A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, DECLARING THE
CITY'S INTENT TO DEED CERTAIN VACANT CITY-
OWNED PROPERTY IDENTIFIED BY FOLIO NO. 08-2128-
007-0270 TO CREATIVE CHOICE HOMES XXXVHI, LTD
FOR A PROPOSED SENIOR HOUSING DEVELOPMENT
PURSUANT TO CERTAIN CITY CONDITIONS AND
RESTRICTIONS
WHEREAS, Creative Choice Homes XXXVIII, Ltd. ("CCH") is developing an
affordable senior housing project on Alexandria Drive in the City of Opa-locka("City"); and
WHEREAS, CCH is proposing redevelopment of sections West of NW 32nd Avenue,
also known as the Nile Gardens subdivision, as part of an affordable senior housing project; and
WHEREAS, CCH has requested a property transfer and the City Manager has
determined that a donation and transfer of the City-owned vacant parcel located at 13210
Alexandria Drive, also identified by Folio #08-2128-007-0270, to CCH is necessary in order to
make the project possible; and
WHEREAS, without acquiring the vacant City-owned land, the City Manager has
determined that CCH will be unable to meet the density and acreage requirements for the project;
and
WHEREAS, the City Manager is recommending that subject to the City's site plan and
other review processes, that the City Commission declare its intent to provide a quit claim deed
for the transfer of property to CCH subject to the following restrictions: (a) The property shall be
used as regular or overflow parking for the Senior Housing Project; or (b) The property shall be
used for a recreational leisure park or clubhouse space for the Senior Housing Project; or(c) The
property shall be used as a means of ingress or egress for the Senior Housing Project; or (d) The

property shall be used for any other purpose approved for development by subsequent resolution
of the City Commission; and
WHEREAS, the City Manager is further recommending that the City Commission
declare its intent to transfer the property subject to the additional condition that CCH qualify for
housing tax credits from the Florida Housing Finance Corporation for this project within a period
of twenty-four(24) months from the passage of this resolution; and
WHEREAS, the City Manager hereby recommends that if CCH does not qualify for
housing tax credits from the Florida Housing Finance Corporation within a period of twenty-four
(24) months from the passage of this resolution that the City Commission rescind its declaration
and intent to quit claim deed city-owned property to CCH without further action of the
Commission.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. The recitals to the preamble are hereby incorporated by reference.
Section 2. The City Commission of the City of Opa-locka, subject to a site plan and
other City review processes, hereby declares its intent transfer by quit claim deed a vacant parcel
of City-owned land located at 13210 Alexandria Drive, also identified by Folio # 08-2128-007-
0270 to Creative Choice Homes XXXVIII, Ltd., subject to the following conditions and
restrictions: (a) The property shall be used as regular or overflow parking for the Senior Housing
Project; or(b) the property shall be used for a recreational leisure park or clubhouse space for the
Senior Housing Project; or (c) the property shall be used as a means of ingress or egress for the
Senior Housing Projector; or (d) The property shall be used for any other use approved for
development by a subsequent resolution of the City Commission.

Section 3. The City Commission of the City of Opa-locka further declares that if
Creative Choice Homes XXXVIII, Ltd., fails to qualify for housing tax credits from the Florida
Housing Finance Corporation for the subject development within a period of twenty-four (24)
months from the passage of this resolution that the City Commission rescind its offer and
declared intent to transfer the City-owned property without further action of the Commission.
Section 4. This resolution shall take effect immediately upon adoption.

Request: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA, DECLARING INTENT TO TRANSFER
VACANT CITY-OWNED PROPERTY, IDENTIFIED BY FOLIO
08-2128-007-0270, TO CREATIVE CHOICE HOMES, Ltd.; AS THE
CITY'S CONTRIBUTION IN THE COMPREHENSIVE
DEVELOPMENT OF THE SENIOR HOUSING DEVELOPMENT
PROJECT IN THE NILE GARDENS SUBDIVISION; FURTHER
AUTHORIZING THE CITY MANAGER TO ENTER INTO AND
EXECUTE AN AGREEMENT FOR THE TRANSFER OF SAID
PROPERTY. PROVIDING FOR SEVERABILITY AND
EFFECTIVE DATE.
Description: Transfer of City Owned property to Creative Choice Homes, Ltd for the
development of a senior housing apartment project.
Financial Impact: The proposed Senior Housing development will generate a substantial
increase in Ad Valorem tax at the completion of the project.
Implementation Time Line: Immediately, upon approval of this resolution.
Legislative History: None
Recommendation(s): Staff is recommending the approval of the Resolution declaring
intent to transfer city owned property to Creative Choice Homes, Ltd.
for the development of Senior Housing Apartments.
Analysis: The principals of Creative Choice Homes, Ltd. made a presentation to
City Manager's staff concerning their revitalization plan through the
development of an affordable senior apartment project on Alexandria
Drive. This comprehensive plan includes the redevelopment of sections
West of North West 32nd Avenue, better know as Nile Gardens
Subdivision. The project includes the assembling of eight to ten parcels of
land to make up parcel B (see-attached plan) for the Senior Housing
Project consisting of approximately 140 units. Moreover, the housing
project will comprise the common area amenities such as a clubhouse, a
leasing office, a recreational area, which were not included in Parcel B and
Creative Choice Homes, Ltd. is requesting the city owned parcel to satisfy
the amenity requirements on Parcel A. (see-attached plan)
The City of Opa-locka imposes the following conditions for the transfer
of the aforementioned property:
(1) The transferred land shall be used as regular or overflow Senior
Housing Project parking; recreational Leisure Park or Clubhouse
space; or any other use approved for development by the City
Commission.
(2) The proposed project must be completed within a two-year period
commencing from the date of the City Commission Site Plan Approval
or the land reverts to the City of Opa-locka.
(3) The project must be subject to the City's site plan review process.

