AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI,
PERTAINING TO THE NEIGHBORHOOD IMPROVEMENT PROGAM.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Chapter 32 (Street and Sidewalks), Article XI (Neighborhood Improvement
Program) is amended as follows:
ARTICLE Xl.NEIGHBORHOOD IMPROVEMENT PROGRAM
Sec.32-330. Purpose.
The purpose of this Article is to provide encouragement and cooperation for the making of improvements
to streets,sidewalks and other infrastructure through a voluntary program of citizen participation in cost.
Sec.32-331. Petition necessary.
For each project which may be eligible for inclusion in the City's Neighborhood Improvement Project
(NIP), a petition shall be submitted by the owners of the requisite front footage as specified in this Article by March
1" of each vear for consideration for the following year's fiscal budget to the Director of Public Works.
Petitions shall be considered approved if the project is identified and funded in the following vear's budget.

Sec.32-332. Participation Requirement.

Director of Public Works, to construct proiects which involve the rebuilding of any street ar PeFtien
thereof-, inGk1ding curb and gutter, pavement, or sidewalks, etc:, for an entire block, which shall be
petitioned by greater than seventy-five €#y percent 75% (50/°O of the owners of the front footage
abutting the proposed projects.

Sec.32-333. Cost to Applicant.
A For each proiect included in the NIP and funded, the cost to each abutting property owner shall be
set by the City Administrator each year in Appendix Y.
B At least seventy-live percent (75%) of abutting property owners must agree to prepay the entire
amount of their cost-share prior to approval of the construction contract by the Citv Council or City
Administrator.
C. Any party which fails to prepav the party's full cost-share of the project shall be charged an
additional twenty-five percent (25%). Such person's share shall be placed as a lien against the
property as part of a tax bill pursuant to Section 32-40,32-41.and 32-42 of the City Code.
Sec.32-334. Funding,criteria for project selection.

following criteria will be considered:
A. Funding available.
B. Number of properties affected
C. Existing conditions
D. Property share prepaid vs.tax bill
E. Overall effect on area
Sec.32-335.Street lighting in improved subdivisions.
A. Where street lighting doesn't meet the minimum requirements of 33-9(E).Abutting property owners may
petition the City for street lighting. The Director of Public Works Planning nna protective comes may
approve street lighting request,within budget constraints based on the following criteria.
I. Installation of the street lights will generally be at spacings no less than 250 feet(residential)and
180 feet(commercial).

when needed for traffic safety.
3. The City may grant additional lighting on the basis of high concentration of pedestrian traffic such
as downtown,school areas,serious traffic hazards, or high incidence of crime as determined by
the Chief of Police.The latter would not relieve the property owner of the responsibility of
security lighting.
B. Property owners requesting lighting would pay 25%(residential)and 50%(commercial)for installation and
the City would install and pay for maintenance and operation when installation is approved.
C. Objections to the decision of the Director of Public Works ^- iees with respect
to placing of street lighting can be appealed to the City Council within thirty(30)days of the decision of
the Director of Planning and Protective Services.

Section 2. Appendix Y is amended by the addition of a new fee as follows:
Chapter 32-333 Neighborhood Improvement Program $25.00 rimer linear foot
Section 3. Any Neighborhood Improvement Project received by the City before
December 19, 2011 but not acted upon before the enactment date of this ordinance, shall be
considered pursuant to merits and costs to the applicant of this Article as it was in force on that
date.
Section 4. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.
