HomeMy Public PortalAbout1986-004Member '`7"Y moved its adoption: introduced the following resolution and CITY OF MEDINA RESOLUTION NO. 4 RESOLUTION GRANTING A VARIANCE TO DOUGLAS THEIS TO PERMIT CONSTRUCTION OF A HOUSE AT 5342 HIGHWAY 101 WHEREAS, Douglas Theis (applicant) has applied for a vari- ance from the provisions of Section 825.25 of the Medina zoning ordinance to construct a house adjacent to an existing garage; and WHEREAS, the proposed house will be located 36 feet from the right-of-way line of Highway 101; and WHEREAS, Section 825.25 requires a front yard setback from the right-of-way line of state highways of 100 feet; and WHEREAS, a variance from the requirements of Section 825.25 is justified by the hardship of the shape of the lot; and WHEREAS, granting the variance requested will not confer upon the applicant any special privilege that is denied to the owners of other lands, the variance will not be materially detrimental to the purposes of the ordinance or to neighboring property, and the variance requested is the minimum variance which will alleviate the hardship; and WHEREAS, the applicant appeared before the planning commis- sion on July 9, 1985 and before the city council on August 20, 1985. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a variance from the requirements of Section 825.25 of the Medina zoning ordinance is hereby granted, as requested, subject to the following terms and con- ditions: 1. Verification that the existing septic system meets all applicable code requirements. 2. Closing of the old well on site in accordance with applica- ble regulations. 3. The house be completed no later than September 1, 1986 in accordance with the plans and specifications submitted to the city of Medina and attached hereto. 4. The applicant comply with all other provisions of the Medina zoning ordinance. BE IT FURTHER RESOLVED by the City Council of the City of Medina that a violation of any of the foregoing conditions is declared to be a violation of the city zoning ordinance.
