ORDER TO CONSTRUCT NINE (9) DETACFiED SINGLE- ~ FAMILY RESIDENCES ON PROPERTY LOCATED AT 4237 - 4241 IMPERIAL HIGHWAY, FURTHER ' DESCRIBED AS ASSESSOR PARCEL NUMBERS 6192- -~ - 023-024 & 025 ' TRACT 5103, PORTION OF LOT 10, ~ CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE ~ ` ~ OF CALIFORNIA. . ~ , a , . WHEREAS; the L-ynwood Planning Commission, pur`suant to law, conducted a public hearing on November 11, 2003 on. Zone Change No. 2003-05 and continued the item; and . ' ~ WHEREAS, the Lynwood Planning Commission conducted a continued public hearing December 9, 2003 and denied the project; and ~, .~ WHEREAS, the Lynwood City Council has carefully considered all oral and written testimony ofFered at the public hearing; and WHEREAS, the Lynwood City Councif conducted a public hearing to consider Appeal No. 2003-04 on January 20, 2004; and ', WHEREAS, the Development Services Department has determined that the project ~ may have significant impacts, an Initial Study was performed, mitigation measures have been incorporated into the project to reduce potential impacts to a level of insignificance, and a Negative Declaration was prepared. ~ ~ ~, Section l. The Ciry Council of,the City of Lynwood hereby fnds and determines as foifows: ~ . ~ ~ A. A PRD (Planned Residential Development) zoning designation of the subject property would not be consistent with developments in the vicinity. , ,B. The PRD (Planned Residentialf,Development) zoning designation would not be consistent with Chapter 25 bf the Lynwood Municipal Code. , ~:. C. The PRD (Planned Residential Development) zoning wilf not be consistent , . with the intent of the Lynwood General Plan. ;: D. ~ The PRD. (Planned Residential Development) zoning designation may be _ detrirnental to the properties surrounding the site and may negatively impact the public health, safety, or general welfare. ~ ' Section 2. The City Council of the City of Lynwood, based upon the aforementioned findings and determinations, hereby denies Appeal 'No.~2003-04 ~therefore denying Zone Change No. 2003-05, a request to change the zoning designation for 4237 -- - 4241 Imperial Highway from ,R-1 (Single-Family Residential) to PRD (Planned Residential Development).
