RESOLUTION NO. :6 -8
RESOLUTION GRANTING CONDITIONAL USE
PERMIT TO THE CITY OF MEDINA FOR
TWO RADIO ANTENNAS AT CITY HALL
WHEREAS, the City of Medina (Applicant) has applied for
permission to erect two radio antennas at its municipal building
located at 2052 County Road 24 which would extend 13 feet above
the roof line of the building; and
WHEREAS, Section 825.21, subd. 11 of the Medina city code
requires that a conditional use permit be granted for any antenna
which will extend five or more feet above the roof; and
WHEREAS, the proposal has been reviewed by the Planning
Commission and City Council for compliance with all the ordi-
nances of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, Minnesota that the two proposed radio antennas
are consistent with the City's zoning ordinance and will not
impede the development of adjacent property and that a condition-
al use permit for same is hereby granted, subject to the follow-
ing conditions:
1. The antennas shall be constructed in substantial compliance
with the drawings reviewed by the Planning Commission and
City Council and shall be of a design which is compatible
with the architecture of city hall.
2. The operation of the antennas shall cause no interference
with radio or television reception on nearby properties.
3. Installation of the antennas shall be in accordance with all
applicable City codes and regulations.
4. The City shall obtain adequate liability insurance against
personal injury or property damage caused by the collapse of
an antenna.
BE IT FURTHER RESOLVED by the City Council of Medina that
the conditional use permit shallremain valid for so long as all
conditions enumerated herein or in the Medina city code are met
and that a violation of any of the conditions enumerated herein
shall be deemed to be a violation of the Medina zoning ordinance.
