HomeMy Public PortalAbout1985-1251eiceetry ri Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 85- /"?_'' A RESOLUTION REGARDING LANDFILL ABATEMENT AND OTHER MEASURES TO BE FINANCED BY THE CITY OF MEDINA WHEREAS, pursuant to the federal Resource Conservation and Recovery Act of 1976, states are under a mandate to examine and plan for a reduction in municipal solid waste; and WHEREAS, in 1980 the Minnesota legislature adopted the Waste Management Act (the Act) which conveyed responsibility for regulating hazardous and municipal solid waste to the Minnesota Pollution Control Agency, the Minnesota Waste Management Board, the Metropolitan Waste Control Commission and the Metropolitan Council; and WHEREAS, the Act prohibits the use of landfills within the Twin Cities area for disposing of unprocessed solid waste after 1990; and WHEREAS, the Act gives primary responsibility for planning and coordinating efforts to reduce municipal solid waste within the Twin Cities area to the Metropolitan Council; and WHEREAS, the Metropolitan Council estimates that if present practices continued unchanged, by the year 2000 the Twin Cities area will need to dispose of about 24 million tons of solid waste above the capacity of existing landfills, resulting in the need for approximately 10 new landfills; and WHEREAS, in March of 1985 the Metropolitan Council adopted its Solid Waste Management Development Guide/Policy Plan (the Plan) for regulation of solid waste within the Twin Cities area; and WHEREAS, the Plan establishes the following goals for the Twin Cities for eliminating the use of landfills for unprocessed solid waste by 1990: 4 percent reduction in total volume; 16 percent reduction through source separation; and 80 percent reduction through central processing; and WHEREAS, the Plan requires metropolitan counties to identify and plan for additional landfill sites, to prepare comprehensive plans consistent with those of the Metropolitan Council and to acquire and construct solid waste management facilities; and WHEREAS, the Plan requires metropolitan municipalities to consider ordinance amendments and modifications to their compre- hensive plans to accommodate landfill abatement efforts and encourages municipalities to implement or participate in landfill abatement programs and activities; and WHEREAS, the City of Medina regulates the operation of the Woodlake sanitary landfill located within the city by a condi- tional use permit granted on February 7, 1984; and WHEREAS, the CUP allows the City to collect a fee for road maintenance equal to $.02 per cubic yard of solid waste and a fee for other city expenses for monitoring and regulating the land- fill of up to $.10 per cubic yard of solid waste; and WHEREAS, in 1984 the Minnesota legislature authorized the state department of revenue and counties and municipalities in which landfills are located to charge fees of $.50, $.25 and $.15 per cubic yard of solid waste, respectively, for the purpose of funding landfill abatement measures; and WHEREAS, Medina is especially conscious of those costs associated with landfills which are not directly borne by the users of landfills and wishes to participate in efforts to lessen dependence within the Twin Cities area on the landfilling of solid wastes; and WHEREAS, the City intends to avail itself of all resources designed to abate the use of landfills and to mitigate and compensate its residents for the presence of a landfill within the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota as follows: 1. That a Landfill Task Force is hereby created for the purpose of recommending to the City Council landfill abatement activities which the City should implement or participate in, including those towards which the City should contribute financially. 2. The names of persons to serve on said Task Force shall be recommended by the Planning Commission and approved by the City Council. 3. Staff is hereby authorized and directed to cooperate with the Task Force and provide any assistance it may require in performing its responsibilities. 4. The Task Force shall prepare a report of its findings and recommendations as quickly as is reasonably practicable and shall present same to the City Council no later than July 1, 1986.
