Mayor COUNCIL MINUTES November 14, 1978 The Council of Bal Harbuur Villa:;e met Tuesday, November 14, 1978 at 9:30 A. M. in the Villa.:e Hall. ''re ent: Messrs. Beatty, Davis, Krez, Vrintup and Taplin glso preeent were Fred Maley, Village Manager; Mary Wetterer, Village Clerk; and Alan Gold, Village Attorney. Mr. Gold said he will recta Ordinance No. 205 as presented at first reading and then consider several questions that have been raised since that time. Mr. Gold then read rdinance 205. He outlined the two proposed amendments regarding Floor Area Ration and Traffic Requirements. He also addressed the question of rebuilding nen-conforming structures in case of accidental destruction. Discussion followed on these items and on motion of Mr. Davis, seconded by Mr. Taplin and voted an amendment to be known as Section 4 covering the rebuilding of non -conforming structure was passed and the subsequent sections of the ordinance renumbered. On motion of Mr. Taplin, seconded by Mr. Davis and vote:, the definitions of Level of Service governing traffic flow as it pertains to the 11u;iness District was in- cluded in the ordinance. The last amendment to the ordinance covered whether or not mezzanines were :o be included in the Floor Area Ratio. -2— On motion of Mr. Davis, :seconded by Mr. Bea',ty and voted mezzanines were excluded from Floor Area Ratio. After passage of the amendments Ordinance No. 205 amending the Zoning Code of Bal Harbour Village was passed on motion of Mr. Krez, seconded by Mr. Ta.plin and voted. Mr. caul, attorney for Bat Harbour Shops, presented additional cards endorsing expansion of the Center. Mr. Maley said that the Corps of engineers have placed about 50,000 ,yards of sand at the Singapore to replace sand 'Lost before the Surfside portion of the beach war, completed, but th.:t an emergency fit1 of about 3,000 more yards is needed at the Americana Hotel for the landscaping project. Mr. Maley asked permission to waive formal bids and bring sand in by truck at $5,00 per yard. It was moved by Mr. Davis, that the emergency existsanu bids should be waived for the needed sand. The motion was seconded by Mr. xrez and voted. The condition of beaches due to oil spills was discussed and on motion of Mr. Beatty seconded by Mr. Davis and voted, Mr. Gold was aked to pre— pare a resolution known as Resolution No. 2614 requesting the Coast Guard and Corps of Engineers to enforce legislation against tankers releasing oii. Mr. James Sims appeared before the council to explain the delays in the storm sewer project as there have been many complaints from the residents regarding the progress of his job. It was the consensus of the council that the December meeting should be held on December 19th at 9:'0 A. M. due to the holidays. Mr. Maley reported that he, Mr. Gold and Mr. Males and Mr. Horwitz from Bay Harbor Islands had met with Mr. O'Brien, City Manager of Miami Beach, regarding the water rate suit. It is their opinon that the litigation must exhaust itself before :cny negotiations can begin, Mr. Ralph Gimel of the Bal Harbour Resort Association explained the program they were planning for the holidays to attract people to the hotels. Mr. Maley sail the affairs would be conducted on the hotel property and would be reimbursed a an approved function of the Tourism Department.
