RESOLUTION NO. g* / O - 2/
RESOLUTION GRANTING A CONDITIONAL USE
PERMIT TO JOHN AND MARTHA DANIELS
FOR AN ACCESSORY STRUCTURE
WHEREAS, John and Martha Daniels (Applicants) own property
located at 2472 Parkview Drive which is zoned Rural Residential;
and
WHEREAS, the Applicants have applied for permission to
construct a 25' x 33' accessory structure on their property for
their private and non-commercial use; and
WHEREAS, Section 826.21 of the Medina zoning ordinance
requires a conditional use permit for the construction of an
accessory structure under the circumstances requested by the
Applicants; and
WHEREAS, the proposal has been fully reviewed by the Plan-
ning Commission and City Council for its compliance with the
standards of the Medina zoning ordinance, particularly its impact
on adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that the construction of a 25' x 33'
accessory structure for the private and non-commercial use of the
Applicants is consistent with the ordinances of the City and will
not impede the development of adjacent property and that a
conditional use permit for same is hereby granted, subject to the
following conditions:
1. The accessory structure shall be solely for the private,
non-commercial use of the Applicants in connection with
their hobbies.
2. The accessory structure shall not be rented or used as
living quarters, or for instructional purposes.
3. The accessory structure shall be connected to the existing
drainfield for the house.
4. Any change in use or ownership of the accessory structure
shall be reviewed by staff for compliance with the ordi-
nances of the City and the terms and conditions of the
conditional use permit.
BE IT FURTHER RESOLVED by the City Council of the City of
Medina that the conditional use permit granted hereby shall
remain in effect so long as all conditions enumerated herein or
by the ordinances of the City are met and that any violation of
the conditions enumerated herein shall be deemed to be a vio-
lation of the Medina zoning ordinance.