Dear Mr.Leonard:
Per our discussion last week,this letter is the request for Municipal help to make the above Project
feasible.
One of the items we need is the City property at:
13210 Alexandria Drive
Folio 08-2128-007-0270
64,000 SF owned by City
Our desires include to include the acreage in our density calculations, use part of this site for project
parking,provide outdoor recreation&to construct the Senior Clubhouse component.
We also request that the City waive the building permits fees&impact fees for this Senior Housing
Development.
With the above assistance from The City of Opa-locka,we feel the Florida Housing Finance Credit Tax
Credit Program will look favorably of our Proposal.

Re: Proposed Affordable Senior Housing on Alexandria Drive
SCOPE OF PROJECT
Our goal is to develop& manage an affordable senior apartment building on Alexandria Drive in Opa-locka.
Creative Choice Homes is assembling the 8-10 parcels to make up Parcel B on the Proposed Concept Site
Plan attached. Our financial study requires 140 units.
Parcel B is not large enough to include the desired common area amenities including the Clubhouse,Leasing
Office&recreation areas.
Creative Choice requests help from the City of Opa-locka to add Parcel A to our complex. This will
provide the land we need for the amenities we feel is critical to the success of this development. This
will also provide some of the"local contribution"so necessary for State Tax Credit selection.
We feel this is an excellent location for this complex. It will help stabilize the neighborhood. By keeping
Alexandria Drive without thru access, it will remain quiet &pedestrian-friendly.

Professional Staff-Parent Company- Creative Choice Homes, Inc.
The Creative Choice team is comprised of some of the brightest and socially
motivated professionals in the industry of affordable housing revitalization and
development. The core team members possess extensive experience in public housing
and real estate development, planning, financing, construction, accounting, legal,
management, relocations and other related fields. While the Creative Choice
professional staff works harmoniously to achieve the project goals, each team member
has a distinct area of functional responsibility based on corporate division of labor.
The Creative Choice professional staff consists of:
. Dilip Barot, President. Mr. Barot has over fifteen years of experience in real
estate development, investment and management. He has been responsible
for the creation of a number of programs and mechanisms that have raised the
level of public and affordable housing, as well as development. Mr. Barot's
strongest quality is his vision for the improvement of affordable housing,
along with his ability to bring harmony among people and programs to
achieve a common goal.
• Keith Dusenberry, Keith has been professionally involved in commercial real
estate development for most of his 30 year career. His real estate expertise has
culminated from past employments with Banks, the Resolution Trust
Corporation (RTC), the State of Florida's Affordable Housing Corporation as
Director of the Tax Credit Division, Professorships at three major Universities
and as a Developer Partner and Principal. One of Keith's most challenging
positions was employment with San Antonio Savings Association as Senior
Vice President and Director of Construction and Development for the Bank's
wholly owned Development entity, The Real Estate Group. Keith holds an
advanced degree from The Florida State University.
• Yash Pal Kakkar, Director of Accounting and Finance. Mr. Kakkar holds a
Bachelors Degree in Commerce and was a Chartered Accountant in India. Mr.
Kakkar has been involved in Senior Level Accounting and Finance positions
throughout India including a number of multi-national companies. He is well
versed in all aspects of international accountancy and financial management.
• Ashok Kumar, Controller for Naimisha Construction, Inc. the construction arm of
Creative Choice Group.In this role he is responsible for managing the financial affairs
for Naimisha Construction. He s a Certified Public Accountant from India and has
held senior management position over 15 years with large corporation in India and
abroad. Previous to Naimisha Construction, Inc. he headed the corporate and legal
affairs of Creative Infocity Limited and Effective Teleservices,Inc.
• Robert P. Snow, Planning &Architecture (Bob Snow Associates). Mr. Snow
has an extensive experience in all aspects of engineering,building and
architecture.He holds an MBA in Real Estate Management.Mr. Snow is a
Florida licensed Building Contractor and has a Florida Architect license&
NCARB.He is also licensed to practice architecture in Texas&Nevada.
• Yashvant Barot, Project Engineer. Prior to his position with Creative Choice
Mr. Barot served as an Assistant Engineer then Deputy Executive Engineer,
Roads & Building Department (Public Works) for the Government of Gujarat.
Mr. Barot received a Bachelor of Civil Engineering from Sardar Patel
University,India.
. Jason Larson, Vice President of Development/Acquisitions.Mr.Larson holds a
Bachelors degree in Finance and Real Estate from Florida State University.
Mr. Larson is well versed in all aspects involved in the development and asset
management of multi family housing and has been involved in over
$250,000,000 in multi family real estate transactions. Prior to joining Creative
Choice, Mr. Larson was a Sr. Analyst at Ocwen Federal Bank, F.S.B. involved
in the acquisition and disposition of multi family housing as well as the
servicing and work out of troubled commercial real estate mortgages in excess
of$3,000,000.
