HomeMy Public PortalAbout1986-014Member /Pi44:e, introduced the following resolution and moved its adoption: CITY OF MEDINAQ RESOLUTION NO. dr‘-/1/4 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO TOM KELLIN WHEREAS, Tom Kellin (Applicant) owns property located at 4555 Pioneer Trail which is zoned rural residential (RR); and WHEREAS, Applicant has applied to construct an accessory building on his property to operate a horse training and breeding facility; and WHEREAS, Section 826.21 of the Medina Code of Ordinances permits such facilities within the RR district provided the City Council grants a conditional use permit; and WHEREAS, the proposal has been reviewed by the Planning Commission and City Council for compliance with ordinance stan- dards. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the proposed horse training and breeding facility is consistent with the City's zoning ordinance and will not impede the development of adjacent property and that a conditional use permit for same is hereby granted, subject to the following conditions: 1. The two parcels of land owned by the applicant on both sides of Pioneer Trail and comprising approximately 23 acres shall be combined for tax purposes per the subdivision ordinance. The combined parcel may not be re -subdivided prior to removal of the accessory structure for the horse training and breeding facility. 2. The total number of accessory structures to be located on the combined parcel shall not exceed three, shall not exceed an aggregate size of 20,000 square feet and shall be located a minimum of 150 feet from all property lines. 3. There shall be no outside storage except for licensed vehicles and a manure storage dumpster, which shall be screened from public view. 4. There shall be no more than 40 horses housed at the facility at any time, and all horses shall be owned by the Applicant. 5. The method of manure removal shall comply with the guide- lines of the Minnesota Pollution Control Agency. 6. There shall be no more than four employees at any time and adequate parking for the employees shall be provided on site. 7. Any signs which the Applicant may construct shall comply with the requirements of the Medina sign ordinance for RR districts. 8. There shall be no outside public address system. 9. The facility shall be for the use of the Applicant only and there shall be no horse shows or presentations at the facility which involve 25 or more persons. 10. The Applicant shall install two mercury vapor fixtures for outside lighting, which fixtures shall be downward facing to avoid broadcasting light off the premises. 11. The Applicant shall install and maintain fencing adequate to contain the horses in a secure manner. 12. The Applicant shall dedicate or convey to the City right-of-way along Highway 55 and Pioneer Trail in an amount and location as may be required by the Medina zoning admin- istrator. 13. The Applicant shall convey to the City a temporary con- struction easement 10 feet in width along the north side of Pioneer Trail. 14. There shall be no parking of vehicles associated with the facility on or along the right-of-way of Pioneer Trail. 15. The Applicant shall install a septic system in connection with the living quarters in the accessory horse building which is satisfactory to the Medina zoning administrator. 16. The living quarters shall be used exclusively as housing for persons employed in operation of the facility. 17. The Applicant agrees to use wooden materials for the sides and metal for the roof of the accessory horse structure. BE IT FURTHER RESOLVED by the City Council of the City of Medina that a violation of any of the above conditions shall be deemed to be a violation of the Medina zoning ordinance.
