHEREAS, there is a City resolution dated August 7, 1956
referring to purported vacations of part of Brook Avenue and Grove
Street;
WHEREAS, the City vacated a portion of Brook Avenue de-
scribed as "an area 40 feet by 100 feet between Lot 1, Block 31
and Lot 13 and the south 40 feet of Lot 12, Block 29, Independence
Beach" in the resolution adopted at the special meeting of the
council on October 26, 1956, a copy of which meeting minutes was
filed with the Hennepin County Recorder's office on February 15,
1960, as Document No. 3220587 in Book 852 of Miscellaneous, page
593;
WHEREAS, the City wishes to clarify any ambiguity
regarding Main Street, Brook Avenue and Grove Street;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina:
1. The vacation of Main Street lying east of the
easterly right of way line of Brook Avenue, now known
as Ardmore Avenue, and west of the westerly right of
way line of County Road 19 is confirmed.
2. That the portion of Brook Avenue intended to be
vacated, was vacated and is vacated is legally
described as follows:
That portion of Brook Avenue lying between the
easterly line of Block 29 and the westerly line of
Block 31, Independence Beach, and lying between the
easterly extensions across it of the south line of
Lot 13 and the south line of the north 20 feet of Lot
12, Block 29, "Independence Beach, Hennepin County,
Minnesota".
3. That the remaining portion of Brook Avenue lying to
the north of the above -described vacated portion of
Brook Avenue was intended to remain open, has
remained open and is now open.
4. That no part of Grove Street was intended to be
vacated, was vacated or is vacated and that all of
Grove Street is open. The northerly portion of Brook
Avenue and all of Grove Street have by usuage come to
be known as Ardmore Avenue.
5. That the owners of lands abutting Lakeshore Avenue as
described in Document No. 2907575 whose lands extend
to the shore of Lake Independence, including
specifically Lester O. Tronrud and Ethel L. Tronrud
and Edward P. Schanus and Irene F. Schanus, may have
the exclusive use of the lakeshore of Lake
Independence as riparian owners thereof consistent
with the right of way granted to the public in said
Document No. 2907575, which right of way is for
public travel on Lakeshore Avenue and not for public
access to Lake Independence.

That part of Lot 12 lying South of the North 20 feet thereof, and
all of Lot 13, Block 29, "Independence Beach, Hennepin County,
Minnesota," according to the recorded plat thereof.
A tract of land comprising part of vacated Brook Avenue dedicated
in the plat of "Independence Beach, Hennepin County, Minnesota,"
and that part of Government Lot 2, Section 18, Township 118, Range
23, described as follows:
Beginning at the intersection of the South line of said
Government Lot 2 with the Southerly extension of the
center line of said vacated Brook Avenue; thence Northerly
along said extension and along said center line to the
Easterly extension of the South line of the North 20 feet
of Lot 12, Block 29, "Independence Beach, Hennepin County,
Minnesota;" thence Westerly along the last -described
extension and along the South line of the North 20 feet of
said Lot 12 and its Westerly extension a distance of
148.02 feet, more or less, to the Northeasterly line of
the public road described in instrument recorded in the
Office of the County Recorder as Document No. 2907575;
thence on an assumed bearing of South 20 degrees East
along said Northeasterly line a distance of 63.54 feet;
thence South 44 degrees West to the shoreline of Lake
Independence; thence Southeasterly along said shoreline to
the South line of said Government Lot 2; thence East along
said South line to the point of beginning; EXCEPT
therefrom Lot 13 and that part of Lot 12 lying South of
the North 20 feet thereof, in said Block 29.

Commencing at the Southeast corner of said Government Lot
2; thence on an assumed bearing of West along the South
line of said Government Lot 2, a distance of 396 feet;
thence on a bearing of North a distance of 297 feet;
thence North 70 degrees West, a distance of 20.50 feet;
thence South 20 degrees West to the intersection with the
Westerly extension of the North line of said Lot 11, said
intersection being the point of beginning of the land to
be described; thence Easterly along said extension of the
North line of said Lot 11, to the Northeast corner of said
Lot 11; thence Southerly along the East lines of said Lots
11 and 12 to the South line of the North 20 feet of said
Lot 12; thence Westerly along said South line of the North
20 feet and its Westerly extension to the Northeasterly
