CITY OF MEDINA
RESOLUTION NO. 84- .3
RESOLUTION GRANTING A CONDITIONAL USE
PERMIT TO JACK BRADY FOR J-B FARMS
WHEREAS, Jack Brady (Applicant) owns property located at
4650 Maple Street which is zoned rural residential; and
WHEREAS, Applicant has applied to operate a horse training
and breeding facility at the property; and
WHEREAS, Section 826.21 of the Medina Code of Ordinances
permits such facilities within the rural residential district
provided the City Council grants a conditional use permit; and
WHEREAS, the proposal has been reviewed by the Planning
Commission and City Council for compliance with ordinance stan-
dards.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina that the proposed horse training and breeding
facility is consistent with the City's zoning ordinance and will
not impede the development of adjacent property and that a
conditional use permit for same is hereby granted, subject to the
following conditions:
1. The number of accessory buildings shall not exceed four and
they shall not occupy an area in excess of one percent of
the 45 acre parcel and all accessory buildings housing
animals shall be and shall remain at least 150 feet from all
present and future lot lines;
2. The number of horses at the facility shall not exceed 60 at
any time;
3. No toilet facility shall be constructed at the arena which
requires a drainfield;
4. Manure removal shall conform to the regulations of the
Minnesota Pollution Control Agency;
5. The number of employees at the facility shall not exceed 10
and employee parking shall be on the lot located to the
north of the existing barn as indicated on Exhibit A;
6. The Applicant shall cause traffic associated with all horse
presentations to be restricted to the Maple Street entrance
from County Road 19;
7. The Applicant agrees to contribute one-third of the cost of
improving Maple Street when it is upgraded;
8. Any signs shall conform to zoning ordinance standards
applicable to residential districts;
9. There shall be no outside public address system;
10. The Applicant shall provide temporary sanitary facilities
during all horse presentations;
11. The hours of operation of the facility shall be restricted
to 6:00 a.m. to midnight daily;
12. The Applicant shall install two mercury vapor fixtures for
outside lighting, which fixtures shall be downward facing so
as not to broadcast light off the premises;
13. There shall be no outside storage allowed except for li-
censed vehicles and trailers and one tractor with a manure
spreader;
14. The Applicant shall hold no more than one major horse
presentation per month (defined as involving 25 or more
persons) and shall give prior notice of same to the City;
15. A11 fencing on the property shall be wood with two electric
wires and shall be kept in good operating condition;
16. The Applicant shall combine the two parcels into one lot for
tax and subdivision purposes; and
17. The Applicant shall dedicate the necessary right-of-way for
County Road 19 as indicated on Exhibit A.
BE IT FURTHER RESOLVED by the City Council of the City of
Medina that a violation of any of the above conditions shall be
deemed to be a violation of the Medina zoning ordinance.
